AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM
MLrLTI-FAMILY 1 (MF-1) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION
TO COMMERCIAL CONDITIONED (CIe]) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION FOR 0 58 ACRES OF LAND LOCATED ON THE EAST SIDE OF WOODROW
LANE, SOUTH OF MCKINNEY STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE (Z-99-017)
WHEREAS, Eric Fry, on behalf of Thomas Whatlock, has apphed for a change m zomng for
0 58 acres of land from a Multa-famfly 1 (MF-1) zomng &strict clasmficataon and use demgnat~on
to a Commercxal (C) zoning thstnct clasmficat~on and use demgnatlon, and
WHEREAS, on April 14, 1999, the Planmng and Zomng Commasmon recommended
approval of the requested change m zomng, and
WHEREAS, the City Council finds that the change m zomng wall be ~n compliance wath the
1988 Denton Development Plan, the 1998 Denton Plan Pohcles, and the 1999 Growth Management
Strategies and Plan, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~_I That the zoning district clasmficataon and use demgnanon of the 0 58 acre
property described m the legal description attached hereto and ancorporated herean as Exhabat A as
changed from Multi-family 1 (MF-1) zoning district clasmficataon and use designation to
Commercml Conditioned (C[c]) zoning dmtnct clasmficataon and use demgnanon under the
comprehensive zomng ordinance of the City of Denton, Texas, subject to the following conchtlon
1 Lighting on the property shall be designed and mmntmned so as to heather sh~ne on or
ofiaerw~se chsmrb, surrounding remdentml property, nor to shine and project upwards and
diffuse hght into the mght sky
~ That the City's official zomng map as amended to show the change ~n zomng
district elasmficanon
~ That any person wolatang any prowmon of th~s or&nance shall, upon
convacnon, be fined a sum not exeee&ng $2,000 00 Each day that a provision of tbas ordinance as
wolated shall constitute a separate and distinct offense
~ That thru ordinance shall become effectave fourteen (14) days from the date
of as passage, and the City Secretary m hereby directed to cause the capnon of this or&nanee to be
pubhshed twice m the Denton Reeord-Chromcle, a daffy newspaper pubhshed m the Caty of Denton,
Texas, within ten (10) days of the date of its passage
