TO THE CONDITIONS OF ORDINANCES 89-171, 92-033, 94-126, AND 96-048 WHICH
ESTABLISHED CONDITIONED LIGHT INDUSTRIAL (LI[C]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 64 4155 ACRES OF LAND LOCATED ON
THE SOUTH SIDE OF MCKINNEY STREET AND THE WEST SIDE OF WOODROW LANE,
PROVIDING FOR A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE (Z-99-035)
WHEREAS, Joseph Santopetro, on behalf of Denton County, has applied for an amendment
to the conditions of Ordinances 89-171, 92-033, 94-126, and 96-048, wluch estabhshed a
Cond~tloned Light Indusmal (LI[c]) zomng dlsmct classification and use designation for 64 4155
acres of land, and
WHEREAS, on May 26, 1999, the Planmng and Zoning Commission considered the
rezonmg request and based on a 2-2 vote does not forward a recommendation to the City Council
regarding the requested change in conditions of Or&nantes 89-171, 92-033, 94-126, and 96-048,
and
WHEREAS, the City Council finds that the change in the conditions of Ordinances 89-171,
92-033, 94-126, and 96-048 vall be m comphance with the 1998 Denton Plan Policies, and the 1999
Growth Management Strategies and Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the conditions of Ordinances 89-171, 92-033, 94-126, and 96-048, which
estabhshed conditioned Light lndusmal (LIlt]) zomng d~smct classfficatlons and use deslgnatmns
for the subject 64 4155 acre property, described in the legal description attached hereto and
~ncorporated hereto as Exhibit A, are amended under the comprehensive zoning ordinance of the
City of Denton, Texas, as follows
1 a That only public bmkhngs, including correctional factht~es, for local, state, or federal
governments and professional and admlmstratlve offices be permitted
b That there will be no curb cuts on Ruddell Street
c That a fence will be erected from H~ckory street to the creek along Ruddell Street
SECTION II That the prows~ons of th~s ordinance shall govern and control over any
conflmtmg prowsions of Ordinances 89-171, 92-033, 94-126, and 96-048, but all prows~ons of
Ordinances 89-171, 92-033, 94-126, and 96-048 as they apply to the rematmng port~on of the zomg
d~smct land use regulations not here~n amended, shall continue ~n full force and effect
SECTION III That a copy of this ordinance shall be attached to Ordinance 89-171, 92-033,
94-126, and 96-048 showing the amendments here~n approved
SECTION IV That any person wolatlng any prows~on of th~s ordinance shall, upon
conwct~on, be fined a sum not exceedang $2,000 00 Each day that a pmws~on ofth~s ordinance ~s
v~olated shall conmtute a separate and dastmct offense
SECTION V. That this ordinance shall become effective fourteen (14) days fi.om the date
of ~ts passage, and the C~ty Secretary ~s hereby d~rected to cause the caption of ttus ordinance to be
pubhshed twine m the Denton Record-Chromcle, a dmly newspaper pubhshed ~n the C~ty of Denton,
Texas, within ten (10) days of the date of~ts passage.
