1999-207AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM ONE-FAMILY DWELLING (SF-7) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO PLANNED DEVELOPMENT (PD) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 6 081 ACRES OF LAND LOCATED EAST OF RLrDDELL APPROXIMATELY 70 FEET SOUTH OF LATTIMORE STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z-99-031) WHEREAS, Marvin Morgan, on behalf of Gregory Hollar, has applied for a change m zoning for 6 081 acres of land from one-famdy Dwelling (SF-7) zoning district classification and use designation to Planned Development (PD) zomng d~smct classfficat~on and use designatmn, and WHEREAS, on May 26, 1999, the Plaunmg and Zoning Comm~ssmn recommended approval of the requested change m zomng, and WHEREAS, the City Council finds that the change m zomng will be ~n comphance w~th the 1988 Denton Development Plan, the 1998 Denton Plan Policies, and the 1999 Growth Management Strategies and Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zomng district classfficatmn and use designation of the 6 081 acre property described m the legal description attached hereto and incorporated herein as Extublt A is changed from One-family dwelling (SF-7) zonmg district classffieatlon and use designation to Planned Development (PD) zomng chstnct classification and use designation under the comprehensive zomng ordinance of the Cay of Denton, Texas, subject to the following condmons 1 That permitted land uses be restricted to those uses permitted, including those uses subject to specific use permits, in a SF-7 zoning district 2 That alternative street secUons be allowed subject to staff approval, ~ncludlng but not limited to a Forty (40) feet of right-of-way with a twenty-two (22) foot street secUon with parking allowed on only one side of the street or b Fifty (50) feet of right-of-way with a thirty-one (31) foot street section w~th parking allowed on both s~des of the street and traffic calming devices used to reduce the street section at intermittent sections along the street 3 That development shall be consistent with the detmled plan attached hereto and incorporated hereto as Exhibit B SECTION II That the C~ty's official zoning map ~s amended to show the change ~n zoning dastnct classfficat~on SECTION III That any person v~olat~ng any proms~on of th~s ordinance shall, upon conwct~on, be fined a sum not exceeding $2,000 00 Each day that a prows~on ofth~s ordinance ~s wolated shall constitute a separate and d~st~nct offense SECTION 1V That th~s ordinance shall become effective fourteen (14) days from the date of~ts passage, and the C~ty Secretary ~s hereby d~rected to cause the caption of ttus ordinance to be pubhshed twine m the Denton Record-Chromcle, a dmly newspaper pubhshed ~n the C~ty of Denton, Texas, w~th~n ten (10) days of the date of~ts passage , PASSED AND APPROVED th~s the/~-~fft day of (fir/Z~L~' , 1999 JAC~ ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY PAGE 2 EXHIBIT A Z-99-031 FIELD :IO~ES TO 6.081 ACRES I;t THE ~.
