1999-216F \shared~depflLGL\Our Documents\Ord~nances\99~Araend Chapter 6 Impounded Ammal Agencies doc AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ARTICLE I OF CHAPTER 6 OF THE CODE OF ORDINANCES RELATING TO "ANIMALS" BY ADDING SECTION 6-37 TO PROVIDE FOR THE TRANSFER OF IMPOUNDED ANIMALS TO HUMANE SOCIETIES OR OTHER SIMILAR AGENCIES, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Legislature has enacted legislation, codified as the Texas Health and Safety Code, Chapter 828, winch sets out requirements for lmmumzatlon and stenhzatlon of dogs and cats adopted from releasing agencies, and WHEREAS, Chapter 828 of the Texas Health and Safety Code provides that releasing agencies may be pubhe or private ammal pound, shelter, or humane orgamzat~on, and WHEREAS, xt would be m the interest of the City of Denton to allow transfer of the custody of impotmded anxmals to animal shelters or humane organizations to be the releasing agency responmble for complying with Chapter 828 of the Texas Health and Safety Code, and WHEREAS, the transfer would be made without any fee because the animal shelter or humane orgamzatlon would be the releasing agency responsible for complying wxth animal adoptmn laws, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ That Chapter 6 of the Code of Ordinances titled "Ammals" ~s hereby amended by adding Section 6-37 which shall read as follows 6-37 Transfer of Antmais to other Releastng Agenctes The custody of dogs and eats ehg~ble to be placed for adoption under Section 6-33 may be transferred without fee to animal shelters or humane organ~zatmns so that these organizations may act as releasing agencms and place the animals for adoption pursuant to Chapter 828 of the Texas Health and Safety Code Before any ammals will be transferred to other releasing agencies, these agencies must meet any adm~mstrat~ve requirements estabhshed by the C~ty of Denton Ammal Control Department All responminhtles reqmred of releasing agencms under Chapter 828 for the adoption, lmmumzatlon and stenhzat~on of impounded animals shall be solely the raspons~blhty of the ammal shelters or humane organizations and the City of Denton shall retain none of these responminhtles upon transfer The transfer of the animals ehg~ble for adoption to alternate releasing agencies shall be made without any fee SECTION II If any sectmn, subsection, paragraph, sentence, phrase or word m tins ordinance, or apphcat~on thereof to any person or circumstance ~s held mvahd by any court of competent junsdmtlon, such holding shall not affect the vahdlty of the remmmng porhons of tins ordinance, and C~ty Councd of the C~ty of Denton, Texas hereby declares ~t would have enacted such remaimng portions despite any such ~nvalld~ty ~ That the repeal of any ordmance or any port~on thereof by the preceding sections shall not affect or ~mpmr any act done or right vested or accrued or any proceeding, stat or prosecution had or commenced m any cause before such repeal shall take effect, but every such act done, or right vested or accrued, or proceedings, stat or prosecution had or commenced shall remain in full fome and effect to all intents or purposes as ff such ordinance or part thereof so repealed shall remmn ~n fome ~ That save and except as amended hereby all the remmmng sections, subsections, sentences, phrases and clauses of Chapter 26 of the City Code shall remmn ~n full rome and effect SECTION V That this orchnance shall become effective fourteen (14) days from the date of th~s passage, and the City Secretary is hereby d~rected to cause the caption of this ordinance to be pubhshed twice ~n the Denton Record Chromcle, the officml newspaper of the City of Denton, Texas, w~thm ten (10) days of its passage PASSED AND APPROVED thls the /t--~dayof ~'~4~/ ,1999 JAC~L/LER, MAYOR ATTEST' JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY
