1999-219 ORDINANCE NO AN ORDINANCE AMENDING ARTICLE I, CHAPTER 22 OF THE CODE OF ORDI- NANCES OF THE CITY OF DENTON TO CREATE A PARKS AND RECREATION BOARD COMPOSED OF SEVEN MEMBERS WHO SHALL MAKE RECOMMENDA- TIONS ON PARKS AND RECREATION TO THE CITY COUNCIL AND THE DIRECTOR OF PARKS AND RECREATION IN AN ADVISORY CAPACITY, AND SHALL PERFORM OTHER FUNCTIONS AS SET FORTH 1N THE BODY OF THIS ORDINANCE, PROVID- ING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE WHEREAS, on May 1, 1999, m an election to amend the City Charter held concurrently with the regular election to elect couneflmembers, the citizens amended Section 11 02 "Parks and Recreation Board" of the City Charter by deleting the Parks and Recreation Board from the Charter and requmng that a new board composed of at least seven members be created by ordi- nance, and WHEREAS, the City Council deems it in the public interest to create a seven-member board to advise the City Council and the Director of Parks and Recreation on park and recrea- tional activities, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Article I "In General" of Chapter 22 "Parks and Recreation" of the Code of Ordinances of the City of Denton is hereby amended by amending Section 22-1 and adding Sections 22-2 through 22-4, which shall read as follows Sec 22-1. Board appmnted There is hereby created a park and recreation board which shall consist of seven residents of the City of Denton, Texas The members of the park and recreation board shall be appointed by the City Council for a term of two years Board members shall be eligible for reappolntment in accordance with Section 2-65 of the Code of Or&nantes The board shall elect its chairperson from among its members, and he or she shall serve for two years, or until his or her successor is elected and qualified All members of the board shall serve without pay, and the board shall adopt such rules of procedure and other rules as may be necessary for the regulation of its busi- ness and affairs Sec 22-2. Attendance All members of the board shall comply with the provisions pertmmng to all boards and commissions set forth m Sections 2-61 through 2-65 and 2-81 through 2-84 of thru Code of Ordi- nances Section 2-83(c) states that the unexcused absence of any board member for more than three regularly called and scheduled meetings of the board in any one year or lack of attendance of more than 50% of the number of regular meetings m a year, unless such absence is the result of a personal or family illness or death, shall be considered "cause", as that term is used in Sec- t~on 14 16 of the Charter, for removal of the member by the C~ty Council from such board Board members shall be subject to removal in accordance w~th th~s section and other applicable prowslons of this Code of Ordinances, the City Charter, and other applicable laws Sec. 22-3 Advisory board The board shall serve in an advisory capacity to the City Council and the Director of Parks and Recreation The board and the D~mctor of Parks and Recreation shall meet b~-monthly and at such other times as the board may, by resolution, determine The board shall submit to the City Council an annual report of its operations, together with its recommendations for the ~m- provement of the park and recreation program as it may deem appropriate Sec 22-4. Duties. The board shall endeavor to stimulate public interest m the development and maintenance of parks and playgrounds, and a well-rounded community-wide program, it shall endeavor to in- terpret the work of the Park and Recreation Department and promote close cooperation between the C~ty and all private citizens, restitutions, and agenmes, to the end that all park and recrea- tmnal facilities and resources w~thm, or controlled by, the City may make their maximum contn- bntlon to the pubhc welfare ~ That if any section, subsection, paragraph, subparagraph, sentence, clause, phrase, or word in th~s ordinance, or apphcat~on thereof to any person or c~rcumstance ~s held mvahd by any court of competent junsdmt~on, such holding shall not affect the vahdlty of the remaining portions of this ordinance, and the City Council of the C~ty of Denton, Texas hereby declares it would have enacted such remmnmg portmns despite any such vahdlty SECTION III That save and except as amended hereby, all the sections, subsections, sentences, clauses, and phrases of Chapter 22 of the Code of Ordinances of the City of Denton shall remmn in full force and effect ~ That this ordinance shall become effective ~mmed~ately upon its passage and approval ~fT~d f PASSED AND APPROVED this the [5/ ay o \(/~,-~-~ ,1999 ATTEST JENNIFER WALTERS, CITY SECRETARY Page 2 APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY £ Page 3
