1999-221 ORDIN CE NO q ¢'A; / AN ORDINANCE OF THE CITY OF DENTON, TEXAS, ANNEXING A TRACT COMPRISING 125 ACRES, LOCATED ON THE WEST SIDE OF 1-35W AND NORTH OF CRAWFORD ROAD, PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTWE DATE (A-81) WHEREAS, the City of Denton wishes to extend its City limits line to include the 125 acre tract labeled as "Tract #2", desenbed in Exhibit A, and WHEREAS, public hearings were held in the Council Chambers on March 29th, 1999, and March 30th, 1999, to allow all interested persons to state their views and present evidence bearing upon this annexation, and WHEREAS, after a public hearing on April 14th, 1999, the City of Denton Planning and Zoning Commission recommended approval of the annexation by a vote of 4-2, and WHEREAS, annexation proceedings were instituted for the property described herein by the introduction of this ordinance at a meeting of the City Council on April 20th, 1999, and WHEREAS, this ordinance has been published in full one time in the official newspaper of the City of Denton after annexation proceedings were instituted and 30 days prior to City Council taking final action, as required by City Charter, and WHEREAS, the City Council finds that the annexation will be in compliance with the 1999 Growth Management Strategy, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the tract of land labeled as "Tract #2", described in Exhibit A, attached hereto and incorporated by reference, is annexed to the City of Denton, Texas SECTION II That the service plan attached as Exhibit B, and incorporated by reference, which provides for the extension of municipal services to the annexed property, is approved as part of this or&nance SECTION III The annexed property is temporarily classified as Agricultural (A) zoning district classification and use designation ~uO_!!9__~I_!X_ The City of Denton official zoning map is amended to show the Agricultural (A) zomng district and use classification of the property annexed SECTION V Should any part of this ordinance be held illegal for any reason, the holding shall not affect the remmnmg portion of this ordinance and the City Council hereby declares it to be its purpose to annex to the City of Denton all the real property described in Exhibit A regardless of whether any other part of the described property is hereby effectively annexed to the C~ty If any part of the real property annexed is already included within the clty limits of the C~ty of Denton or w~thm the hm~ts of any other c~ty, town or village, or ~s not wltlun the C~ty of Denton's jurisdiction to annex, the same is hereby excluded from the temtory annexed as fully as ff the excluded area were not expressly descnbed in this ordinance SECTION VI That th~s ordinance shall become effective fourteen (14) days from the date of its final passage, and the C~ty Secretary is hereby d~rected to cause the entire ordmance to be pubhshed once or the Pohce Protection In the short term, the Police Department can provide service to Tracts #1, #2, and #3 using ex~stmg resources, resulting ~n response times consistent with other undeveloped perimeter 1-35W / F M 2449 lntersectlun The City of Denton F~re Department Five-Year Strategic Plan m scheduled to be presented to City Council on March 30th, 1999 The plan w~ll provide additional detml regarding proposed fire and emergency service delivery to all parts of the c~ty, including Tracts #1, #2, and #3 C Water / Wastewater Services Current C~ty of Denton CIP funchng is programmed for the construction ora 20-mch water line extension that will reach the Hills of Argyle subdivision on U S 377 The line wall be extended further south to Tract #3 m a subsequent phase Construction of these ~mprovements will begin w~thm 2 years and will be completed within 4V2 years Development wltban Tract #3 is expected to run the hne west to 1-35W The property owners of Tracts #1 and #2 w~ll be expected to extend water lines from 1-35W to dehver water for development Interim water service options are available Wastewater service will be made avmlable through e~ther extensions from the Hickory Creek ~nterceptor sewer system or through on-s~te treatment plants that are owned, operated, and mmntalned by the C~ty of Denton See Annexation Servme Analyses for further detml D. Stormwater Drainage Serwces Dnun~ge improvements wall be made by property owners at the t~me of development Maintenance will be the responslbthty of the City of Denton, supported as a function of water and wastewater fund transfers p0ad by rate payers E Solid Waste Collection and Disposal Solid waste service are available to the annexed tracts Existing contracts between customers and private waste haulers will not be disturbed Equapment and personnel needed to serve new development will be added in proportaon to growth in the customer base F Electric Utilities Electric service will be made avaalable upon request to all of the property wathan the areas being annexed G. Parks~ and Recreation Services Neighborhood parks will be prowded as res~dentml growth occurs, as per the City of Denton Park Dedication 0rdanance One commumty park wall be needed an the longer term The comraumty park and additional personnel will be funded as appropriate through city funds H. Streets and Roads Crawford and Florence Roads, located on the perimeter of Tract #1, will not be annexed, and wall remain the responsibility of Denton County Johnson, John Poane, and Allred Roads m Tract #3 will be upgraded by private development, and ultimately maintained by the CaW of Denton F M 1830 (Country Club Road) as a state facahty and will be upgraded and moantamed by the Texas Department of Transportataon (TXDOT) I. Building Inspections / Code Enforcement Services Services are available now for the areas to be annexed Addataonal personnel will be dedicated to the areas to be annexed as d~ctated by growth J L~brary Services The Library Master Plan will determine the appropriate method of servace dehvery for all areas of the caty, and is near completion The plan will be presented to Caty Council in late April 1999
