AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM TWO-FAMILY DWELLING (2F) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION TO CENTRAL BUSINESS (CB) ZONING DISTRICT CLASSIFICATION
AND USE DESIGNATION FOR 3 ?9 ACRES OF LAND BOUNDED BY CARROLL
BOULEVARD, PEARL STREET, BOLIVAR STREET AND PARKWAY STREET,
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z-99-02g)
WHEREAS, Lake Cities State Bank on behalf of Pearl Street Church of Christ and Pearl
Street Church of Christ Elders has applied for a change in zoning for 3 79 acres of land from
Two-fam, ly Dwelling (2F) zoning district classfficat, on and use des,gnatlon to Central Business
(CB) zomng district classification and use des,gnatlon, and
WHEREAS, on April 14, 1999, the Planning and Zoning Commission recommended
approval of the requested change m zoning, and
WHEREAS, the City Council finds that the change in zoning will be in compliance with
the 1988 Denton Development Plan, the 1998 Denton Plan Policies, and the 1999 Growth
Management Strategies and Plan, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zomng district classification and use designation of the 3 79 acre
property described m the legal descnptxon attached hereto and incorporated herein as Extublt A
is changed from Two-famdy Dwelling (2F) zomng dlsmct classification and use demgnation to
Central Business (CB) zoning district classfficat~on and use designation under the comprehensive
zoning orchnance of the City of Denton, Texas, subject to the following conditions
1 Lighting on the property shall be designed and mmntalned so as not to shine on or
otherwise dmturb, surrounding residential property or to shine and project upward to
prevent the diffusion into the mght sky
2 As offered and agreed to by the applicant, the site shall comply with the new Landscape
Code, which reqmres fifteen (15) trees per acre and twenty (20) percent of all surfaces to
remmn pervmus (plantable area)
SECTION II That the City's official zoning map is amended to show the change in
zoning district classification
SECTION III That any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of thru ordinance
is violated shall constitute a separate and distinct offense
SECTION 1V That th~s ordanance shall become effective fourteen (14) days from the
date of ~ts passage, and the C~ty Secretary ~s hereby d~rected to cause the eaptmn of tbas
ordinance to be pubhshed twice m the Denton Reeord-Chromcle, a datly newspaper pubhshed m
the City of Denton, Texas, w~thm ten (10) days of the date or,ts passage
