AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM
AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO
A LIGHT,INDUSTRIAL WITH CONDITIONS (LI[C]) ZONING DISTRICT CLASSIFICATION
AND USE DESIGNATION FOR 2 39 ACRES OF LAND LOCATED AT 4401 EAST
MCK1NNEY STREET ON THE NORTHEAST CORNER OF MAYHILL ROAD AND
MCKINNEY STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF
$2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z-
99-027)
WHEREAS, Troy Glenn, the owner of the subject property, has applied for a change m
zomng for 2 39 acres of land from Agricultural (A) zomng d~stnct classification and use designation
to Light Industrial (LI) zoning district classification and use designation, and
WHEREAS, on May 12, 1999, the Planning and Zomng Commission recommended
approval of the requested change m zomng, and
WHEREAS, the City Council finds that the change m zoning will be in compliance with the
1988 Denton Development Plan, the 1998 Denton Plan Policies, and the 1999 Growth Management
Strategies and Plan, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the zoning dmtnct classification and use designation of the 2 39 acre
property described m the legal description attached hereto and incorporated herein as Exhibit A is
changed from Agricultural (A) zoning district classification and use designation to Light Industrial
with conchtions (LI[c]) zomng dlsmct classification and use designation under the comprehensive
zomng ordinance of the C~ty of Denton, Texas, subject to the following cond~Uons
1 Floor Area Ratio. Total developed floor area shall not exceed a 0 50 1 0 floor-to-area
ratio (F A R ) or 52,054 square feet
2 Llghtlng Lighting on the property shall be designed and mmntmned so as not to sh~ne
on, or otherwise d~sturb, adjo~mng property or to shine and project upward to prevent the
diffusion into the mght sky
SECTION 2 That the City's offic,al zoning map is amended to show the change in zoning
dlsmct classification
SECTION 3 That any person wolatmg any provision of th~s ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is
violated shall constitute a separate and distinct offense
SECTION 4 That thxs ordinance shall become effective fourteen (14) days from the date
ofxts passage, and the C~ty Secretary m hereby directed to cause the captxon of th~s ordinance to be
pubhshed twice m the Denton Record-Chromcle, a dmly newspaper published ~n the C~ty of Denton,
Texas, w~thm ten (10) days of the date of~ts passage
