II. General Information & Status Update
A. Upcoming Council Meetings and Events – Staff adjusted some timeframes given the
upcoming run-off elections on December 8. Please see as follows:
Mayor and Council Reception – Rescheduled
o The reception to honor Mayor Watts and all outgoing Council
Members has been rescheduled from Thursday, November 17, from 4-
6 p.m. to Thursday, Dec. 17 from 4-6 p.m. at the Denton Civic
Center.
Tuesday, November 17 Council Meeting at 6:30 p.m.
o This meeting will canvass the results of the election, swear -in elected
Members, and call for a run-off election on December 8. Attached is
an ISR provided earlier this fall with some tentative information on the
run-off election.
Tuesday, December 15 Council Meeting – Cancelled
o This meeting will be cancelled
Thursday, December 17 Special Called Council Meeting at 6:30 p.m.
After the Mayor and Council reception (as noted above), a special called meeting will
be held at 6:30 p.m. to canvass the results of the run-off election, swear-in elected
Members, appoint a Mayor Pro Tem, and t hen hold a Council meeting for any business

B. Contractor Issues on Windsor Drive – The 2019 Street Reconstruction Project, which
includes Windsor Drive, is part of the Street Bundle from the 2012/2014 Bond
Program. Quality Excavation was awarded the construction contract for this project in
February 2020. Since Quality Excavation was awarded the contract, Public Works
Inspections and Capital Project Delivery staff have had repeated issues with them not
following the safety protocol or the general notes stipulated in the contract documents.
Since March 2020, staff maintained a log of issues identified with the contractor. Staff
met with Quality Excavation’s leadership team on October 22 to discuss concerns with
project performance. During the October 22 meeting, a clear issue escalation plan was
established and Quality Excavation committed to address the issues identified field.
Following the meeting, Quality Excavation failed to address the issues identified.
On November 5, Council Member Briggs sent images provided by area residents
depicting jobsite cleanliness and safety concerns along Windsor. Staff held a follow -
up meeting with Quality Excavation on the afternoon of Friday, November 6, where a
stop work order was issued; this is the third stop work order that has been issued to the
contractor. Staff directed leadership from Quality Excavation to review plans and
specifications included in the contract. Staff plans to conduct a site walk through on
Tuesday, November 10, and will meet with Quality Excavation leadership again on
Wednesday, November 11. If all issues have been addressed and the call on
November 11 is positive, the stop work order will be lifted. Staff will provide updates
on progress with the contractor in the November 13 Friday Report. Staff contact:

C. Internal Audit Report Translations – To improve transparency and dedication to serving
the public interest, staff now offer s residents the ability to request Internal Audit report
translations in their language of choice. This initiative was communicated to residents
on social media, on the Internal Audit Department webpage, and will be noted in each
published Internal Audit report going forward. Internal Audit report translations may
be requested by emailing InternalAudit@cityofdenton.com.
In addition, all new “Audit at a Glance” and “Follow-Up at a Glance” report summaries
will be translated into Spanish and made available to residents on the City’s website.
To ensure Spanish-language information is available on all audit projects to date, staff
also had the Customer Service Division Follow-Up, Procurement Card Process Follow-
Up, and Procurement Process Follow-Up report summaries translated; all of these
translations are currently available on the City’s Internal Audit webpage. Staff contact:

D. Compliance with New EPA Dental Rule – EPA promulgated pretreatment standards in
2017 to reduce discharges of mercury from dental offices into publicly owned treatment
works (POTWs). Texas Commission on Environmental Quality (TCEQ) has been
working for the past three years in the implementation of the EPA Dental Rule. The
rule effective date for Texas POWTs was October 12. All dental offices are now
responsible for capturing mercury and other metals (by using separators) before they
are discharged into sewers that drain to POTWs. Once captured by a separator, mercury
can be recycled. The Industrial Pre-treatment division oversees the implementation and
documents compliance with the new rule. Environmental Services is happy to inform
we have obtained 100% compliance from all 65 dental providers located in Denton and
customer cities discharging into Denton’s sanitary sewer system. Staff contact: Tony

E. Timeline Change to Boards & Commissions 2020 Screening & Appointment Process
– In Informal Staff Report No. 2020-094 dated and provided with the October 30, 2020
Friday Report, a timeline was detailed which covered certain steps and deadlines for
the 2020 Board & Commission appointment process. The timeline has been modified
as follows:
November 6, 2020 Email notifications will be sent to all existing members and
other interested individuals to submit an online application,
due December 18, 2020.
Note: Applications can continue to be submitted by this date.
Setting this deadline allows for vetting to be done so that
information provided in the B&C Packet (on January 19), will
include only those qualified to serve. As applications are
received, weekly Packet Updates will be provided to Council as
has been done this past year.
November, 2020 City staff will promote the upcoming Boards/Commissions
appointment process across its communication channels and
encourage interested individuals to submit by December 18,
2020 so their applications can be sent to Council.

F. Coyote Concerns – Animal Services staff received concerns from the Denton Animal
Support Foundation (DASF) regarding increased reports of coyote sightings and
concerns that development is contributing to coyotes being pushed out of their normal
territory. The following response was provided and is being provided to all of Council
as a couple Council Members were copied on the correspondence.
“Thank you for reaching out regarding the concern over the increase of coyote
sightings. We believe that education is key to having residents make appropriate
decisions regarding their safety or managing their property and pets. With the
information you provided, the goal of the education is to decrease attractants, increase
pet safety, provide tips for safe situational hazing, and create reasonable expectations
of normal coyote behavior. We would love to partner with DASF and the HOA’s to
expand our reach. Below you will find a list of options that we have available now to
assist in disseminating information to residents.
Provide educational literature to residents who call and report regarding coyote
sightings/concerns.
Animal Services can visit resident and perform a yard audit.

Attend HOA meetings (in person or virtual) and discuss our educational goals
in detail – followed by Q&A.
Please have HOA board reach out to Julien Peralta – (940) 349-7694 to

Place educational information on Nextdoor/Social Media to target identified
areas who are experiencing the increase in coyote sightings and encourage them
to report.”

G. Traffic Alert – Beginning Friday, November 6, traffic lights at the intersection of
N. Bell Avenue and E. Sherman Drive will be temporarily down for maintenance; stop
signs will be in place. The intersection will be temporarily converted to a 4-way stop
and will have various intermittent lane closures. During this time, a contractor for the
City of Denton will be reconstructing the traffic signal and completing sidewalk and
ramp improvements in the area. Weather permitting, the traffic signal reconstruction
and sidewalk improvements are expected to be complete by January 8, 2021.
Signage is posted to alert motorists of the temporary 4-way stop and sidewalk
closure. Motorists are reminded to use caution when traveling in the area and adhere to
all posted construction signage.

H. Solid Waste Routing Software Milestones – The Solid Waste and Recycling
Department started the implementation of the new Rubicon Global Routing Software
(the Smart Routing System). All commercial, residential routes and end user
information has been electronically formatted and sent to Rubicon to be configured and
uploaded into the software. In-vehicle components will be installed into the City’s Solid
Waste Fleet November 9-12, 2020. User training is planned for the week of
November 30, 2020. Staff contact: Allison Wing, Solid Waste
I. Stationed Bike Share – On October 16, Council Member Briggs requested information
on how staff plans to procure a stationed bike share after Velo left the city due to the
City’s electronic scooter aversions. Staff is currently working with UNT and TWU to
secure an alternate vendor to pro vide a bike-only offering. UNT has considered
operating its own bike share, but costs are currently prohibitive. Once an appropriate
vendor is selected, staff will present the selection to City Council for approval. Staff

J. Mural at Voertman’s – On November 1, Council Member Armintor asked Parks and
Recreation (PARD) staff to reach out to the owner of Voertman’s on behalf of a resident
regarding a mural on the building ’s west side. PARD contacted the business, and the
owner is interested in the mural getting updated or repainted to add to the art scene in
Denton. Since this mural does not require city approval, the owner of Voertman ’s
requested Council Member Armintor reach out to them for future discussion. Staff

K. Broadway Street and Fulton Street Intersection Visibility – On October 21, Council
Member Meltzer forwarded a resident’s concerns about the visibility at the intersection
of Broadway St. and Fulton St and if the intersection required striping. Staff conducted
a study of the intersection and determined that, due to the extensive on-street parking,
visibility is often obstructed for vehicles on Broadway St. Staff has developed a simple
marking and signing plan to limit the on-street parking adjacent to the intersection in
order to reduce these obstructions. Implementation of these measures will take 1 -2
weeks, depending on weather and the availability of our striping contractor. Work will
begin as soon as it is authorized. Staff contact: Brian Jahn, Capital Projects
L. Recycled Books Steps – On October 9, Council Member Briggs requested that staff
assess the condition of the steps along Oak St. in front of Recycled Books near the

intersection of N. Locust St. and Oak St. for potential trip hazards. In the October 16
Friday Report, staff communicated that a handrail would be installed in the next few
weeks for a to alleviate any hazards in the short -term. A contractor competed the
handrail installation on November 4, shown below. Since the picture below was taken,
the barricades have been removed and the sidewalk is currently open to foot traffic.
The contractor will be returning to repaint the handrail by November 13 so the color
matches with the existing structure. Staff is planning to assess the need for a complete
sidewalk upgrade for the Courthouse Square and surrounding Mews streets in order to
make the sidewalks Americans with Disabilities Act (ADA) compliant. Staff contact:

M. Hill Street Speed Study – On October 26, Council Member Briggs requested staff
assess potential traffic calming measures to prevent speeding and accidents on Hill
Street. Staff is currently working with Denton Police Department to collect speed and
volume data for this roadway. When data collection is complete, staff will prepare a
list of options for calming traffic and reducing speeds along Hill St. Based on the
current backlog of the speed study equipment, we estimate at least 7 -8 weeks before
the information will be available. Staff contact: Brian Jahn, Capital Projects
N. Swisher Road Sidewalks – On October 22, Council Member Briggs requested
information on when sidewalks w ill be constructed on Swisher Road between Edwards
Rd. and Pockrus Page Rd. This sidewalk is part of a proposed Safe Routes to School
project funded jointly by the City, TxDOT and the NCTCOG. There are conflicts with
Right-of-Way, drainage and heavily wooded parkways along this corridor that are
prohibiting the construction of this sidewalk at current funding levels. Staff is in the
process of selecting a design consultant who will then determine the feasibility of
constructing this sidewalk. Staff contact: Brian Jahn, Capital Projects
O. Safety Concerns at Businesses – On October 31, Council Member Briggs passed along
concerned citizens’ inquiries about safety at particular businesses. Staff are working
closely with businesses to address any concerns or challenges. The approach may differ
upon the business, its location/site factors, and the concerns reported. Both Economic
Development and the Police Department’s Downtown unit as well as the PD Homeless
Outreach officers have developed close working relationships with many businesses.
Theywill go out to visit with businesses onsite and provide direct contact info rmation
for following up with a staff member. Depending upon the factors and staffing, attempts
to increase patrols and increase homeless outreach by the HOT team, suggest
improvements on private property, as well as look at any improvements that may be
recommended on public property, etc.
If a customer feels unsafe while visiting the business, they should contact the store
manager. The manager may ask someone to leave their property or they may contact
the Police Department if needed. If there is an immediate health and safety concern,
individuals should call 9-1-1 for a public safety response.
For a particular reported instance, staff reached out to the store manager of Natural
Grocers and asked about the lig ht levels around the business and if the manager feels
improvements in lighting on public property may be helpful. After the discussion, staff

planned to upgrade the existing DME lights when the next shipment arrives and will
follow up with the manager accordingly. Staff contact: Sarah Kuechler, Chief of Staff
P. Street Lighting Downtown – On October 28, Council Member Briggs requested
information about the street lighting in the downtown area, and whether the y could be
upgraded to brighter LED lights. The specific area of downtown that Council Member
Briggs received a resident request is the area on the Mews Streets, one block off of the
square proper. The lights in this area, as detailed on the map below, have all been
upgraded recently to LED lights. Staff verified that approximately 8 lights were not
functioning properly. Repairs have been made and all lights within a two block radius
of the square should now be illuminated. On the map, the lights with a black plus (+)
symbol have already been upgraded, and staff is continuing to schedule the remainder
of City-owned lights to be upgraded to the LED lights. Any private lights located on
buildings are the responsibility of the property owner to manage. The Police
Department will continue their routine patrols in the area.
Residents are encouraged to report street light outages, or request that the light level on
LED lights to be lowered, through the Engage Denton app. Once received, staff will
prioritize repairs on the nonfunctioning lights, and assess whether the LED light levels

Q. Bagging Dyno Products – On November 4, Council Member Davis requested
information about the possibility of bagging additional beneficial reuse productions in
addition to Dyno -dirt. Dyno-dirt is bagged by a contractor who periodically bags the
material creating an inventory of bagged dyno -dirt. This work is being performed under
a Purchase Order because the costs are under the tot al expenditure level mandated by
COD purchasing policies. Increasing the bagging operation to mulch and other
products would require a contract pursuant to an RFP. That process will likely take 3
months or more. Dyno-dirt is the only bagged product sold. All others are sold in bulk.
Staff is interested in pursuing this option as they believe it has the potential to increase
the sales of these other products and thus avoid landfilling of surplus (where we don’t
have sufficient storage space) and materials that are too old. The more of the products
we sell, the less that has to be diverted to the landfill using up valuable air space in the
landfill and increasing the cost to rate-payers. The operation has the ability to screen

wood chips to produce a more homogenous size mulch that would be conducive to
bagging and for which we believe there is a significant market if properly priced.
To properly evaluate this potential, the following steps will be required:
1. Determine how much additional product can be bagged under the purchase
order that is currently open while ensuring that there is sufficient purchase
order capacity to continue bagging dyno -dirt
2. Seek price estimates for additional bagging capacity
3. Staff will revisit work done 4 to 5 years ago to determine the cost of
producing each product, including the avoided costs of disposal
4. Perform a limited market assessment to determine the prices offered for
competing products in Denton
5. If the economics appear favorable, staff will prepare an ordinance for
consideration by Council to establish a range of prices for bagged and bulk
materials.
6. If the ordinance is approved, we will issue an RFP for bagging services and
put in place a contract to enable the bagging of multiple products.
7. Assess the business viability of continued sales of multiple products using the
first one or two years of sales and determine if the continuation of the business
is cost effective, including a determination as to whether the city should
purchase bagging equipment or continue to use a contractor.

R. Lakeview Boulevard Cyclist Safety Concerns – On November 1, Council Member
Briggs requested that staff assess the site of a cyclist accident at Lakeview Blvd and a
DCTA Trail crossing area for any safety concerns. Staff performed a site visit on
November 2 and found the DCTA Trail does have stop signs on both the East and West
side of the trail that notifies trail users to stop before crossing Lakeview Blvd. Staff
found Chinese Privet growing in the area along the eastern sidewalk beside Lakeview
Blvd. that does not infringe the 50-foot sight line distance for crossings. Staff concluded
that while the crossing has adequate sightlines at the crossing, Park Maintenance will
trim back the vegetation even further to expand the sightline from the trail to
Southbound traffic on Lakeview Blvd. Staff contact: Drew Huffman, Parks and

S. Cleanup Event Survey – On Wednesday, November 4, Council Member Briggs
recommended Parks and Recreation complete the North Central Texas Council of
Governments' statewide survey on organized litter cleanup events. Staff reported
information on Denton's citywide litter cleanup efforts through Keep Denton Beautiful
programs. The survey's object ive is to collect data to support a U.S. EPA Trash Free
Waters Gulf of Mexico grant to create a statewide platform for litter reporting. Staff

T. Invasive King Ranch Bluestem Update – Recently, Parks and Recreation (PARD)
received many calls from concerned citizens worrying about the appearance of
roadsides, medians, and parks due to the overgrown “grass.” This concern is typical
this time of the year and one that PARD receives frequently. The complaint centers on
an invasive weed.

What is causing these citizen concerns in taller grass is a weed pest named King Ranch
(KR) Bluestem. Each year, just before fall, KR Bluestem sends up its seed heads that
wave and move in the wind, which people are noticing and calling to report. KR
Bluestem is an invasive species of grass, bred a long time ago for soil and water
conservation and as a forage grass. The variety in Denton, Bothriochloa ischaemum
var. songarica, was purposely bred on the King Ranch as a foraging grass for animals.
While it served its purpose for the ranch, it also spread across half of the state.
This grass is very drought resistant and can grow, on average, a foot or more per week.
Because of this, it can suppress and threaten native species and their abundance. KR
Bluestem is winter hardy and is found from Russia to Northern India.
There is little PARD can do to eradicate KR Bluestem. Chemicals, cultural practices,
and other methods have had little effect on containing or eradicating the grass. Weekly
mowing cycles or attempting to till and kill the exposed root system would be cost
prohibitive and unsustainable for PARD. Therefore, PARD asks for patience as KR
Bluestem runs its course in Denton. Staff co ntact: Marshall McGee, Parks and

U. Texas Arbor Day – Denton is celebrating Texas Arbor Day on Friday, November 6,
with virtual education and celebration activities. DTV produced a series of videos
demonstrating tree identification and proper planting, which are available to view now
on the City of Denton website. Denton Public Library and Tejas Storytelling Festival
shared tree-themed story times on social media as a family-fun option.
Denton celebrates both Texas Arbor Day in the fall and National Arbor Day in the
spring as a certified Tree City USA. The City of Denton plans to apply for its 30 th year

V. Nominate a Veteran Scholarship – The Parks and Recreation Department (PARD) has
partnered with the Denton Parks Foundation (DPF) to award a local veteran with a $100
credit to any PARD program or activity. DPF is supplying the scholarship and decided
to partner with PARD to identify a veteran through a simple social media contest.

Submissions are accepted through Sunday, November 8. A committee will select a
winner on Monday, November 9, and the winner will be announced on Veterans Day,

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
November 3, 2020 General and Special Elections
BACKGROUND:
The report provides information involving the November 3, 2020 General & Special Elections as
well as the December 8, 2020 Runoff Election, if needed.
DISCUSSION:
On March 20, 2020, the General (Places 5, 6, and 7/Mayor) and Special (Districts 1 and 2)
Elections were postponed to the November 3, 2020 Uniform Election date. The adopted
ordinances were written in a way that would have required no further action from the City Council.
On July 27, 2020, Governor Abbott extended the early voting period to three weeks. As a result,
the ordinances must be amended to update the early voting period dates and will be submitted for
adoption in September.
NOVEMBER 3, 2020 GENERAL & SPECIAL ELECTION
The early voting schedule is as follows:
Each year, the City contracts with the Denton County Elections Department (County) to administer
a joint election with other jurisdictions who will hold an election on any Uniform Election Date .
Unlike for elections held in May, local political subdivisions are required to use county election
precincts and county polling places for elections held on the November uniform date, pursuant to
Title 4, Chapter 42, Subchapter A, Section 42.002, and Subchapter C, Section 42.0621 of the
Election Code. The County does not anticipate having locations finalized until late September.
Exhibit A, outlines the proposed locations within the City of Denton. Confirmation on some
locations are still pending.
As was reported at the August 4, Work Session, the County is diligently working to identify
approximately 50 early vo ting locations as well as open a voting location in every county precinct
that has 750+ registered voters.
Canvassing of the elections is scheduled for the Regular City Council Meeting on Tuesday,
November 17. The Runoff Election will be ordered at that time if necessary. More information
will be provided after November 3 on how the canvassing and related issuance of the Certificate

of Election and Oaths/Statements of Office will be handled as we will be better able to gage how
meetings need to be handled around that time.
COST
A cost estimate is not available at this time. The County confirmed participating jurisdictions that
postponed elections to November 3, will be charged as if the elections were still being held in May.
DECEMBER 8, 2020 RUNOFF ELECTION (if necessary)
The early voting schedule is as follows:
The contract with the County will also apply to the Runoff Election. Polling locations for early
voting/election day will be determined at the time the election is ordered. The City w ill have more
flexibility regarding the locations to be used.
A Special Called City Council meeting will be needed to canvass these results and is being
scheduled for Thursday, December 17. Outlook calendars will be updated. Again, more

COST
The cost estimate is not typically available in advance of a runoff election as they vary, and are
largely based on the number of participating jurisdictions.
SOCIAL DISTANCING & SAFEGUARDS
The County will provide a Personal Protective Equipment (PPE) station in all polling locations.
This includes sanitizing stations, hand sanitizer, cleaning solutions, gloves, protective shields, etc.
They remain committed toward ensuring social distancing to the extent possible at all polling
locations.
PUBLIC AWARENESS
Election information was distributed in the recent Resident Update newsletter mailed to residents.
The Notice of Election will be advertised twice for the General & Special Elections and once fo r
the Runoff Election, if necessary. Staff will undertake efforts to promote early voting. Denton

County has also created a “Points of Interest ” page that contains valuable reference information
which we are placing on our Denton Vote page.
CANDIDATE PACKET – MODIFIED
The modified Candidate Packet is available here. It was modified to include information and
deadlines for candidate filings in accordance to the Election Code, Texas Secretary of State, and
Ethics Commission mandates which are applicable to any November 3, 2020 election candidate.
CONCLUSION:
As noted, the County has identified locations which must be used. However, if City Council
desires to add location(s), the request will be submitted to the County who will have the final say
on its potential use. Should they agree, t he City will be obligated to pay the full cost for use of
that facility. For any Runoff election, that restriction does not apply.
Comments, suggestions or recommendations on the use of any locations within the City should be
sent to the City Secretary’s Office by Friday, August 28. A work session will be scheduled in mid-
September to report the results of input received.

SUBJECT:
Provide information regarding 5G and other high-speed internet services in Denton.
DISCUSSION:
During the Municipal Broadband Work Session report on October 20, 2020, the City Council
requested information about various items related to current high-speed internet options that are
currently available in Denton, and potential plans for 5G services in the City.
Current High-Speed Internet Options
Most of the City of Denton is serviced by Charter Spectrum and/or Frontier Communications
through cable and fiber lines that provide high-speed internet directly to residents. There are
sections of the City that are serviced by Grande Communications (in Robson Ranch), and staff is
aware of a small section of the Preserve at Pecan Creek which is currently coordinating with
Lumen Technologies (formerly CenturyLink) to acquire services. The table below shows a
summary of available speeds for these companies with the advertised rates (as available in
Denton):

Residents who are curious about which providers are available in their area may visit the FCC
broadband map, where they may input their address to determine their options. The map also
provides the user with other satellite providers that may offer services to them.
During the Work Session on October 20, the City Council also asked if any of the providers
offered any aide to customers who are being affected by COVID-19. Charter Spectrum provided
a press release that outlines their Spectrum Remote Education program which offers 60 days of
free internet access to new customers with K-12 students, college students or educators, as well
as their Spectrum Internet Assist program that offers low-cost internet for free and reduced lunch
student households. Additionally, Charter provides the opportunity for local ISD’s to connect
students, educators and school staff working from home to broadband services through their Stay
Connected program. Frontier Communications provided staff information that they are
participating in the Federal Lifeline program and offer the Federal Lifeline credit to low income
phone and broadband customers who qualify for the program.
Requiring Broadband Infrastructure
There is not a requirement in the Denton Development Code or any other City of Denton
ordinances that requires broadband infrastructure or service to be provided to a development.
Generally, the individual developer negotiates with a provider to extend service to new
development depending on whether the development falls into a provider’s district. The City
Council requested information about whether conduit or other infrastructure could be required to
be installed during construction that would facilitate a company to provide services to a
neighborhood. Nearby, Celina, TX passed an Ordinance in 2017 (Attachment 1) that requires
the installation and construction of a fiber optic system and infrastructure as part of their
development process. If a consensus of Council agrees to, staff can further investigate
establishing a similar ordinance in Denton. This would include research of other city’s
ordinances and best practices, receiving feedback from the development community, and
assessing any legal considerations for such a requirement. Following these assessments, staff

could then bring forward a work session item to the City Council and/or Planning and Zoning
Commission for discussion.
5G Service – In general
Fifth Generation Technology (5G) is the latest generation of internet technology, which comes in
the form of nodes, also known as small cells. Like prior networks, 5G wireless devices in a cell
are connected to the Internet and telephone network by radio waves through a local antenna in
the cell. Each small cell has a coverage area of about 300-500 feet, meaning full, uninterrupted
coverage will require a grid of nodes spaced 300-500 feet apart. The small cells can be attached
to the outside of existing structures such as buildings and poles, or providers can install poles
with the small cell equipment embedded inside the poles. These networks are expected to have
higher bandwidth, giving higher download speeds, possibly up to 10 gigabits per second.
Because of this bandwidth, the 5G network will be able to service more than only cell phones or
tablet computers, but will also be able to provide service to residences using a receiver in the
building that will turn that 5G wave into usable WiFi within the home or business. It is also
possible that in the future, home electronics would be equipped to be 5G compatible. Various
providers are investing in this network throughout the Country and have generally targeted larger
population centers to deploy the technology at the beginning of the rollout.
Notably, Verizon has launched a service called 5G home in parts of five cities (as of April 2020)
– Los Angeles, Sacramento, Houston, Indianapolis, and Chicago. Verizon’s product used a “5G
Internet Gateway” which serves as both the receiver and router. Currently, Verizon’s typical
speeds for this are around 300 Mbps and costs $70/month where available, and current Verizon
mobile customers can receive a $20 discount.
T-Mobile Home Internet also has limited availability in select markets and is available on the
LTE network currently (5G still in development). This service costs $50/month and offers speeds
of 25mbps or more.
5G Service – In Denton
Denton has been chosen as one of the select few cities to be amongst the first to have 5G
technology available. Denton has been excepting permit applications since January of 2020, and
to date has issued 70 permits for small cell pole structures. At the cost of the provider, the pole
tops will be fitted with an arm and luminaire, increasing our streetlight coverage as networks
increase their 5G coverage.
All providers are encouraged to apply for permits, however Verizon has been the most active
applicant to date. Their plans that have been submitted to the City includes build out coverage in

central and downtown Denton through 2021, with expansion of the network planned thereafter.
Staff will continue to receive permit applications and monitor the 5G network buildout in the
City.

CELINA, TEXAS, REQUIRING INSTALLATION AND
CONSTRUCTION OF A FIBER OPTIC SYSTEM WITHIN THE
CITY OF CELINA AND ESTABLISHING STANDARDS FOR THE
INSTALLATION AND CONSTRUCTION OF THE FIBER OPTIC
SYSTEM; PROVIDING FOR INCORPORATION OF FINDINGS;
PROVIDING FOR AMENDMENT TO THE CODE OF
ORDINANCES; PROVIDING A PENALTY CLAUSE,
SAVINGS/REPEALING CLAUSE, AND SEVERABILITY CLAUSE;
PROVIDING FOR PUBLICATION; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Celina, Texas (“City Council”) has
investigated and determined that expanded broadband access via a fiber optic network in the City
of Celina, Texas (“City”) is a fundamental aspect of the infrastructure required to educate youth,
create jobs, promote public safety, improve citizens’ standards of living and deliver essential
services such as health care; and
WHEREAS, requiring conduit to be installed as part of public improvements projects or
developments in order to accommodate anticipated future demand for access to internet and
telecommunications services will assist the City in responsibly managing such facilities and areas
by reducing or eliminating the need for excavation within public streets and rights-of-way when
telecommunications service providers seek to locate underground telecommunications facilities
within such streets and public property, easements and rights-of-way in the future; reducing or
eliminating the traffic disruption that occurs whenever excavation occurs within or around these
areas; and reducing or eliminating the loss of pavement integrity and diminishment of the useful
life of pavement that occurs whenever paved or improved streets and rights-of-way are cut and
excavated; and
WHEREAS, according to the Federal Communications Commission, the largest cost
element for deploying broadband is burying fiber optic cables and conduit underground and the
Federal and the Federal Highway Administration has indicated that ninety percent of the cost of
deploying broadband is when the work requires significant excavation of the roadway; and
WHEREAS, coordinating road construction projects with the installation of broadband
facilities will save on costs incurred by repeated excavation in areas where the entire right-of-way
is paved or developed and reduces deployment time by preventing the need to acquire duplicative
reviews and permits for work done at the same location; and
WHEREAS, the City Council finds that the benefits and positive impact associated with
the creation of such a network within the City have been recognized and acknowledged, and the
City desires to incentivize the provision of high-speed broadband internet service to the City’s

residential and commercial residents and visitors as part of an effort to bridge the digital divide of
its citizens and community as part of the City’s Gigabit City Initiative; and
WHEREAS, the installation of fiber optic cable within the City will further the goals of
the City’s Gigabit City Initiative while at the same time commence the creation of a fiber optic
network for the City which would largely amount to establishment of what is generally referred to
or known as the “middle mile” of fiber; and
WHEREAS, the incremental installation of fiber optic cable within property owned by the
City or otherwise within public rights-of-way or easements in conjunction with public
improvements projects and private development in these areas will assist in expediting the
realization of a fiber optic network within the City, decrease the costs associated with the
construction and creation of such a system and will allow the City to control use of these public
ways through agreements on access to and use of such City-owned cable and infrastructure and in
exchange of consideration to the City; and
WHEREAS, the installation of fiber optic cable within public property, easements and
rights-of-way will also provide access to meet the needs of City departments, public safety
organizations and other publicly owned and operated facilities as well as protecting these areas by
improving both the management and regulation of competing demands through the elimination of
duplicate fiber optic facilities within public property, easements and rights-of-way; protecting the
economic vitality of the City by providing the broadband transport service and fiber facilities
leasing required by broadband service providers; and reducing the costs associated with
maintaining sidewalks, pavement and public facilities located within public property, easements
and rights-of-way by minimizing the number of pavement cuts and dislocation of other public
facilities necessitated by the construction or installation of fiber optic facilities; and
WHEREAS, a fiber-optic network will allow better, faster communications with
emergency responders; and
WHEREAS, in furtherance of these interests, the City Council finds that all road
improvement and other capital improvements projects involving the resurfacing or overlaying,
refurbishment, replacement and/or widening of existing public streets, alleys and roadways or
sidewalks or walkways in the City as well as the creation of new improved streets, alleys,
roadways, sidewalks or walkways by the City or private developers or the installation of any new
drainage or sewer pipes or infrastructure within City property, easements or public rights-of-way
shall include as part of their projects and the costs thereof the construction and installation of one
288-count fiber cable that is installed in an underground conduit which is a minimum of four inches
(4”) in diameter with a minimum of four (4) one-inch HDPE-SDR 15.5 inner-ducts within City
property, easements or public rights-of-way to which the City has access or ownership as well as
installation and construction of proper appurtenances and attendant facilities thereto, which shall
be located parallel to the nearest public street or roadway and meets or exceeds specifications of
emerging industry standards for provision of ultra-speed broadband service, with the exact
locations of such infrastructure and the specifications of which to be determined and periodically
updated by the City Engineer or his or her designee in reliance on such industry standards and
consideration of needs of the City’s Gigabit City Initiative; and

WHEREAS, the City Council desires to foster a fair and level playing field for all market
competitors that does not disadvantage or advantage one service provider or technology over
another; and
WHEREAS, the City Council seeks to promote widespread access to the most
technologically advanced telecommunications services for all City residents and businesses in a
nondiscriminatory manner regarding authorization or placement of facilities in the right-of-way,
access to a building, or rates or terms; and
WHEREAS, it is the responsibility of the City to protect and control access to public
rights-of-way and ensure that all service providers utilizing City property, facilities or rights-of-
way comply with all applicable state and local health, safety and other laws; and
WHEREAS, the City Council has investigated and determined that it would be
advantageous and beneficial to the citizens of the City to establish standards for the installation
and construction of a fiber optic system within the City as set forth below.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CELINA, TEXAS:
SECTION 1
INCORPORATION OF FINDINGS
The above and foregoing findings are true and correct and are incorporated into the body
of this Ordinance and made a part hereof for all purposes as if fully set forth herein.
SECTION 2
PURPOSE
This Ordinance is intended to provide for the construction of infrastructure sufficient for
the deployment of communication lines, wires or cables in the future by pulling the same through
the conduit and appurtenances installed pursuant to this Ordinance without excavating within
public property, easements and rights-of-way or to otherwise use and oversee use of such
infrastructure and facilities. This Ordinance is not intended to require telecommunications or
broadband service providers to install additional ducts or conduit but is intended to require those
constructing public streets and roadways or performing any public improvements projects along
or under public streets, easements, rights-of-way and/or property, including the City, private
developers and all others, to provide and install such conduit and appurtenances as may be
necessary to accommodate future telecommunications and broadband service needs within public
streets, easements, rights-of-ways and property without further excavation or disturbance.

3.01 That the City of Celina Code of Ordinances, Chapter 10: Subdivision Regulation;
Article 10.03: Subdivision Ordinance; Division 4. Design Standards; Section
10.03.126: Improvements; shall be amended by the addition of Subsection 10.03.126(i) to read as
follows:
“(i) Fiber Optic Network Conduit and Fiber Optic Cable
(1) Requirements. All subdivisions and road improvement and other capital
improvements projects involving the creation of new improved streets,
alleys, roadways, sidewalks or walkways by the City or any other person
or entity, including private developers, or the installation of any new
drainage or sewer pipes or infrastructure within City property, easements
or public rights-of-way, or where feasible the resurfacing, overlaying,
refurbishment, replacement and/or widening of existing public streets,
alleys, roadways, sidewalks or walkways, shall include as part of their
projects and the costs thereof the construction and installation of fiber optic
network conduit that contains at least one fiber optic cable within City
property, easements, or public rights-of-way to which the City has access
or ownership as well as installation and construction of proper
appurtenances and attendant facilities thereto, which shall be located
parallel to the nearest public street or roadway and meets or exceeds
specifications of emerging industry standards for provision of ultra-speed
broadband service, with the exact locations of such infrastructure and the
specifications of which to be determined by the City Engineer or his or her
designee in reliance on such industry standards and consideration of the
needs, objectives and findings of the City’s Gigabit City Initiative. The
following additional requirements shall also apply:
(A) In addition to installing fiber optic network conduit, the party
constructing the street will be required to install such vaults,
manholes, hand-holes and other appurtenances and facilities
as are necessary or needed to accommodate installation and
connection of fiber optic cable within the fiber optic network
conduit.
(B) All construction and installation required in this Subsection
shall be accomplished according to construction standards
adopted by the City Engineer or the City’s designee in
consideration of the needs of the City’s Gigabit City
Initiative. Such standards shall be adopted with due
consideration given to existing and anticipated technologies
and industry standards.
(C) All fiber optic network conduit, fiber optic cable, facilities
and appurtenances installed by private parties or developers
or by persons or entities other than the City pursuant to this
Section shall be conveyed and dedicated to the City either

with or as part of the dedication and conveyance of the public
street and/or right-of-way to the City or otherwise.
(D) All construction and installation costs shall be the
responsibility of the party constructing the public street,
roadway or improvements project that falls within the
purview of this Ordinance.
(2) Definitions. For purposes of this Subsection, the following terms have the
meanings ascribed below:
Fiber optic network conduit means a minimum four inch (4”) conduit
containing a minimum of four (4) inner-ducts used to enclose or carry fiber
optic cable or other wires or lines and attendant parts and accessories buried
alongside a roadway or surface mounted on bridges, overpasses and other
facilities where below-ground placement is impossible or impractical, all in
accordance with emerging industry standards and as determined by the City
Engineer or his or her designee.
Fiber optic cable means a minimum 288-count fiber cable bundle.
(3) Use by Broadband Service Providers. Whenever fiber optic network
conduit and/or fiber optic cable installed or to be installed under this
Subsection is available or will become available within a newly constructed
public street or right-of-way or other improvements project that falls with
the scope or purview of this Subsection upon dedication, all broadband
service providers thereafter locating fiber optic cable, wire or lines within
or along such street or right-of-way shall be required to use available dark
fiber (currently unused fiber optic strands) within the then-existing
infrastructure or to locate their cable, wire or lines within such fiber optic
network conduit unless it can be demonstrated to the reasonable satisfaction
of the City Engineer that such use or location is not technologically feasible
or reasonably practicable or unless such provider is exempt or otherwise not
required by other law to comply with the provisions of this Subsection.
Fiber optic cable and strands as well as fiber optic network conduit capacity
shall be allocated to broadband service providers on a first-come, first-
served basis; provided, however, that the City may reserve capacity within
such fiber and conduits for its own use; and provided further, that the City
Engineer may adopt additional reasonable rules for fiber optic cable or
strand and fiber optic network conduit allocation in order to ensure that all
broadband service providers have reasonable access to the City’s rights-of-
way and that no barriers to entry or competition result from the allocation
of cable, strand or conduit space.
(4) Fees. Any person or entity constructing fiber optic network conduit or
installing fiber as required by this Subchapter shall pay a nonrefundable fee
in an amount as provided for in the fee schedule of the City for the City to

recover its costs incurred for plan review, engineering design and approval,
purchasing materials, and costs associated with issuing, processing, and
verifying applications, inspecting job sites and restoration improvements,
and other costs the City may incur in implementing the provisions of this
Subchapter. The City reserves the right to charge reasonable fees for the
use of fiber optic cable and fiber optic network conduit and attendant
accessories, facilities and infrastructure installed pursuant to this Ordinance,
to the extent consistent with and as limited by federal and state laws and
regulations. Any such fee amounts shall be established in the fee schedule
of the City.”
SECTION 4
PENALTY CLAUSE
Any person, firm, entity or corporation violating any provision of this Ordinance, as it
exists or may be amended, shall be deemed guilty of a misdemeanor, and on conviction thereof,
shall be fined in an amount not exceeding FIVE HUNDRED AND 00/100 DOLLARS ($500.00).
Each continuing day’s violation shall constitute a separate offense. The penal provisions imposed
under this Ordinance shall not preclude the City from filing suit to enjoin the violation. The City
retains all legal rights and remedies available to it pursuant to local, state and federal law.
SECTION 5
SAVINGS/ REPEALING CLAUSE
This Ordinance shall be cumulative of all other Ordinances and shall not repeal any of the
provisions of such Ordinances except for those instances where there are direct conflicts with the
provisions of this Ordinance. Ordinances, or parts thereof, in force at the time this Ordinance shall
take effect and that are inconsistent with this Ordinance are hereby repealed to the extent that they
are inconsistent with this Ordinance. Provided however, that any complaint, action, claim or
lawsuit which has been initiated or has arisen under or pursuant to such other Ordinances on this
date of adoption of this Ordinance shall continue to be governed by the provisions of such
Ordinance and for that purpose the Ordinance shall remain in full force and effect.
SECTION 6
SEVERABILITY
The provisions of the Ordinance are severable. However, in the event this Ordinance or
any procedure provided in this Ordinance becomes unlawful, or is declared or determined by a
judicial, administrative or legislative authority exercising its jurisdiction to be excessive,
unenforceable, void, illegal or otherwise inapplicable, in while in part, the remaining and lawful
provisions shall be of full force and effect and the City shall promptly promulgate new revised
provisions in compliance with the authority’s decisions or enactment.

SECTION 7
PUBLICATION CLAUSE
The City Secretary of the City of Celina is hereby directed to publish in the Official
Newspaper of the City of Celina the Caption, and Effective Date Clause of this Ordinance as
required by Section 52.013 of the Local Government Code.
SECTION 8
ENGROSSMENT AND ENROLLMENT
The City Secretary is hereby directed to engross and enroll this Ordinance by copying the
descriptive Caption in the minutes of the City Council and by filing this Ordinance in the
Ordinance records of the City.
SECTION 9
EFFECTIVE DATE
This Ordinance shall become effective from and after its date of passage in accordance
with law.
