General Information & Status Updates
A. Internal Audit Fiscal Year 2021-22 Fourth Quarter Report – The Internal Audit
Department’s Quarterly Reports are intended to provide the City Council and the public
with a status update on the Annual Internal Audit Plan. Additional items of note may also
be presented and discussed by the Internal Audit Advisory Committee including, but not
limited to, the Department’s structure or budget, application of and compliance with
relevant auditing standards, the annual audit plan, and changes to the auditing process. The

B. Catalytic Converter Etching Event – The Denton Police Department is partnering with
Toyota of Denton to host a vehicle-etching event at Toyota of Denton (4100 S. I-35E) from
10 a.m. to 4 p.m. on Saturday, November 5. In addition to etching VINs onto catalytic
converters, this free event will include food trucks, entertainment, and child safety seat
checks courtesy of the Flower Mound Police Department. See the attached flyer for RSVP
information.
The event is also in conjunction with two City of Denton Ordinances passed on October
25, 2022, by the City Council. The first ordinance makes it a Class C Misdemeanor to
possess a catalytic converter that has been cut or unbolted, without being able to provide
ownership of the vehicle the converter came from. The second, also a Class C
Misdemeanor, makes it mandatory for a metal recycling business purchasing catalytic
converters to record the thumbprint of the person selling it, along with other information.
In 2021, the City of Denton had a total of 187 reported catalytic converter thefts. As of
August 24, 2022, a total of 221 catalytic converters have been reported stolen, resulting in
an approximate loss of $350,000 (averaged) in parts and labor alone. Supply chain
problems and vehicle replacement during the time of repair drive total costs even higher.

C. Status on the Renovation of the Loop 288 CMAR Building Project – Please see the
attached update provided Peak Program Value, LLC (PPV) on the current status of the
909 N. Loop 288 CMAR building project. As the project is nearing substantial completion,
City and Our Daily Bread staff are planning for a Ribbon Cutting followed by an open
house and tours open to the public. More details to follow closer to the date. Staff contact:

D. “In the Loop” October DME Newsletter – Flip the pages of “In the Loop”, Denton
Municipal Electric’s (DME) quarterly newsletter. This edition contains information on
community service projects, employee & department spotlights, a message from the
General Manager, as well as Hurricane Ian response information and accolades. Staff

E. State of the City Event on Social Media – Marketing and Communications staff are hard
at work preparing for this year’s State of the City event with video creation, content
creation for departments, and external social media promotion. State of the City’s
Facebook event page is now available online. Staff encourage Council to share the event

F. Denton Nonprofit Collaborative – On October 21, the Denton Nonprofit Collaborative met
to plan its first project. The group selected a resource navigation tool for nonprofits service
providers and individuals to find referrals to assistance in Denton. Over 12 community
agencies and the Community Services department will plan and coordinate logistics to
implement and utilize this tool. In the interest of working towards a long-term, effective
solution to the problem of resource navigation in the community, an action plan was formed
to begin this project. Staff contact: Alaina Graff, Community Services
G. Micro-Surfacing Update – As a follow up to previous reports, Viking Construction will
perform repairs to previously micro-surfaced roadways, with eight roadways receiving a
full roadway reapplication, 28 roadways receiving partial roadway reapplication, and an
additional 30 roadways receiving minor repairs and cleaning. Staff expects Viking
Construction to initiate work on deficient roadways during the week of November 7. The
length of the repair schedule will be determined by the extent of repairs and potential
weather impacts. Because micro-surfacing requires dry conditions and temperatures to be
50 degrees or higher for effective application, staff will monitor weather and adjust the
schedule as needed. Oversight of the repair work will be performed by the Streets
Operation Manager and Public Works Inspection staff. If staff observes that the repair work
does not meet specifications, a stop work order will be issued and staff will coordinate with
the Procurement Department and City Attorney’s Office to determine next steps.
Prior to work commencing, staff will hold a public meeting for residents residing on
roadways that will receive a reapplication of micro-surfacing. The purpose of the meeting
will be to discuss the need for repairs, provide notice regarding the schedule, and answer
resident questions and concerns. In addition, staff will provide communication to residents
using the Capital Improvement Map, the street closure report, and door hangers. A copy of
the map depicting roadways receiving micro-surfacing reapplications is attached. Staff

H. Reported Scam Alert – Customer Service partnered with Marketing and Communications
to issue a social media notice regarding an email scam received by a customer. The email
was masked to appear as though it came from the City’s customer service email account
and requests the customer to set up automated payments by direct fund transfer from their
bank.
At this time, Customer Service has only received the single report, but is investigating the
issue after being contacted by the customer. No further information is available at this time
as staff actively investigate this isolated occurrence.

I. Film Friendly Denton – Last October, Economic Development announced the filming of
an international commercial at the Denton Enterprise Airport. The commercial was filmed
on location at the Denton Enterprise Airport’s Jet Center Fixed Base Operation (FBO). The
commercial featured a F1 fighter jet racing a Mercedes Formula E-One race car. The film
crew used the FBO’s main hangar for their closed set and the West Runway to film a
simulated race between the jet and race car. Airport staff synchronized all FAA, TXDOT,

and airport commercial traffic approvals to close the runway for use by the film crew. In
addition to the commercial, the Formula One driver had a small film crew following him
for an on-going Netflix series. The commercial, just released this week, features race car
driver Lewis Hamilton and can be viewed on YouTube. A full-feature video including actor
Glen Powell is expected at a later date as the brand releases their marketing assets.
Economic Development coordinated efforts with the following City of Denton departments
in this effort: Airport, Fire, Risk, City Attorney’s Office, and DTV. Discover Denton was
contacted to assist with securing a hotel block for the film crew. Additionally, Medical City
Denton had staff on site performing COVID-19 tests while local U-Haul vehicles, Jet
Works staff, and local film crews were hired to produce this commercial. Staff contact:

J. DTV Videos for October - In addition to producing public meetings, staff collaborated and
released several videos this month raising awareness, educating, and informing the
community. Each month staff highlight a few videos in the Friday Report with Council
encouraged to share the following:

Responses to Council Member Requests for Information
A. Inspection of Potential Encampment – Mayor Pro Tem Beck shared a resident complaint
about a possible homeless encampment on a vacant property adjacent to the Glenn Gary
neighborhood. The Homeless Outreach Team (H.O.T) and Community Improvement
Services (CIS) inspected the property and found trash and debris but no other activity. CIS
will work with the property owner to abate the trash and debris. Staff contact: Dani Shaw,

B. Texas Homeowner’s Assistance Program – On October 10, Mayor Pro Tem Beck asked
staff about the usefulness and/or validity of the Texas Homeowner’s Assistance Program
to Denton residents. The program is administered through the Department of Housing and
Community Affairs and is intended to assist qualified homeowners with delinquent
mortgage loans, property taxes, property insurance, homeowner association fees, or utility
bills, as seen on the attached flyer. After reviewing the information provided, staff would
be able to provide the link to the website and information about the Homeowners
Assistance Program on the City’s website as a resource. Staff contacts: Cassey Ogden,

C. Rayzor Town Center Driveway – On Friday, October 14, Mayor Hudspeth requested
information related to driveway permits or requests for Rayzor Town Center main drive
for the period between 9/4/22 to 10/14/22. The following information has been provided:

• Zoning Compliance Plan for Rayzor Ranch Town Center (Phase 1) Approved April
27, 2022
• Civil Engineering Plans for Rayzor Ranch Town Center (Phase 1) Approved
August 24, 2022
• Plat to establish easements associated with the approved ZCP for Rayzor Ranch
Town Center (Phase 1) Approved October 12, 2022
• Permit for construction of Rayzor Ranch Town Center Phase 1 site work is awaiting
final approval once comments are addressed and fees are paid.
The remainder connection between the retail and the roundabout near Alamo Drafthouse
must have an approved Zoning Compliance Plan prior to construction. This will be the
final phase to provide the full connection. It is our understanding Fidelis Realty, is currently
working on finalizing the land uses and building footprints now in order to complete the
development of the “donut hole” piece remaining. See the below Overall Zoning
Compliance Plan Exhibit clouded to illustrate the remainder where the connection is to be

D. Tree Canopy Data – On October 17, Council Member Beck requested clarification on the
City’s tree canopy data summary included in the Comprehensive Plan. Since 2008, the City
has conducted three canopy assessments, each time from a different supplier. Staff
reviewed the prior data, and determined each assessment varied in what boundary
jurisdiction and type of technology were used. Based on the data reported in 2016 and
2022, the tree canopy of the City of Denton proper has decreased by 3.9%. This decrease
is most likely due to a combination of factors that include an increase in image quality,

improved methodologies for assessing data, the annexation of land, death, and disease of
trees, and new development.
In January 2022, the City subscribed to TreePlotter Canopy by PlanIT Geo, which analyzes
and updates the City’s tree canopy assessment every two to three years at the parcel level.
New canopy numbers will be available in January 2023 and moving forward each
jurisdiction will be measured separately for consistent methodology. Staff contact:

E. North Texas Boulevard Update – On October 21, Council Member Davis contacted staff
requesting an update on the North Texas Boulevard Project. Staff shared information
regarding the public meeting held on Thursday, October 20, 2022, along with the link to
the Discuss Denton page which includes the recording from the meeting. Staff contact:

F. Bell Avenue Update – Staff received questions from various Council members regarding
the Bell Avenue Bicycle and Pedestrian Corridor and next steps. On October 18, City
Council gave direction to move forward with the Bell Avenue Bicycle and Pedestrian
Corridor Project. Staff informed City Council that the next steps for the project would be
to work with our selected consultant, Kimley Horn and Associates, to complete a final
survey and final design for the corridor. Once prepared, a design amendment will be
brought forward to City Council. Staff will work with representatives from the City
Attorney’s Office, Capital Projects/Engineering, Streets/Traffic Operations, Water
Utilities, Fire, Police, as well as Texas Woman’s University on next steps, including
bringing for City Council review and approval an ordinance restricting access. All
elements, including the responsibility of funding for construction, operation, and
maintenance, will be discussed with staff and representatives from TWU, and will be
completed through agreements and ordinances approved by City Council. Depending on
the final design, staff will select a contractor through the procurement process which will
include a contract that will also come before City Council for approval prior to initiating

G. Council Ceremonial Powers – On October 24, Council Member McGee inquired about the
ceremonial powers Council Members may have. Staff researched and verified the City
Charter does not provide ceremonial powers for Council members except for the Mayor.

H. The Railyard Multifamily Development – On October 24, Mayor Hudspeth requested staff
gather information for citizens regarding a neighborhood project southeast of downtown.
Lang Partners has acquired approximately 18.5 acres situated east/southeast of downtown
to redevelop the former industrial site with multifamily and commercial uses. The property
is zoned Mixed-Use Neighborhood and Mixed-Use Downtown Districts which permit
multifamily dwellings and a variety of commercial uses (restaurant, retail, office, etc).
According to the applicant, the project master plan includes three phases; however, only
Phase 1 has been submitted to the City for review and approval (outlined with the blue
dashed line below).

Phase I development includes 326 one-, two-, and three-bedroom dwelling units within 5,
three-story buildings. Two access driveways connect to East Sycamore Street and parking
is being provided on the site. Given the adjacent single-family residential uses to the south,
the south property line includes a 10-foot buffer designed with a 6-foot board-on-board
cedar fence, shrubs, and large canopy trees in accordance with the Denton Development
Code buffer requirements.
Since the existing zoning allows the proposed multifamily use by right, a public hearing
and notification was not required per State law or the Denton Development Code. A Final
Plat for Phase I was conditionally approved at the October 26 Planning and Zoning
Commission meeting to allow for some remaining engineering design issues to be
addressed. At that meeting, the developer’s representative Aimee Bissett addressed the
Commission and indicated that she would be available to discuss the project with the
residents of Southeast Denton or host a neighborhood meeting.
Thus far, the City has not received any applications for the development of Phases 2 and
3. Since the existing zoning permits multifamily and commercial uses, a public hearing
would not be required to develop those uses. Staff contact: Julie Wyatt, Development

I. Changing City General Election from May to November - A Council member inquired
whether the City can amend Section 3.01 of the Charter to change the City Council election
date from May to the November uniform election date. Chapter 41 of the Texas Election
Code establishes the uniform election dates on which governmental entities are permitted
to hold elections. Sec. 41.0052(a) of the Texas Election Code granted governmental entities
the limited authority to change their election date from May to November. However, there
was a December 31, 2016 statutory deadline for doing so. Sec. 41.0052(a) reads as follows:
Sec. 41.0052. CHANGING GENERAL ELECTION DATE. (a) The governing
body of a political subdivision, other than a county or municipal utility district, that

holds its general election for officers on a date other than the November uniform
election date may, not later than December 31, 2016, change the date on which it
holds its general election for officers to the November uniform election date.
After December 31, 2016, the Texas Election Code prohibits the governing body from
changing the election date from May to November. The Texas Legislature changed the
deadline in Sec. 41.0052(a) on multiple occasions between 1993 – 2016, but the current
deadline of December 31, 2016 has not changed in any subsequent legislative sessions.
Until the Texas Legislature adopts new legislation to change the existing 2016 deadline in
Sec. 41.0052(a), the City Council may not change the date on which general elections are
held from May to November. See Tex. Att’y Gen. Opin. No. GA-0342 (2005)

Upcoming Community Events and Meetings
A. Halloween Tennis Fun – Come out to the Goldfield Tennis Center, Friday, October 28,
from 6 to 7:30 p.m. and enjoy a fun-filled event featuring a variety of games including
Scoop-it-up, Monkeys and Bananas, and Tennis Stroke Spell Out. Winners will be selected
for the best overall boy, girl, and family participants. This event runs from 6 to 7:30 p.m.
at the Goldfield Tennis Center, 2005 W. Windsor Dr., next to the North Lakes Recreation

B. Movie in the Park: Hocus Pocus – Quakertown Park is hosting a screening of the original
Hocus Pocus on Friday, October 28 from 6 to 9 p.m., with preshow fun including pumpkin
painting, inflatables, lawn games, and a costume contest starting at 6 p.m. and the movie

C. Halloween Hike - On Friday, October 28 from 6 to 8 p.m., Denton Parks and Rec will host
a family-friendly, free night hike at South Lakes Park Nature Trail. Staff will take groups
every 30 minutes to see the mysterious side of nature on a 0.85-mile hike. Staff contact:

D. Texas Arbor Day Tree Planting – Denton Parks and Recreation and Keep Denton Beautiful
will host a tree planting event at North Lakes Park on Arbor Day, November 5 from 9 to
11 a.m. Volunteers can learn more about tree care and the importance of our urban forest

E. Unity Plaza Dedication – The University of North Texas (UNT) will dedicate Unity Plaza
on Saturday, November 5, at 1:30 p.m. Mayor and Council are invited to attend, as well as
residents. Unity Plaza is located between Apogee Stadium and the UNT Athletics offices
on the UNT campus.
Unity Plaza honors Abner Haynes and Dr. Leon King as the first African Americans to
integrate major college football at a four-year university in Texas. Abner Haynes, who is a
member of the UNT Athletics Hall of Fame, the Texas Sports Hall of Fame and the UNT
All-Century Team, led the Mean Green in rushing three times and was twice a Missouri
Valley All-Conference honoree. He led UNT to a 1959 Sun Bowl appearance, and Time
magazine named him an All-American. He went on to play for the AFL’s Dallas Texans
who later became the Kansas City Chiefs. In 1991 he was inducted into the Kansas City
Chief’s Hall of Fame.

After suffering an injury, Dr. King left UNT after his junior year to support his family, but
returned to complete his bachelor’s and master’s degrees. He later earned a doctorate from
Nova University. Dr. King was inducted into the African American Education Archives
and History Program Hall of Fame following more than four decades of service as a
teacher, coach, and administrator in the Dallas Independent School District.
Parking for the dedication needs to be reserved in advance of the event, but the event is
free and open to the public. Council will receive email instructions regarding parking
reservation. It is recommended to reserve parking early, as November 5 is also UNT
homecoming and parking will be limited. Parking reservations can be made through the

F. Veteran’s Day Program at Denton Senior Center – Denton Parks and Recreation and
patrons of the Denton Senior Center will gather together to honor veterans from all
branches of our armed forces. The event will feature a patriotic music performance by the
Young at Heart Band and will include light refreshments. Join in honoring our veterans,
on November 10, from 1:00 to 2 p.m. at the Denton Senior Center. Staff contact: Nicole

G. Recycling 101 – Join Sustainability for National Recycling Day on November 15 to review
what’s accepted in curbside recycling, where the recycling goes, why certain items are not
accepted, and what recycling becomes. The discussion will also include sustainable
alternatives to recycling. RSVP online to join Recycling 101 at 6 p.m. at Emily Fowler

H. Creating in Acrylics at the Denton Senior Center – Novice and experienced painters can
learn and grow their painting skills as each six-week session focuses on a different
technique. This session focuses on painting scenery; future sessions will include painting
Still Life and Portraits. Classes are held each Tuesday from 5:30 to 7:30 p.m. and pre-
registration is required. Registration is available online, in person, or over the phone at

I. State of the City – On November 17, the City of Denton is hosting the annual State of the
City event in-person from 6 to 8:30 p.m. The Denton City Council, City staff, and other
community members will gather to share major milestones from the past year and key
priorities for the future, as well as offer opportunities to get involved in our community.
• At 6 p.m., City staff will host an engagement fair to help residents learn about City
services, programs, and events.
• At 7 p.m., Mayor Gerard Hudspeth will give a formal address about Denton’s
growth and development, capital improvements, and citywide accomplishments
and goals. Following the address, Mayor and City Management staff will answer
community questions during a Q&A session.
This event is free and open to the public and will be hosted at Embassy Suites by Hilton
Denton Convention Center, at 3100 Town Center Trail, Denton, Texas. Staff contact:

INTRODUCTION
Peak Program Value, LLC (PPV) is pleased to offer the following update on the current status of the 909 N. Loop 288
Building project.
GENERAL INFORMATION
In spring 2020, City Council provided direction to staff to purchase a facility located at 909 N. Loop 288 for a co-located
day center and overnight shelter to provide services to people experiencing homelessness or at-risk of experiencing
homelessness. The property was originally designed as a nursing facility in 1975 and underwent improvements from
2004-2005, transforming the facility into its current use. The building is a one-story H-frame garden office building
(approximately 34,284 square feet) on a concrete slab foundation with two courtyards and approximately 2.0 acres
of land for future development opportunities. This facility was selected for consideration due to its location, design
comparable to the future intended use, and connection to other services.

services to renovate the facility and accommodate the proposed

SUBJECT:
2023 City Council Meeting Schedule
BACKGROUND:
The attached 2023 City Council Meeting Schedule has been prepared to provide for the two regular
meetings per month as mandated by the City Council Rules of Procedure. In addition, proposed
dates have been held for a Budget Workshop and City Council Retreat as both have occurred
annually in recent years.
DISCUSSION:
Section 2-29(d)(1) of the City Council Rules of Procedure require regular meetings be held the
first and third Tuesdays of each month, barring certain exceptions:
“Regular meetings: The council shall meet on the first and third Tuesday of each month,
at such time as may be set by the city council, unless the meeting is postponed or cancelled
for valid reasons. All regular meetings of the council will be held in City Hall at 215 East
McKinney Street, Denton, Texas or at such other location as the city council may, from
time to time by proper posting under the Open Meetings Act and so long as the meeting
is available to the public, designate. In the event a regular meeting falls on a day the city
observes a paid holiday, or the day after, no regular meeting shall be scheduled.
Furthermore, no regular meetings shall be held the first two weeks in July, nor the last two
weeks of November and December…”
To recognize the diversity of the community and of City Council, staff also considered major
religious holidays historically observed by both the City and previous City Councils.
Staff will continue the process of scheduling Regular Meetings while also providing a Special
Called Meeting during those months that do not provide for two Regular Meetings based on the
above-referenced rules. As the need for additional special called or joint meetings are identified,
the calendar will be modified.
There is no formal action required as the meeting calendar complies with the City Council Rules
of Procedure.
CONCLUSION:
Questions should be sent to the City Secretary’s Office by Friday, November 11, 2022. The public
version of the meeting schedule will be placed online at that time.

INFORMAL STAFF REPORT

SUBJECT:
Status of Joint Use Agreements and Stub Pole Removal
BACKGROUND:
Council Member McGee requested information regarding power lines and line clean up in
Southeast Denton. Additionally, Denton Municipal Electric (DME) understands that other past
and current Council Members have shared interest in this subject and the related efforts to remove
stub poles.
Many telecommunication companies that provide service to the citizens of Denton utilize DME
poles to install overhead copper and/or fiber lines to expand their system in the city of Denton
(City). When DME constructs improvements on its electric system it often requires the
replacement of existing wood poles to achieve either regulatory clearances or for safety purposes.
At the locations where a DME pole has been replaced, electric equipment is transferred to the new
pole and the old pole is cut above the location of the telecommunication lines. These poles are
commonly referred to as “stub poles” but may also be called, “topped” or “topped off” poles.
Notice is provided to the telecommunication company(-ies) to transfer cables to the new pole or
pole line; however, this transfer often does not take place, leaving multiple poles at a single
location.
DISCUSSION:
The City has multiple locations throughout its service territory where stub
poles exist. Currently, DME estimates about 558 stub poles in the system.
Appendix 1 reflects the locations of these poles. Additionally, some stub
poles are owned by the telecommunications company and, as such, would
likely remain. Image 1 is representative of one of these installations where
the stub pole is less than 10 feet away from an existing DME pole.
Joint Use Agreements
The City’s Legal team, along with DME, are working with Lloyd Gosselink,
Rochelle & Townsend P.C. to assist with the development of a joint use
agreement. An existing “pole attachment” agreement was negotiated with
the University of North Texas, Unite Private Networks, and MCI Metro.
These agreements may need to be replaced once a final joint use agreement
is developed.

Action Plan
DME will continue to work with attorneys to develop a joint use agreement that may be used with
all telecommunication companies. Once completed, DME will coordinate with telecommunication
companies to execute these agreements and ensure a working relationship to address the stub pole
issue. If staff are unable to get agreements in place, DME may need to explore other legal remedies,
including relocation of communication lines by qualified contractors at its expense and to seek
reimbursement from the telecommunication companies. Staff would anticipate an initial budgetary
impact which staff would plan to discuss with the PUB and City Council in next year’s budget
process.
