General Election Voting Locations – Attached are early voting and election day polling locations finalized by the Denton County Elections Office. The information has been placed on the City’s Vote webpage and addresses have been linked for easier searching. As with previous elections, Capital Projects/Engineering is identifying any roadway construction that might hinder the ability of residents to travel to listed voting locations in Denton. Staff will then coordinate voting detour routes, produce detour “vote here” directional signs, and then place the signs at the potential areas of conflict. The diagrams for each location were also placed on the Vote webpage. Staff contact: Rosa Rios, City Secretary B. 2023 Denton Utilities Benchmark Survey – Over the next few weeks, select utility customers will receive a utilities and customer service benchmark survey provided by the City of Denton via mail, as referenced in Informal Staff Report 2022-076. The launch of this broad, large-scale community survey via Polco will gather baseline data specifically surrounding the provision of utilities and utility billing. The first phase of this survey will utilize random sampling to ensure statistically valid results. The second phase of the survey will include an online open participation survey, allowing utility customers to provide feedback should they not have been included in the random sampling selection. Once results are compiled, staff will provide an update to Council via an upcoming Friday Report. Staff contact: Jennifer Rainey, City Manager’s Office C. Denton Animal Services Receives Donated Pet Food Pantry Shed - Denton Animal Services (DAS) recently received a donated shed from Denton Animal Support Foundation (DASF). The shed will be used as a Pet Food Pantry to store donated pet food that is distributed to anyone in need of pet food. Last year, in partnership with DASF, DAS distributed pet food to 2,841 customers. DAS extends its appreciation and gratitude for the support of DASF to continue the Pet Food Pantry program and a secure place to store the food. Supplemental Council Meeting Documents – On Feb. 24, Mayor Hudspeth suggested creating a digital folder to store Council meeting-related documents. Staff regularly provide clarifying responses to Council questions on City Council agenda items prior to meetings. Beginning March 21, these questions and responses will be publicly available and linked to the agenda under “Section 2. Requests for clarification of agenda items listed on this agenda” as indicated in the attached document. Additionally, any handouts provided during the meeting will be uploaded and available after the conclusion of the meeting. Staff contact: Rosa Rios, City Secretary’s Office B. ReHydrant Feedback – On March 14, Mayor Pro Tem Beck shared information and requested staff feedback on ReHydrant projects from various jurisdictions. Staff from multiple departments reviewed the concept and provided feedback. Should additional information be requested, a two-minute pitch is requested. Water Utilities advised existing hydrants in the City’s system are ‘dry barrel type’, which TCEQ may not allow to be used for potable water. Staff is researching the regulations on this but advised of multiple considerations to be aware of should this be allowed by TCEQ, including the maintenance of water quality through backflow prevention and regular testing. Community Services advised that the concept does not appear to conflict with the Property Maintenance Code, though considerations would need to be made if a project like this were to be implemented locally, including what role, if any, the City would have enforcing compliance with proper usage of the drinking fountain. Should additional information be needed, a two-minute pitch is requested for staff to perform a more in-depth assessment. Staff contact: Jennifer Rainey, City Manager’s Office C. Senior Living Group Home Inquiry – On March 14, a resident emailed staff and Mayor Hudspeth with concerns about a residence on Churchill, which they believe is being used as a senior living group home. Staff visited the residence on March 15, inspected the rooms, and spoke with the owner. Staff did not observe any activity that went beyond what is permitted by city standards for residents of a single-family dwelling. Staff contact: Sean Jacobson, Planning D. Property Concerns at on Locust St – On March 15, Mayor Hudspeth and Council Member McGee shared communication from a local business regarding a potential roof leak. Staff visited the location along with the property manager, contractor, and business owner to review the building repairs provided and plans to continue to remediate the issue. Staff will follow up with the business owner to ensure the roof is in proper condition after the next rain. Staff contact: Monica Benavides, City Manager’s Office E. GreenSense Program Update – On March 16, Mayor Hudspeth shared resident communication regarding rooftop solar systems and solar tax. Staff believe the increased resident communication is prompted by a flyer distributed to residential customers with rooftop solar systems incorrectly informing them of an impending $50 “solar tax”. While staff recommendations to both the Sustainability Framework Advisory Committee and Public Utilities Board did include recommended changes to fees paid by residential customers with rooftop solar, those changes are meant to recover fixed costs currently not paid by those customers and instead borne by all other customers. Denton Municipal Electric (DME) currently serves over 60,000 customers and approximately 1,000 of those customers have rooftop solar systems. As such, a work session with the City Council on 3 May 16 was previously scheduled to discuss the current state of the rooftop solar market, recommended updates to the GreenSense Program, and provide the advisory bodies’ recommendations. Staff contact: Bill Shepherd, DME Upcoming Community Events and Public Meetings A. Macramé Workshop – (ages 18+) on Tuesday, March 21 at 2 p.m. at the South Branch Library. Join local artisan Mary Cresson and learn two basic knots used in macramé work. You will leave with a new skill and two keychains. More information and registration is available online. Public Meeting for Cooper Crossing Neighborhood 1A – Capital Projects is hosting a Virtual Community Meeting for the 2019 Street Bond Neighborhood 1A (Cooper Crossing) Construction Kickoff on Thursday, March 23 at 6 p.m. This project consists of full-depth reconstruction of 21 street segments within the Neighborhood 1A project area, including Meadow Lane, Plum Hollow Street, Tanglewood Street, Pheasant Hollow Street, Willow Stone Street, Pear Tree Place, Windbrook Street, and Windbrook Court. Through the Lens – (ages 5-11) on Thursday, March 23 at 4 p.m. at the South Branch Library. Learn about photographer Dorothea Lange, who captured images of the Dust Bowl and the Great Depression and make Depression-era toys. More information and registration is available online. Staff contact: Jennifer Bekker, Library D. Adaptive Rec Bowling – (ages 14+) are invited to join Adaptive Recreation staff at the University Lanes Bowling Alley (1212 E. University Drive) on March 24. This social connection event begins at 11:00 a.m. and continues until 1:00 p.m. The cost is $10 per person. Registration is required and available online. Staff contact: Mia Macy, Parks and Recreation E. Great American Cleanup – The 35th Annual Great American Cleanup (GAC), Denton’s largest and longest-running litter cleanup, is Saturday, March 25. Cleanups begin at 9 a.m. followed by a Volunteer Appreciation Party at Quakertown Park / Denton Civic Center (321 E. McKinney Street) from 11 a.m. to 1 p.m. with a free lunch, educational activity booths, a children’s bounce house, and more. During the Appreciation Party, prizes will be awarded to the largest group of volunteers, the most bags collected, and the oddest item found. While online registration for the 2023 GAC has closed, day-of registration will be available at the event beginning at 8 a.m. at the Denton Civic Center. Staff contact: Autumn Natalie, Parks and Recreation F. Northeast Denton Area Plan Public Engagement Events – Two public engagement events have been scheduled for the Northeast Denton Area Plan. The first event is a Community Visioning Open House to obtain input and feedback from the community. At the open house, attendees will learn about the planning process and timeline, participate in fun exercises to understand opportunities and challenges from the community’s point of view and share their vision for the Northeast Denton area. Staff encourages community members and Council to attend one of the two Community Visioning Open House dates below: • Date/Time: Thursday, March 23 from 6 p.m. to 8 p.m. Saturday, March 25 from 4 p.m. to 6 p.m. 4 • Location: Hodge Elementary School Cafeteria – 3900 Grant Parkway The second event is an invitation-only Strategic Foresight Workshop. Participants will review trends impacting the area, develop future scenarios, and identify a list of common themes. Feedback will be used to develop a future vision statement for the Northeast Denton area, which will then be vetted widely through multiple public feedback opportunities, including an online survey on the project website. This one-day workshop will include a diverse group of 40-60 stakeholders that are a representative sample across geography, organizations, and demographics (age, race, gender, etc.). The invitations will ensure participants represent a broad range of experiences to ensure a meaningful dialogue. City staff worked with the consultant team to identify stakeholders that include City Council members, Planning and Zoning Commissioners, Denton County representatives, Northeast Denton Area Plan Steering Committee and Ambassador members, DISD representatives, landowners, residents, business owners and university and high school faculty and students. Felted Soap Workshop – (ages 18+) on Wednesday, March 29 at 6:30 p.m. at the South Branch Library. Have “good clean fun” by creating felted soap! We will cover a bar of soap with colorful wool which gently exfoliates, eliminates the need for a loofah or washcloth, and makes soap easier to hang on to. Teen Art Night – (ages 12-17) The Teen Council is hosting an Art Night on March 31 from 7 p.m. to 9 p.m. at Denia Recreation Center (1001 Parvin St). Step-by-step instructions will be provided to create your own masterpieces. No creative or artistic skills are needed. Additionally, the Teen Council will provide all necessary supplies and snacks for all attendees. The cost is $10 per teen , and registration is available online. Staff contact: David Ruiz, Parks and Recreation I. Active Adult Health Fair –(active adults ages 50+) The Denton Senior Center (509 N. Bell Avenue) is hosting a health and resource fair on April 1 from 9 a.m. to noon. This fair provides community members connections to services and resources they may need now or in the future. Vendors with tables include Medicare, doctor offices, legal services, and so much more! The fair is free to attend and open to the public. Staff contact: Nicole Brasher, Parks and Recreation J. Emily Frenkel Quilt Talk – Local quilter, Emily Frenkel, will present her historical masterpiece “The 1922 Displacement of the Town of Quaker, in Denton, TX” to the Visual Arts Society of Texas at their April 5 meeting at 6:45 p.m. at the Patterson-Appleton Arts Center (400 E. Hickory). The event is $5.00 per person and is included on the City of Denton’s Quakertown Centennial Memorial Calendar. This calendar of events runs through the end of 2023 and brings together events hosted by the City and community partners that honor the Quakertown community and recognize the centennial of its removal. 5 For more information, visit discussdenton.com/Quakertown. Easter Eggstravaganza – (ages 0-10) Denton Parks and Recreation will host its annual Easter Eggstravaganza and Egg Hunt on Saturday, April 8 from 9 a.m. – noon. The family- friendly event will feature bounce houses, food trucks, arts and crafts, face painting, balloon twisting, a petting zoo, free photos with the Easter Bunny, and over 40,000 eggs! The egg hunts are staggered and categorized by age groups and are scheduled at various times throughout the event. This year’s event will feature a sensory hour and sensory- friendly egg hunt which includes reduced noise and lights and allows for a slower paced egg hunt for every bunny to enjoy! Hop on out and do not forget your favorite basket for the hunt! This free event is hosted at the Denton Civic Center and Quakertown Park, 321 E. Kids Rock: The Return – (ages 5-11) Kids Rock has returned, and young Denton residents are having a blast! Each month, kids enjoy a night out while parents enjoy the night off. The program runs from 7 p.m. to 11 p.m. Experienced staff plan each month around a unique theme, then create play stations that include games and activities, mini-sports tournaments, unique inflatable fun, ping-pong, video games on a large screen, and a DJ with dance contests! Two slices of pizza and a drink are included for attendees. Staff also sell additional concessions and glow products. Preregistration is required and can be completed online. The cost is $25 per child, with a $5 late fee if registering the day of, after 5 p.m., with an upcoming program on April 21. Staff contact: Sara Farris, Parks and Recreation M. Garden Workdays at Denia Wildflower Garden — Join Keep Denton Beautiful for monthly garden workdays at the Denia Wildflower Garden, located in front of Denia Recreation Center (1001 Parvin St.). Get ready to dig in the dirt and learn proper garden maintenance techniques with our garden experts. Tasks vary but frequently involve weeding, cutting back plants, and picking up plant debris and litter. The volunteer opportunity is free to attend but does require registration through the park’s event calendar page. Upcoming workdays are scheduled for April 15, and May 6. The first proposed project is to implement an Advanced Distribution Management System (ADMS), improving control and monitoring of the distribution system. The second proposal is for the design and completion of a distribution system of renewable generation resources and storage serving the University of North Texas (UNT) campus and creating energy capacity on the DME distribution grid to serve local customers. The DOE has reviewed the proposals and encouraged the City to submit a full application on each project, advancing both proposals to the next step of the grant process. BACKGROUND: GRIP is a $10.5 billion program funded by the Infrastructure Investment and Jobs Act, commonly referred to as BIL, with the purpose to enhance grid flexibility and improve the resilience of the power system against growing threats of extreme weather and climate change. The first round of funding for this program is $3.8 billion for FY 22 and 23. GRIP includes three funding Topic Areas: • Topic Area 1 – Grid Resilience Utility and Industry Grants ($2.5 billion) - supports activities that will modernize the electric grid to reduce impacts due to extreme weather and natural disasters. • Topic Area 2 – Smart Grid ($3 billion) – aims to increase the flexibility, efficiency, and reliability of the electric power system, with particular focus on increasing capacity of the transmission system, preventing faults that may lead to wildfires or other system disturbances, integrating renewable energy at the transmission and distribution levels, and facilitating the integration of increasing electrified vehicles, buildings, and other grid- edge devices. • Topic Area 3 – Grid Innovation ($5 billion) – provides financial assistance to one or multiple states, Tribes, local governments, and public utility commissions to collaborate with electric sector owners and operators to deploy projects that use innovative approaches to transmission, storage, and distribution infrastructure to enhance grid resilience and reliability. Concept papers, outlining a proposed project, are a required first step in the application process and submission deadlines vary by funding Topic Area. DME has submitted two concept papers for proposed projects under Topic Area 2 and 3. Both Topic Areas require a 50 percent non-federal source match. To modernize the grid and reduce service impacts related to natural events, remote control and monitoring of the DME distribution system is proposed under Topic Area 2. Currently, DME relies on substation breakers to disconnect the power in the event of a fault, customers to call in 12 March 17, 2023 Report No. 2023-026 to report an outage, and line crews to find the affected circuit and restore power. Utility providers are implementing ADMS, a software platform that integrates numerous utility systems and provides automated outage restoration and optimization of distribution grid performance. ADMS functions include automated Fault Location, Isolation, and Service Restoration (FLISR), conservation voltage reduction, peak demand management, and volt/volt-ampere reactive (volt/VAR) optimization. DME strongly believes that this proven technology can provide safe and secure management of an increasing volume of data on the distribution electric grid while enabling the effective management of distributed renewable energy, electric vehicle charging, and other grid-connected devices. In collaboration with Hunt Energy Enterprises (HEE) and UNT, DME proposes integrating batteries into existing wind generators and future solar energy resources managed by DME and UNT, on the UNT campus, to increase overall system resilience and provide new sources of reliable power and renewable power to the citizens of Denton and the students and faculty of UNT as well as the Electric Reliability Council of Texas (ERCOT) grid. The design and completion of the proposed project will provide a distribution system of renewable generation resources and storage serving the University of North Texas (UNT) campus and create energy capacity on the DME distribution grid to serve local customers and provide ancillary services like fast frequency response, voltage support, congestion management, and power quality management to the distribution network. The collaborative and innovative approach to enhance grid resilience and reliability meets the requirements of Topic Area 3. DOE has reviewed the proposals and encouraged the City to submit a full application on each project, advancing both proposals to the next step of the process. The deadline for Topic Area 2 full applications is March 17, 2023 and the deadline for Topic Area 3 is May 19, 2023. Staff is currently working to finalize the required documents and budget for the ADMS application (Topic Area 2). Discussions between the City, UNT, and HEE continue regarding a distribution system of renewable generation resources and storage. Submission of a full application under Topic Area 3 will be dependent on an agreed collaboration. Since the beginning of bill filing on Nov. 14, 2022, over 8,000 pieces of legislation were submitted for the legislature’s consideration. This record-breaking tally includes over 1,500 bills impacting cities. Staff along with its legislative consultants continue to review filed legislation, assess their impacts on the City of Denton, and, in some cases, prepare for the possibility of providing written or verbal testimony to the legislature. A report of the bills currently being tracked by the City is attached. Additionally, the Texas Municipal League also publishes detailed descriptions of bills on its website. With roughly 67 days of the 140-day session complete, legislators continue their work by hearing bills in an ever-increasing number of committee meetings. The Senate has begun to hear a small number of bills on the floor, while the House is expected to begin floor activity in earnest in late March. DISCUSSION: The following are updates on the City’s state legislative-related activities over the previous weeks. Qualified Hotel Project Legislation The City’s Qualified Hotel Project bill (H.B. 2321), which would grant Denton the ability to use the Qualified Hotel Project economic development tool was previously filed in the house, but, despite significant engagement with senate delegation members, the City was not able to secure the filing of a companion bill in the Senate. The City and its legislative consultants are working vigorously to have the bill heard in committee as soon as possible. Recent Actions Several significant local pre-emption bills were heard in committee this week. S.B. 149 would restrict a city’s ability to regulate what the bill defines as “statewide commerce”. This broadly written bill could limit requirements to various permits and regulatory systems, such as noise, donation boxes, mini-warehouses, dance halls, lodging facilities, and alternate housing facilities. Issues such as metal recycling, accessible pedestrian sidewalks, special event parking, and valet parking policies could also be severely restricted. A similar bill, H.B. 2127, would remove a city’s ability to adopt or enforce ordinances relating to a field under specific state codes, including the Occupational Code and Agriculture Code. Staff expressed opposition to the authors of both bills and the committee’s hearing them, focusing on the pre-emption of local control and the possible unintended consequences of such broadly written legislation. Staff and the City’s legislative consultants have also taken advocacy action on the following: 14 March 17, 2023 Report No. 2023-027 • Opposition to S.B. 175, which would prohibit cities from using legislative consultants to communicate Council’s legislative policy in Austin. • Support for H.B. 149, which would provide additional flexibility with regarding to parkland dedication • A number of human resource-related bills, summarized in our Human Resources-Related Bill Impact Summary (attached) • Two telecommunications bills summarized in our Telecommunications-Related Bill Impact Summary (attached) Electric Utility Bills On the last official day to file bills, nine (9) bills focused on ERCOT market design were filed by the Chair and Vice Chair of the Senate Business and Commerce Committee. Two of these bills, SB 6 and SB 7, are supported by the Lieutenant Governor and are priority bills. DME filed comments on both bills this week (attached). SB 6 establishes the Texas Energy Insurance Program and other funding mechanisms to support the construction and operation of new dispatchable (natural gas) electric generating facilities and a fund to provide low-interest loans to existing dispatchable generating resources to improve their reliability and to protect against their retirement. SB 7 mandates the development of a new reliability product in the ERCOT day-ahead market called the Dispatchable Reliability Reserve Service. This new product would require renewable energy resources to purchase capacity firming to cover the natural intermittency of wind and solar generation as well as requiring Load Serving Entities like DME to purchase said product to cover hourly load forecast error. DME opposes this approach as it discriminates against renewable energy resources and would disproportionately allocate grid reliability costs to municipal utilities that have, as a matter of public policy, decided to supply renewable energy to its customers. Over 320 electric utility, environmental, and municipal utility-related bills have been filed this session. DME staff, the Texas Public Power Association, and Focused Advocacy are tracking these bills to determine which ones will move through the legislative process and determining our position on each of them. Denton County Days Staff and partner organizations have coordinated travel, meetings, and visits in conjunction with Denton County Days at the Capitol on March 21-22. Denton County Days serves as an opportunity for the various groups, organizations, entities, and jurisdictions to visit with members of the delegation to advocate for the needs of the communities served individually, and as a collective voice advocating for the greater good of residents and businesses within Denton County. Multiple members of the City’s legislative delegation, Council members, peer jurisdictions, and partner organizations will be in attendance. A copy of the City of Denton 2023-2024 Legislative Program is available online. CONCLUSION: Staff, along with legislative consultants, peer cities, and partner organizations, are actively implementing the Council’s legislative policy. All Rights Reserved. 153 City of Denton Updated: 3/9/23 Human Resources-Related Bill Impact Summaries Bill Impact Summaries Human Resources-Related Bills H.B. 121 S.B. 563 Employment Benefits Summary The bills provide that: (1) a city may not adopt or enforce an ordinance, order, rule, regulation, or policy requiring any terms of employment that exceed or conflict with federal or state law relating to any form of employment leave, hiring practices, employment benefits, scheduling practices, or other terms of employment; (2) any provision of an ordinance, order, rule, regulation, or policy that violates (1), above, is void and unenforceable; and (3) the provision in (1), above, does not apply to minimum wage or a contract relating to the terms of employment voluntarily entered into between a private employer or entity and a governmental entity. Impact to Denton As written, the bills would not allow the City of Denton to offer employment benefits greater than those allowed by state or federal law. The City of Denton faces extensive public and private-sector competition for qualified employees within the DFW area and relies on an attractive benefits package to recruit and retain employees. Benefits programs that allow the City of Denton to attract and retain qualified employees, such as paid parental leave or tuition reimbursement, would be prohibited under this legislation. Request Oppose this bill as written. Support an amendment that guarantees the City of Denton may provide competitive employee benefits that go beyond the state or federal minimum. H.B. 471 S.B. 799 Public Safety Personnel Leave/Benefits Summary The bills provide numerous requirements relating to public safety personnel leave of absence and benefits for an illness or injury related to a person’s line of work. Notably, the bills states that a firefighter, peace officer, or EMT who suffers an acute myocardial infarction (heart attack) or stroke resulting in disability or death is presumed to have suffered the disability or death during the course and scope of employment if they were engaged in a situation that involved stressful or strenuous physical activity and the heart attack or stroke occurred not later than 24 hours after the end of a shift in which they were engaging in the activity described above. A similar provision in S.B. 799 extends critical illness benefits to retirees who experience a heart attack or stroke 5 years after retirement. Impact to Denton Both bills create a light duty requirement for up to a year; however, the bills are unclear if the City can deny or challenge the necessity for the light duty in a rebuttal. This is important as illness, injuries, and disabilities are uniquely different and may not require a full year of light duty. Both bills also create a new statutory provision that, should a public safety officer suffer a heart attack or stroke within 24 hours of a shift that included “strenuous” or “stressful” activity, it is presumed to have been caused at the workplace. This blanket 154 City of Denton Updated: 3/9/23 Human Resources-Related Bill Impact Summaries provision does not take into account events taking place after the work shift that could more directly result in said heart attack or stroke (such as exercise, personal stressors, or other relevant factors). H.B. 471, as written, appears to confer lifetime income benefits to employees of the City whose impairment or disability is the result of service as a volunteer first responder for some other jurisdiction. This is a matter in which the City has no control and would be paying the costs for service that does not benefit the citizens of Denton. S.B. 799 requires that leave be part of a meet and confer agreement which removes the right of both the City and the local police associations to negotiate a mutually agreeable alternative within our Meet and Confer Agreement. The bill also creates a "critical illness" benefit that would be extended to any retirees if they experience the onset of a heart attack, stroke, and/or one of a large number of cancers. Like the 24-hour presumption addressed above, this blanket provision does not take into account events taking place after the date of retirement that directly result in said heart attack stroke, or cancer (such as significant lifestyle changes, substance abuse, exposure to hazardous chemicals, etc.). Request Amend both bills to clarify a right of rebuttal by the City for any guaranteed leave or benefit. Amend S.B. 799 to allow the City to negotiate changes to this part of the statute through a Meet and Confer Agreement. H.B. 79 Employment Leave for Domestic Violence Victims Summary This bill, among other things, provides that an employer shall not discharge, discriminate or retaliate against an employee for taking time off to participate in legal proceedings when the employee is a victim of domestic violence, sexual assault, or stalking. The same is prohibited when said victim seeks legal relief such as a restraining order. The bill also provides that reasonable accommodations shall be made for a victim of domestic violence, sexual assault, or stalking, who requests an accommodation for the safety of the victim while at work. Impact to Denton The City of Denton supports assisting victims of domestic violence, sexual assault, and stalking and supports reasonably accommodating their safety needs. Request Support this bill and, to ensure the bill is consistently applied, seek clarification on the amount of time off from work that shall be provided to victims. 155 City of Denton Updated: 3/15/23 Telecommunications-Related Bill Impact Summaries Bill Impact Summaries Telecommunications-Related Bills H.B. 1303 S.B. 1117 Right-of-Way Rental Fees Summary The bills would, for purposes of city right-of-way rental fees from cable and video providers, clarify that “video service” means video programming services provided by a video service provider through wireline facilities located at least in part in the public right-of-way without regard to delivery technology. More importantly, the bills provide that the term “video service” does not include direct-to-home satellite services or any video programming accessed via a service that enables users to access content, information, electronic mail, or other services offered over the Internet, including streaming content. Impact to Denton The bill amends the definition of “video service” provider to exclude streaming companies, with the result of preventing municipalities from being able to collect franchise fees for these services. As many cable providers begin to provide internet-based streaming options, they are bypassing their obligation to compensate the public for use of the public right-of- way for the internet cable used to transmit those video streaming services. Cities are currently in litigation on this point and this bill would undercut the right of the public to be compensated for use of its right of way and, in effect, provide a gift of public property to these companies. I think it is important to understand uses of cash transfers to the city’s general fund and to draw analogies to other utilities in Denton. In the case of DME, the following are the cash transfers to the general fund: 1. Support function fund transfers a. DME uses the city’s Human Resources, Information Technology, Procurement, Finance and Accounting and Legal departments and provides a cost of service based annual payment to the city’s general fund for these services. 2. Franchise Fee a. A 5% franchise fee is paid to the city for the use of the city’s right of ways. This fee is paid by all utilities in the city of Denton including ONCOR, CoServ, Atmos Gas, and telecommunications providers. Franchise fees are specifically identified in the Denton City Charter1. The specific language in the Charter is as follows: The holder or grantee of any franchise or license to use public streets, alleys, highways, or other public property may be required, as compensation for the right or privilege enjo yed, to pay to the City of Denton each year such reasonable sum (not less than two (2) percent of the gross receipts of the business pursued by the holder of the franchise earned for service rendered in the City of Denton), or to pay compensation, rent, or any other fee or charge authorized by law, including, without limitation, specific charges per service line, access line fees, and all other legally permissible charges for the use of its streets, alleys, highways, and other public property, as the counci l may determine by ordinance or by contract with any such utility, which compensation shall be in addition to all ad valorem and corporation 1 ARTICLE XIII. - FRANCHISES | Code of Ordinances | Denton, TX | Municode Library 157 2 taxes paid by the utility. (Ord. No. 99 -057, Amend. No. 24, 2-16-99, ratified 5-1-99) 3. Return on Investment (ROI) a. Pursuant to authority granted in the city Charter, DME remits to the General Fund, a 6% ROI based upon retail revenues. (wholesale transactions are exempt). As the sole shareholder , the city is intitled to a dividend payment that is reflective of the operat ional risk and investment of risk capital. This ROI is analogous to the dividend or return on equity (ROE) permitted by the Public Utility Commission of Texas (PUCT) in the approved rates for investor owned utilities including TDSPs, TDUs, investor owned water and wastewater utilities, and telecommunications providers. Protections are in place to ensure that only “excess revenues” are used to provide the ROI transfer 2. There are several levels of protections to limit the maximum amount of the transfer as detailed below. 1) After all of the requirements of the various funds have been met, there shall be computed a return on the net investment in the utility system. The "Net Investment" figure used in these computations shall be taken from the independent audit of the utility systems for the last fiscal period. The city shall be entitled to receive annually on the net investment from excess revenues, if any, not more than six (6) percent of the net investment3. 2) Any money remaining in the "System Fund" after all necessary expenses of operation and maintenance of the utility systems, including salaries, labor and materials, have been paid, upon proper approval, and after all payments have been made into the several funds required and provided to be made by the ordinance or ordinances authorizing the issuance of any revenue bonds of the city, now outstanding or hereafter authorized and issued which may be payable from and secured by a pledge of the net earnings of th e light, water or sewer systems, shall be deemed "Excess Revenues" for the purposes of this section. "System Fund" as used herein shall mean the fund (or funds as may be required by outstanding bond issues) into which are deposited the gross incomes derived from the operation of the above named utility systems. 2 ARTICLE XII. - PUBLIC UTILITIES | Code of Ordinances | Denton, TX | Municode Library 3 Sec. 12.03. - Excess revenues of utility systems. | Code of Ordinances | Denton, TX | Municode Library 158 3 The City of Denton operates several public utilities all of which are subject to the broad authority that the City Council has pursuant to the Denton City Charter. Those utility funds include: • Water Fund • Wastewater Fund • Solid Waste and Recycling Fund; and • Electric Fund In addition to the city charter limitations identified above, the approval of the annual budget of DME by the City Council is approved in open session with the opportunity for public input to comment on any aspect of the budget. Additionally, there are additional protections resulting from the bond financing that limit the amount of the ROI. While each fund is managed separately, rates and required reserves (fund balances) are approved by the City Commission to provide revenue sufficiency and reserves that are reflective of bond covenants and the risk posed by operating these utilities.4 Denton issues both revenue bonds and general obligation bonds to finance capital improvements in its utility funds. The bond covenants universally mandate that in the waterfall of use of revenues, payment of operational expenses, debt and interest expenses must be paid before providing any GFT to the city. The bond covenants also dictate minimum debt coverage ratios and, in some cases, minimum fund balances.
