March 24, 2023 Report No. 2023-029 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: March 24, 2023, State Legislative Update BACKGROUND: The filing period for the 88th Session of the Texas Legislature concluded on Friday, March 10. Since the beginning of bill filing on Nov. 14, 2022, over 8,000 pieces of legislation were submitted for the legislature’s consideration. This record-breaking tally includes over 1,500 bills impacting cities. Staff along with its legislative consultants continue to review filed legislation, assess their impacts on the City of Denton, and, in some cases, prepare for and provide written or verbal testimony to the legislature. A report of the bills currently being tracked by the City is attached. Additionally, the Texas Municipal League also publishes detailed descriptions of bills on its website. Nearing the halfway point of the 140-day session, legislators continue their work by hearing bills in an ever-increasing number of committee meetings. DISCUSSION: This week, the City took action in opposition to two bills heard in committee. S.B. 1117 amends the definition of “video service provider” to exclude streaming companies, with the result of preventing municipalities from being able to collect franchise fees for these services. There is pending ligation on this topic and the City provided information to the legislature requesting that the bill be opposed until the court proceedings have concluded. Additionally, this week, S.B. 1110, which would generally prohibit the transfer of funds from a municipally owned electric utility to the general fund was heard in committee. The City provided a letter to the committee (attached) providing additional information on the purpose for such transfers, how they are used, and how they relate to calculations of the full cost of service for a utility. The City gave notice of support for H.B. 540 ahead of its committee hearing this week . This bill would allow grants from the Texas State Library and Archives Commission to be used for new construction, rehabilitation, or renovation of a library or the infrastructure of a library. As we plan for new libraries and/or the future of our current library facilities, the availability of state-level grant dollars will be an important option for potential funding. Finally, at the request of the office of Representative Lynn Stucky, staff provided information and were in Austin to respond to inquiries regarding H.B. 2331. This will would ensure that document requests, via subpoena, which stem from third-party lawsuits would be bound by the same fee requirements as residents requesting information through a Public Information Act request. Currently, state statute limits the fee for subpoena document requests to $1, regardless of the volume of the material requested. March 24, 2023 Report No. 2023-029 Electric Utility Bills The Senate Business and Commerce Committee held a hearing on nine bills aimed at restructuring the ERCOT market to improve grid reliability. Several of the bills target intermittent/renewable resources as the leading contributor to energy inadequacy and would disproportionately levy reliability improvement costs on communities like Denton that rely predominantly on renewable energy. DME filed comments to the committee on SB6 and SB7 (attached) but has not taken a position on the bills as considerable committee substitutes are expected. DME will take a position once the bills are ready for a vote in the committee. DME staff continue to monitor the status of other electric utility bills and complete impact analysis. Denton County Days Mayor and Council, along with staff, peer jurisdictions, and partner organizations, convened at the Capitol this week for Denton County Days. While in Austin, Council and staff had opportunities to meet with state agencies and elected officials, receive recognition in the Senate and House, and advocate for the City. CONCLUSION: Staff, along with legislative consultants, peer cities, and partner organizations, are actively implementing the Council’s legislative policy. As written, C.S.S.B. 1110 would prohibit transfers of funds from a municipally owned electric utility (MOU) to a city’s General Fund, if the transfer would result in a rate increase or a “financial deficit” for the municipal utility. Additionally, an MOU may not include transfers of funds to the general fund in its cost of service study. The City of Denton currently effects general fund transfers from its MOUs in three ways: 1. Cost of Service Payments. These payments are generally recognized as administrative transfers to fund services that each utility would have if they were fully vertical. Instead, they are centralized, realizing economies of scale and reduced costs. Our electric utility utilizes the City’s Human Resources, Information Technology, Procurement, Finance and Accounting, and Legal departments. These payments are outlined explicitly in our annual budget. 2. Franchise Fees. A 5% franchise fee is paid to the city for the use of the city’s right of ways. This fee is paid by all utilities in the city of Denton including ONCOR, CoServ, Atmos Gas, and telecommunications providers. This is provided by state law and the City of Denton charter. 3. Return on Investment (ROI) Payments. The City, representing the citizens of Denton, is the sole shareholder of its electric utility, and just like any investor-owned utility, the shareholders (in this case the citizens of Denton) are entitled to a dividend payment that reflects the operational and financial risk they have shouldered. An example of such risk is that the bonds of a utility are ultimately backed by the full faith and credit of taxpayers. This ROI payment in return for risk is no different from the return on equity permitted by the Public Utility Commission of Texas for investor-owned utilities. In addition, the City has several levels of protection to limit the maximum amount of ROI transfers and our ROI is capped at no more than 6% of the net investment of the combined utility system. 2 When these transfers, well-prescribed by state law and the City charter, are considered in the rate-making process they act to ensure that Denton’s MOU rates account for the full costs of providing the service, just like any investor-owned utility. Additionally, the electric utility rates in the City of Denton are adopted by the Public Utilities Board (whose appointed members make rate recommendations to the City Council) and the City Council in a fully transparent, public process that affords all utility customers (and all other members of the public) the opportunity to provide comments. Further, each year the City Council adopts a budget that is also fully transparent, is discussed thoroughly over multiple meetings, includes the transfer amounts for each municipally owned utility, and is an additional opportunity for utility customers to have their comments heard by their elected officials. As the Senate Business and Commerce Committee considers many bills relating to utilities, and MOUs in particular, we encourage the committee members to consider the ratepayer protections already in place, the transparent nature of the MOU rate-setting process, and that existing transfers ensure rates to account for the full cost of a utility’s service.
