April 7, 2023 Report No. 2023-032 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: State Legislative Update BACKGROUND: Over 8,000 separate pieces of legislation have been filed for consideration by the 88th Session of the Texas Legislature. This record-breaking tally includes over 1,500 bills impacting cities. Staff, along with its legislative consultants, assess the impacts of legislation on the City of Denton, communicate these impacts to legislators, and, in some cases, prepare for and provide written or verbal testimony to legislative bodies. A report of the bills currently being tracked by the City is attached. Additionally, the Texas Municipal League also publishes detailed descriptions of bills on its website. Nearing 90 days into the 140-day session, a significant number of committee hearings are being held on the impressive number of bills. If a bill is voted favorably out of committee, it will then be scheduled to be voted on by the entire chamber, e.g., the Senate, before being similarly considered in the other chamber of the legislature, e.g., the House. DISCUSSION: Numerous bills that would negatively impact the City of Denton and other municipalities were heard in committee over the past two weeks. In addition to communicating the concerning impacts of these bills to individual legislators, the City of Denton registered formal opposition to the following bills: H.B. 2789 Would pre-empt the City’s ability to regulate accessory dwelling units, without consideration for zoning regulations or neighborhood character. Additionally, the city could not regulate the selling or renting of accessory dwelling units. H.B. 2561 Would require an election to be held November 7, 2023, on the question of disannexation of any area that was annexed by a city between March 3, 2015, and May 24, 2019. This blanket unfunded mandate would impose an election without full consideration of the effects of disannexation on affected residents. H.B. 2367 Would authorize and prevent the City from prohibiting or limiting “residential amenity rentals”, whereby a part of a residential property (such as a swimming pool) may be rented for a period of up to 15 hours. The chief concern with this bill being the lack of local regulation of substantial commercial activity in residential areas. H.B. 1707 Would compel the City to consider open-enrollment charter schools no different than school districts for the purposes of zoning, permitting, platting, subdivision, construction, and land development regulation. April 7, 2023 Report No. 2023-032 H.B. 1204 H.B. 1279 Would greatly reduce the extent of and current level of authority within the City’s extraterritorial jurisdiction. H.B. 1489 H.B. 4082 Would greatly reduce the projects that are eligible to be funded by Certificates of Obligation, potentially delaying and increasing the cost of critical debt-funded projects. Qualified Hotel Project The City’s Qualified Hotel Project Bill (H.B. 2321), which would grant Denton the ability to use the Qualified Hotel Project economic development tool, was laid out for discussion in a House Ways and Means Committee hearing on Monday, April 3. Economic Development Director Wayne Emerson testified in support of the bill, highlighting the ability of the Qualified Hotel Project bill to positively impact the local and state economy. Like most bills, H.B. 2321 was left pending, but is expected to return for a vote by the Committee. Electric Utility Update This week, DME staff met with the following legislators regarding the suite of electric bills pending before the Legislature: • Senator Johnson, Senate Committee on Business and Commerce • Senator Menendez, Senate Committee on Business and Commerce • Senator Springer, Senate District 30 (93% City of Denton / 51% Denton County) • Senator Parker, Senate District 12 (7% City of Denton / 49% Denton County) • Chairman Hunter, House Committee on State Affairs • Rep. Anchia, House Committee on State Affairs • Rep. Stucky, House District 64 (76% City of Denton / 14% Denton County) • Kory Curtis, Policy Advisor, Office of the Speaker • Jarred Shaffer, Policy Advisor, Office of the Governor • Will McAdams, Commissioner, Public Utility Commission of Texas DME staff previously submitted comments to the above-mentioned offices regarding S.B. 6, S.B. 7, and S.B. 2012. The City’s suggested language changes to amend these bills were not accepted by the Senate; however, minor changes to somewhat improve S.B. 7 and S.B. 2012 did occur on the Senate Floor. All three of those bills passed the Senate. The City does not support any of these bills in their current form and has been told those bills will be heard in the House Committee on State Affairs during the 3rd week of April. DME staff have already started offering language changes to House leaders to improve those bills so that they do not discriminate against DME customers due to our reliance on renewable energy. A recent Texas Energy and Power Newsletter article summarizes the suite of electric-related bills passing through the Senate this week. CONCLUSION: Staff and the City’s legislative consultants are actively implementing the Council’s legislative policy as outlined in the 2023-2024 Legislative Program.
