Northeast Denton Area Plan Workshops – As work continues to move forward on the Northeast Denton Area Plan, two joint workshops have been scheduled for the following dates: • Tuesday, August 1, 2023, from 11 a.m. to 1 p.m. (lunch provided) with the Northeast Denton Area Plan Steering Committee, Planning and Zoning Commission, and City Council. At this joint workshop, the project team will discuss draft recommendations for the Northeast Denton Area Plan. • Tuesday, October 17, 2023, from 11 a.m. to 1 p.m. (lunch provided) with the Planning and Zoning Commission and City Council. At this joint workshop, the project team will present the draft Final Plan document. Please note: following this joint workshop, there will be work sessions with both the Planning and Zoning Commission and City Council, a Planning and Zoning Commission public hearing for a recommendation to City Council, and City Council public hearing for adoption of the Plan. Loop 288 Denton Community Shelter Update – Community Services staff is onsite two days per week at the Loop 288 shelter to assist and provide support to Our Daily Bread by gathering and evaluating data, building security, and processes for providing services. The following are updates to shelter operations that have occurred over the last 2-3 weeks: • Community Services and Our Daily Bread staff met with Texas Homeless Network, the lead agency for the Balance of State Continuum of Care, and created a plan for monthly reporting data to be pulled directly from the Homeless Management Information System (HMIS), the centralized system used at homeless service provider agencies county-wide. • Our Daily Bread ID cards/barcodes will be utilized for shelter check-in, decreasing the amount of time individuals will wait to check in to the shelter. • Our Daily Bread head of security is hiring additional security during the day and evening shifts. • Case manager office space has been set up at the entrance area to provide intakes at the time of entry to the shelter, reducing the length of time between shelter entry and intake completion. Staff will continue to spend time at the shelter weekly to support Our Daily Bread in the efforts to increase program efficiency and provide updates to Council. Presenting to LaGrone Academy Students – Kendra Williams, Talent Acquisition Partner, and Daniel Parish, Water Superintendent, presented to students of LaGrone Academy on April 6 and 7 promoting both seasonal and full-time career opportunities with the City. The assemblies were a great success reaching approximately 1,500 students. Staff looks 2 forward to expanding the partnership with Denton ISD. Denton Municipal Electric (DME) Excellence in Reliability Award – DME is proud to announce it has been awarded the American Public Power Association’s (APPA) Excellence in Reliability Award. This marks the fifth year in a row that DME has received this recognition. The Excellence in Reliability designation is given to electric utilities that participate in APPA’s eReliability program and are amongst the top 25% quartile of electric utilities in the nation. American Kestrel Falcon Nesting Box – In collaboration with the University of North Texas (UNT) Texas Department of Biological Sciences, DME recently agreed to install a temporary nesting box on a utility pole. The American Kestrel Falcon, also known as the Sparrow Hawk, is the smallest and most common falcon in North America. The Kestrel is of conservation concern due to the the continental population decline seen over the past five decades. James Bednarz, UNT Principal Lecturer in the Department of Biological Sciences, contacted DME recently asking for assistance to recapture a tagged falcon whose tracker has malfunctioned. The data included in the tracker is critical to their research on the migration and wintering ecology of the falcon which is poorly known. Once the falcon is captured, UNT will download the data from the tracker and make sure the tracker is working properly. To assist UNT, DME installed a “Kestrel Nesting Box” on a distribution pole in an area the subject falcon is known to inhabit. The nesting box will allow UNT to recapture the falcon, correct the issue with the tracker, and gain insight into the falcon’s behavior patterns. Street Construction on Crescent – On March 30, Mayor Pro Tem Beck shared a resident’s request regarding the status of the construction on Crescent Street. The Crescent Street reconstruction is part of the Denton Street Rehabilitation Project. Staff emailed the resident directly to provide a status update including the current estimated completion date of April 12, 2023, weather permitting. Staff contact: Dustin Draper, Capital Projects B. Emerson and Foxcroft Water Concerns – On March 30, Mayor Pro Tem Beck and the City Manager’s Office received an email from a resident regarding water leaking under the roadway at the intersection of Foxcroft Circle and Emerson Lane. Staff collected water samples this week to check for the source of the water and is awaiting the results. Depending on the results of the water testing, potential solutions will be reviewed to address the concern. Staff contact: Brett Bourgeois, Engineering C. Wildlife Impacts at Tennis Courts – On March 31, Mayor Pro Tem Beck inquired about wildlife impacts at the Tennis Center project. Animal Services staff verified the City has received one wildlife call within the last year for the area surrounding the new Tennis Center. This singular call was on March 31 from the City’s contractor, reporting they discovered infant rabbits. They reached out to Animal Services for assistance. Currently, construction contracts do not specifically call out wildlife mitigation, however, staff will look into incorporating contact information if wildlife is onsite. Tree Trimming Concerns in Sequoia Park – On April 3, Council Member Byrd shared an inquiry from a citizen regarding the City’s contracted tree trimmers operating in the Sequoia Park neighborhood. The contractors’ work is in accordance with DME’s Vegetation Management Program. The objectives of this program are to provide a safe system environment and to minimize tree-related outages caused by high winds, snow and ice storms, and trees losing their branches from disease or old age. While trimming trees, the contractors are always observant of nesting birds. In the event of discovering a nest of a migratory bird or bird of prey, including owl, hawk, falcon, and eagle, Texas Parks and Wildlife is contacted for guidance. If the nest is determined to be active, it will not be disturbed, and no trimming will be done within six feet of the nest that Staff contact: Chris Lutrick, DME E. Handicapped Parking Spaces and Striping – On April 3, Council Member Watts and the City Manager’s Office received an email from a resident concerned about the striping of handicapped parking spaces on the downtown Square. The resident identified the hatched striping of the access aisles was white instead of blue, causing confusion about the use of the space. Upon review, staff agreed the striping should be repainted to the standard blue color associated with handicapped spaces. Traffic Operations repainted the access aisles on the Square on Thursday, April 6. Staff contact: Ethan Cox, Public Works F. Electric Capital Budget Amendment – During the April 4, 2023, City Council meeting, Mayor Pro Tem Beck asked DME staff about the impact of rooftop solar on diminishing and mitigating operational and infrastructure costs due to less load or less need for substations. After further evaluation, the larger deployment of rooftop solar would not result in diminishing and mitigating operational and infrastructure costs. DME has a responsibility to provide sufficient infrastructure and electric power to customers at all 4 times – including at night and any other time that a customer’s rooftop solar is not producing energy. Consequently, DME must design substations and distribution facilities to meet the demand during such times. Electric utilities are projecting a significant demand increase associated with electric vehicles and the replacement of gas appliances with electric to address climate change during our planning horizon. These factors, coupled with the electric demand growth being experienced in Denton, are the basis for DME’s capital improvement budgets submitted to Council. Staff contact: Jerry Fielder, DME G. Update on Brookhollow Drive – On April 4, Council Member Davis requested an update on the progress and timeline for construction on Brookhollow Drive. Utility installations on Brookhollow were completed, with no additional utility installations on the opposite side of the roadway. Roadway reconstruction on Brookhollow is scheduled to start in mid- April with completion in mid-May, weather permitting. The comprehensive project, 2020 Street Bundle Sector III, is scheduled to be completed in Q3 of 2023. Staff contact: Scott Fettig, Capital Projects H. Goldfield Tennis Center Inquiry – On April 4, Council Member Davis inquired about the potential plans for Goldfield Tennis Center after the new tennis complex is completed. The eastern tennis court space will be preserved for any future growth related to the North Lakes Recreation Center. Staff is currently exploring options to change some of the courts into a sand volleyball complex, futsal, basketball, and/or fitness courts. Staff contact Gary Packan, Parks & Recreation I. Windsor Drive Sinking Sidewalk – On April 4, Council Member Davis shared reports of a sinking sidewalk on Windsor Dr., directly behind Brooklake St. According to the resident, the sidewalk has sunken approximately six inches, which causes water to pool. Staff performed a site visit and is coordinating with the contractor to schedule a repair. Staff contact: Ethan Cox, Public Works J. Work on North Texas Blvd at I35E Frontage Road – On April 4, Council Member Davis asked for a schedule completion update on the North Texas Blvd project at I35E. Staff currently anticipates completion on April 28, weather permitting. Staff contact: Trevor Crain, Capital Projects K. Bronco Way Connection – On April 4, Council Member Davis asked for a schedule completion update on the temporary connection between Bronco Way and E/W Westgate Drive. The project will be advertised for bid next week. Staff anticipates a construction contract being presented to Council for consideration in June 2023 and completion by November 2023. Local Business’ Roof Leak – On April 4, Council Member McGee requested an update on a local business experiencing a roof leak with the property they lease. Staff followed up with the business owner who advised they have not experienced any more leaks after the recent rains. Community Services staff will follow up to determine potential next steps on repairs needed. Staff contact: Monica Benavides, City Manager’s Office M. Avondale Eroding Embankment – On April 5, Mayor Pro Tem Beck inquired on the next steps for the eroding embankment at Avondale Park. Parks and Recreation staff advised of a recent update on the consultant’s study regarding the erosion. Staff plan to have a public meeting within the next month to present options to the community and discuss the overall 5 project. Staff is also working to identify funding. Easter Eggstravaganza – Parks and Recreation will host its annual Easter Eggstravaganza and Egg Hunt on Saturday, April 8 from 9 a.m. to noon. The family-friendly event will feature bounce houses, food trucks, arts and crafts, face painting, balloon twisting, a petting zoo, free photos with the Easter Bunny, and over 40,000 eggs! The egg hunts are staggered and categorized by age groups (ages 0-10) and are scheduled at various times throughout the event. This year’s event will feature a sensory hour and sensory-friendly egg hunt which includes reduced noise and lights and allows for a slower-paced egg hunt for every bunny to enjoy! Hop on out and do not forget your favorite basket for the hunt! This free event is hosted at the Denton Civic Center and Quakertown Park (321 E. McKinney St.). College and Career Fair – The Martin Luther King, Jr. Recreation Center (1300 Wilson St.) is hosting a College and Career Fair on April 8 from 10 a.m. to noon. The fair provides attendees with an opportunity to learn from local employers, community organizations, and colleges. Learn how to navigate the process of applying for college using the Texas Common Application and discover possible funding avenues through Free Application for Federal Student Aid (FAFSA). Northwest Water Transmission Main Improvement Project Public Meeting – On Monday, April 10 at 6:00 pm, at the MLK Jr. Recreational Center (1300 Wilson St.), Capital Projects is hosting a community meeting for northwest Denton residents potentially affected by the upcoming utility installation project. The Northwest Water Transmission Main Project will consist of the construction of nearly two miles of 36-inch water main along the designated project alignment. Along the way, the water main will connect to smaller diameter water lines of 30-inch, 24-inch, 16-inch, 12-inch and 8-inch. Most of the work is occurring in permanent and temporary easements which the City of Denton has secured. Neighborhoods near the work areas may experience temporary interruptions when the contractor ties-in to the existing water system but will be notified in advance of the construction. The meeting will provide residents with an overview of the project’s scope and schedule as well as what to expect during construction. Staff contact: Jesus Perez, Capital Projects D. Parks and Recreation Hiring Fair – The Parks and Recreation Department is hiring! To learn more, speak to departmental staff, and apply/interview on-site, visit the Denton Civic Center (321 E. McKinney) on April 12 from 4 p.m. to 7 p.m. Parks and Recreation is looking to fill permanent and seasonal positions, many of which offer work schedule flexibility. Night Hike at Clear Creek – Join Parks and Recreation staff on a delightful night hike through the beautiful trails of Clear Creak Natural Heritage Center (3310 Collins Rd.) on April 13 from 6 p.m. to 8 p.m. The hike is available to individuals 12 and older with a waiver signed by a parent/guardian. Registration is required and the event is $5 to attend. 6 If you cannot make the event on April 13, staff will host another Night Hike on May 19. Register for both events online. Windsor Dr.) will be hosting a Food N’ Fun Friday every second Friday of the month beginning April 14. The event will feature local food truck vendors attendees can purchase food and beverages from, and, for $20, participants can also enjoy all-you-can-hit driving range fun with unlimited golf balls. Pickleball Social – If you’ve ever been curious to learn more about pickleball, or if you’re a seasoned player looking to meet new players, Park and Recreation encourages you to attend the Pickleball Social! Join us on Friday, April 14 at South Lakes Park (556 Hobson Ln.) from 6:30 p.m. to 8:30 p.m. The event is free to attend and children five and older can join in, although registration is required online. Staff contact, Rachael Burks H. Adapted Recreation Dance – North Lake Recreation Center (2001 W. Windsor Drive) will host this month’s Adapted Recreation dance on April 14. The theme is Friends and Flowers! The event requires registration and costs $5 per person to attend, but free for attendees with a Recreation Pass. Movie in the Jurassic Park – Quakertown Park (700 Oakland Street) will host a screening of the original Jurassic Park blockbuster (PG13, 1993) on April 14. Dinosaurs, bounce houses, and lawn games will be at the park starting at 7 p.m., with the movie beginning at 8 p.m. Feel free to bring blankets or lawn chairs to sit on while enjoying the film. Garden Workdays at Denia Wildflower Garden — Join Keep Denton Beautiful for monthly garden workdays at the Denia Wildflower Garden, located in front of Denia Recreation Center (1001 Parvin St.). Get ready to dig in the dirt and learn proper garden maintenance techniques with our garden experts. Tasks vary but frequently involve weeding, cutting back plants, and picking up plant debris and litter. The volunteer opportunity is free to attend but does require registration online. Preschool in Nature at Clear Creek – Explore nature and the great outdoors with pre-school friendly activities including a short hike, nature story, and nature-themed art. Preschool in Nature will take place on April 15 from 10 a.m. to noon at Clear Creek Natural Heritage Center (3310 Collins St.). The event is free to attend for preschool-aged children, but does require registration online. Staff contact: Carin Zeman, Parks and Recreation L. Golf Scramble – Denton Parks and Recreation will host a Golf Scramble on April 18 from 5:00 p.m. to 8:00 p.m. at Wildhorse Golf Club at Robson Ranch (9448 Ed Robson Cir.). A scramble is one of the most common formats for a golf tournament and involves a team of two players. The team chooses the best shot from the first stroke and uses the same spot for each player. After the second stroke, the team again chooses their best shot and continues in the same manner until all holes are completed. The cost for registration is $30 per paired team, with only one team member needing to register per twosome. There is also an additional $14 per person green fee charged by the Wildhorse Golf Club upon check- in. Registration is available online. Staff contact: Kelsey Stuart, Parks and Recreation 7 M. Kids Rock: The Return – Kids Rock has returned, and young Denton residents are having a blast! Each month, kids enjoy a night out while parents enjoy the night off. The program runs from 7 p.m. to 11 p.m. Experienced staff plan each month around a uniq ue theme, then create play stations that include games and activities, mini-sports tournaments, unique inflatable fun, ping-pong, video games on a large screen, and a DJ with dance contests! Two slices of pizza and a drink are included for attendees. Staff also sell additional concessions and glow products. Preregistration is required and can be completed online. The cost is $25 per child, with a $5 late fee if registering the day of, after 5 p.m., with an upcoming program on April 21 at the Denton Civic Center (321 E. McKinney). Asian Pacific American Heritage Month – MLK Jr. Recreation Center (1300 Wilson St.) will celebrate the cultural contributions of Asian and Asian Pacific Americans on April 22 from 1:00 p.m. to 3:00 p.m. The event appreciates the history and heritage of individuals who came to America from continental Asia as well as the Pacific Island regions of Melanesia, Micronesia, and Polynesia. This event features guest speaker Dr. Michael Raisinghani, Professor of Business and Economics at Texas Woman’s University’s College of Business and Executive MBA program. The dashboards are intended to give a snapshot of relevant DEC metrics. This resulted in approximately $324,000 less revenue and $303,000 less in total expenditures than for the same time period last fiscal year. The DEC Gross Margin as of October 31 was $1.39 million which is $220,000 higher than budgeted (Gross Margin = DEC Revenue –Fuel Cost –Variable Operating & Maintenance Cost). At this point in the fiscal year, the FY 2022-23 year-end projections are equal to the FY 2022-23 budget. This resulted in approximately $794,000 less revenue and $142,000 more in total expenditures than for the same time period last fiscal year. The DEC Gross Margin as of November 30 was $2.33 million which is $674,000 higher than budgeted (Gross Margin = DEC Revenue –Fuel Cost –Variable Operating & Maintenance Cost). At this point in the fiscal year, the FY 2022-23 year-end projections are equal to the FY 2022-23 budget. This record-breaking tally includes over 1,500 bills impacting cities. Staff, along with its legislative consultants, assess the impacts of legislation on the City of Denton, communicate these impacts to legislators, and, in some cases, prepare for and provide written or verbal testimony to legislative bodies. A report of the bills currently being tracked by the City is attached. Additionally, the Texas Municipal League also publishes detailed descriptions of bills on its website. Nearing 90 days into the 140-day session, a significant number of committee hearings are being held on the impressive number of bills. If a bill is voted favorably out of committee, it will then be scheduled to be voted on by the entire chamber, e.g., the Senate, before being similarly considered in the other chamber of the legislature, e.g., the House. DISCUSSION: Numerous bills that would negatively impact the City of Denton and other municipalities were heard in committee over the past two weeks. In addition to communicating the concerning impacts of these bills to individual legislators, the City of Denton registered formal opposition to the following bills: H.B. 2789 Would pre-empt the City’s ability to regulate accessory dwelling units, without consideration for zoning regulations or neighborhood character. Additionally, the city could not regulate the selling or renting of accessory dwelling units. H.B. 2561 Would require an election to be held November 7, 2023, on the question of disannexation of any area that was annexed by a city between March 3, 2015, and May 24, 2019. This blanket unfunded mandate would impose an election without full consideration of the effects of disannexation on affected residents. H.B. 2367 Would authorize and prevent the City from prohibiting or limiting “residential amenity rentals”, whereby a part of a residential property (such as a swimming pool) may be rented for a period of up to 15 hours. The chief concern with this bill being the lack of local regulation of substantial commercial activity in residential areas. H.B. 1707 Would compel the City to consider open-enrollment charter schools no different than school districts for the purposes of zoning, permitting, platting, subdivision, construction, and land development regulation. 14 April 7, 2023 Report No. 2023-032 H.B. 1204 H.B. 1279 Would greatly reduce the extent of and current level of authority within the City’s extraterritorial jurisdiction. H.B. 1489 H.B. 4082 Would greatly reduce the projects that are eligible to be funded by Certificates of Obligation, potentially delaying and increasing the cost of critical debt-funded projects. Qualified Hotel Project The City’s Qualified Hotel Project Bill (H.B. 2321), which would grant Denton the ability to use the Qualified Hotel Project economic development tool, was laid out for discussion in a House Ways and Means Committee hearing on Monday, April 3. Economic Development Director Wayne Emerson testified in support of the bill, highlighting the ability of the Qualified Hotel Project bill to positively impact the local and state economy. Like most bills, H.B. 2321 was left pending, but is expected to return for a vote by the Committee. Electric Utility Update This week, DME staff met with the following legislators regarding the suite of electric bills pending before the Legislature: • Senator Johnson, Senate Committee on Business and Commerce • Senator Menendez, Senate Committee on Business and Commerce • Senator Springer, Senate District 30 (93% City of Denton / 51% Denton County) • Senator Parker, Senate District 12 (7% City of Denton / 49% Denton County) • Chairman Hunter, House Committee on State Affairs • Rep. Anchia, House Committee on State Affairs • Rep. Stucky, House District 64 (76% City of Denton / 14% Denton County) • Kory Curtis, Policy Advisor, Office of the Speaker • Jarred Shaffer, Policy Advisor, Office of the Governor • Will McAdams, Commissioner, Public Utility Commission of Texas DME staff previously submitted comments to the above-mentioned offices regarding S.B. 6, S.B. 7, and S.B. 2012. The City’s suggested language changes to amend these bills were not accepted by the Senate; however, minor changes to somewhat improve S.B. 7 and S.B. 2012 did occur on the Senate Floor. All three of those bills passed the Senate. The City does not support any of these bills in their current form and has been told those bills will be heard in the House Committee on State Affairs during the 3rd week of April. DME staff have already started offering language changes to House leaders to improve those bills so that they do not discriminate against DME customers due to our reliance on renewable energy. A recent Texas Energy and Power Newsletter article summarizes the suite of electric-related bills passing through the Senate this week. CONCLUSION: Staff and the City’s legislative consultants are actively implementing the Council’s legislative policy as outlined in the 2023-2024 Legislative Program.
