STANDARD NOTES.
1. Selling off a portion of this addition by metes and bounds description without a replat being approved by the City of
Carrollton is a violation of city ordinance and state low is subject to fines and withholding of utilities and building
2. All comers are 1/2 inch iron rod with yellow plastic caps stamped *SPIARSENC" unless otherwise noted.
3. According to the flood study performed for AUS11N WATERS, by the engineering department of Nathan D. Maier
Consulting Engineers, Inc., no 100 Year Flood Boundary exists on the residential lots.
4. The owner of fee simple title to every Individual lot of land within the subdivision must be a member of the Home
Owners Association.
5. The Home Owner Association must have the authority to collect membership fees.
6. An HOA will be required to maintain all Open Space, Common Areas, and Screening Walls.
7. The Home Owners Association must grant the city right of access to common areas to abate any nuisances thereon,
and attach a lien for the prorated cost of abatement upon each individual lot.
8. The Home Owners Association shall indemnify and hold the city harmless from any and all costs, expenses, suits,
demands, liabilities, damages, or otherwise including attorneys fees and costs of suit, in connection with the citis
maintenance of common areas.
9. According to the City of Carrollton Storm Water and Rood Protection Ordinance, a Home Owners Association will be
formed and shall assume the. maintenance responsibilities for areas dedicated as Drainage Easements. The Home
Owners Association shall enter into a perpetual maintenance agreement with the City of Carrollton.
10. The Home Owners Association shall enter into a license agreement with the City of Carrollton, where additional
right—of—way has been dedicated for the purpose of providing landscaping, additional areas for sidewalks, walls, or
other amenities, and shall be responsible for the installation and maintenance of all landscape areas that are in the
public eight —of way.
11. GPS Coordinates are rectified to NAD 83 State Plane Coordinate System North Central Texas Zone 4202 (feet).
12. Any landscaping/foliage on the medians inside the property must be placed in a manner that maintains the required
visibility triangles for traffic.
13. The owner ordeveloper of property to be developed shall be responsible for all storm drainage flowing through or
abutting such property. This responsibility also includes drainage directed to that property by ultimate development
as well as the drainage naturally flowing through the property by reason of topography. The property owner should
provide an adequate storm drainage system to handle anticipated upstream runoff.
14- All easements and right—of—way dedicated by The Final Plat of Austin Waters Phase 1, as recorded in Denton
County Cob. X, Pg. 795, unless otherwise noted on the face of this plot.
15. Intersection visibility triangles shall have the dimensions specified in section 53.40 et seq of the Carrollton Code of
Ordinances.

And the City of Carrollton or any public utility shall at all times have the right of ingress and egress to and from and upon
any of said easements for the purpose of constructing, reconstructing, inspecting, patrolling, maintaining, and adding to or
removing all or port of its respective system without the necessity at any time of procuring the permission of anyone.
