WHEREAS NORTH TEXAS CONTRACTING, INC. is the sole owner of a 58.727 acre tract of land located in
the C. Manchaca Survey, Abstract No. 789, Denton County, Texas, said 58.727 acre tract of land being all
of a called 58.73 acre tract of land conveyed to NORTH TEXAS CONTRACTING, INC., by deed thereof
filed for record in Denton County Clerk's Instrument No. 2023-96914, Official Public Records, Denton
County, Texas (O.P.R.D.C.T.), said 58.727 acre tract of land being more particularly described by metes
and bounds as follows:
BEGINNING at a 5/8 inch iron rod found (Controlling Monument) at the southeast property corner of
the said 58.73 acre tract, same being a southwest property corner that certain tract of land conveyed to
John W. Wilcher, by deed thereof filed for record in Denton County Clerk's Instrument No. 2012-33172,
O.P.R.D.C.T., said beginning point also being on the existing north right-of-way line of Farm to Market
Highway No. 2449 (being a variable width public right-of-way);
THENCE South 89.49'46" West, along the south property line of the said 58.73 acre tract and along the
said north right-of-way line, a distance of 720.13 feet to a railroad spike found (Controlling Monument)
at the southwest property corner of the said 58.73 acre tract;
THENCE North 00"05'22" West, along the west property line of the said 58.73 acre tract, at a distance of
22.50 feet passing the southeast lot corner of Lot 1, Block A, Hicks Addition, being an Addition to
Denton County, Texas, according to the plat thereof filed for record in Denton County Clerk's
Instrument No. 2013-270, O.P.R.D.C.T., and continuing along the said west property line and the east lot
line of said Lot 1, at a distance of 978.44 feet passing the northeast lot corner of said Lot 1, same being
the most easterly southeast property corner of a called 56.20 acre tract of land conveyed to Mark Hicks
Investments, LLC, by deed thereof filed for record in Denton County Clerk's Instrument No.
2016-104080, O.P.R.D.C.T., and continuing along the said west property line and the east property line
of the said 56.20 acre tract, at a distance of 3,341.28 feet passing the most easterly northeast property
corner of the said 56.20 acre tract, same being the a southeast property corner of a called 113.63 acre
tract of land conveyed to 7298 AMYX RD, LLC, by deed thereof filed for record in Denton County Clerk's
Instrument No. 2022-139282, O.P.R.D.C.T., and continuing along the said west property line and along
an east property line of the said 113.63 acre tract, in all a total distance of 3,555.42 feet to a 1/2 inch
iron rod found (Controlling Monument) at the northwest property corner of the said 58.727 acre tract,
same being an interior southeast property corner of the said 113.63 acre tract;
THENCE North 89'56'07" East, along the north property line of the said 58.73 acre and along a south
property line of the said 113.63 acre tract, at a distance of 472.66 feet passing the most easterly
southeast property corner of the said 113.63 acre tract, same being the southwest property corner of a
called 19.00 acre tract of land conveyed to David H Wright, by deed thereof filed for record in Denton
County Clerk's Instrument No. 2018-76772, O.P.R.D.C.T., and continuing along the said north property
line and along the south property line of the said 19.00 acre tract, in all a total distance of 719.14 feet to
a 5/8 inch iron rod found (Controlling Monument) at the northeast property corner of the said 58.73
acre tract, same being the northwest property corner of the aforementioned Witcher tract;
THENCE South 00'06'20" East, along the east property line of the said 58.73 acre tract and along the
west property line of the said Wilcher tract, a distance of 3,554.09 feet to the POINT OF BEGINNING.
The hereinabove described tract of land contains a computed area of 58.727 acres (2,558,129 square
feet) of land, more or less.

1. The bearings and distances shown hereon are referenced to the Texas Coordinate System of 1983,
Texas North Central Zone 4202, and are based on the North American Datum of 1983, 2011
Adjustment. All areas shown hereon are calculated based on surface measurements.

Agency, Department of Homeland Security and by graphic plotting only, the subject property appears
to be located in Zone "X" (areas determined to be outside the 0.2 % annual chance floodplain), as

5. The proposed lot meets the land use standards of the City of Denton for an On -Site Sewer Facility.
Final approval of an On -Site Sewer Facility is subject to review and approval by Denton County.
6. The purpose of this plat is to create an addition to the County of Denton and to obtain building permits
for development.
7. The City of Denton has adopted the NationolElectrical Safety Code (The "Code"). The Code generally
prohibits structures within 17.5 feet on either side of the centerline of overhead distributions lines and
within 37.5 feet on either side of the centerline of overhead transmission lines. in some instances, the
Code requires greater clearances. Building permits will not be issues for structures within these
clearances areas. Contact the building official with specific questions.
8. The City and County, including their agents and employees, have the right of immediate access to the
Common Areas at all times, if necessary, for the welfare or protection of the public, to enforce
City/County ordinances, or to improve the appearance of or to preserve public property, public
easements, or public rights of way. If the Association fails to maintain the Common Areas to a standard
acceptable to the County or City, the County or City may give the Association a written demand for
maintenance. If the Association fails or refuses to perform the maintenance within a reasonable period
of time after receiving the County's/City's written demand (at least 90 days), the County or City may
maintain the Common Areas at the expense of the Association after giving written notice of its intent to
do so to the Association. The County or City may give its notices and demands to any officer, director,
or agent of the Association, or alternatively, to each owner of a Lot as shown on the County's tax rolls.
To fund the County's or City's cost of maintaining the Common Areas, the County or City may levy
assessments against the lots and owners in the same manner as if the Association levied a special
assessment. The rights of the County or City under this Section are in addition to other rights and
remedies provided by law.
