HomeMy WebLinkAbout18-1902 ORDINANCE NO. 18-1902 AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO SIGN AN INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY OF DENTON AND THE UNIVERSITY OF NORTH TEXAS ("UNT") REGARDING TRAFFIC SIGNAL OPERATION DURING UNT SPECIAL EVENTS AND UPGRADES TO TRAFFIC CONTROL SIGNAL EQUIPMENT AT FOUR SPECIFIED INTERSECTIONS (NORTH TEXAS BOULEVARD AT I-35E AND BONNIE BRAE STREET AT I-35E) AT A COST OF $60,000 ($30,000 TO THE CITY AND $30,000 TO UNT); PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the University of North Texas ("UNT") and its Police Department have committed considerable resources to control traffic at various traffic signals along the I-35E Frontage Road for UNT special events; and WHEREAS, the City has agreed to monitor special event traffic with the installation of specialized signal equipment at four identified intersections; and WHEREAS, UNT shall assume fifty percent (50%) of the traffic signal upgrade cost and will pay City technician rates for City personnel utilized at each special event; and WHEREAS, the City and the University of North Texas have agreed that it is necessary to enter into an interlocal agreement to update four existing traffic signals along I-35E Frontage Road to be controlled during special events and provide additional green time for heavy movements; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. ON . The City Manager, or his designee, is hereby authorized to execute an Interlocal Cooperation Agreement for Intersection Upgrades and Traffic Control between the City of Denton and the University of North Texas, a copy of which is attached hereto as Exhibit "A," to upgrade and manage traffic signals at four locations along I-35 E during UNT special events. SECTIO 3. The City Manager, or his designee, is further authorized to carry out all of .......... the duties to be performed by the City under the Agreement, including but not limited to, the expenditure of funds. If any section, subsection, paragraph, sentence, clause, phrase, or word in this ordinance, or application thereof to any person or circumstances, is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton hereby declares it would have enacted such remaining portions despite any such invalidity. SECTION5. This ordinance shall become effective immediately upon its passage and approval. WHEREAS, Denton and UNTdesire to enter into an agreement regarding traffic signal operation during UNT special events and upgrades to traffic control signal equipment at four(4) intersections: North Texas Boulevard at 1-35E(two intersections), and Bonnie Brae at 1-35 (two intersections); and WHEREAS, this Agreement has been authorized by the governing bodies of Denton and UNT; and WHEREAS, the Inter-local Cooperation Act, Chapter 791, Texas Government Code authorizes units of local government to contract with one or more units of local government to perform governmental functions and services; and WHEREAS, it is mutually advantageous to both parties to enter into this Agreement; NOW, THEREFORE, in consideration of the terms and conditions contained herein and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Term. The term of this agreement shall be for one(1)year beginning on the date of execution on the signature page of this Agreement, and shall automatically renew annually on the anniversary of that date for additional one (1) year terms unless either party gives written notice of termination thirty (30)calendar days prior to the expiration of the then-current term. 2. lniers�t'�Ctlon 11�2g'ryeles% A. UNT shall assume 50%of the cost to upgrade the four intersections(see exhibit A). B. Denton shall assume 50%of the cost to upgrade the four intersections. The signal upgrades include installation of new vehicle detection system (Gridsmart)and a Pan-Tilt-Zoom (PTZ) camera(Cohn) at each intersection. The City Traffic Operations Staff will procure and install all signal equipment. The signal upgrade work will be completed within four to six weeks from the execution of this agreement. Once the work is completed, City will send UNT an invoice for 50%of the total cost incurred by the City in upgrading these intersections. If UNT fails to pay the 50%cost of the upgrades within 90 days,this agreement will be terminated and the City will not provide services described in item 4 3 on this agreement. 3. .7raLUe ij))eranon L)�,Lr A. Denton shall monitor and control traffic signal operation at the intersections noted in the agreement. City of Denton staff will operate the traffic signals and change signal timing before and after a special events. B. UNT shall reimburse Denton for providing one(1) city technician for each intersection controlled during UNT special events, at the agreed Upon hourly rate(see exhibit B). The time spent by each technician on a special event shall include both,time spent on the site as well as the travel time required to arrive at the site from the Traffic Operations Building. Also,the typical working hours for Traffic Operations staff is 7:30 ami, to 3:30 p.m. If special events are Outside these working hours,Over Tirne(OT)rate as shown in exhibit B will be applicable. 4. Notices.
