GFOA Award – The City of Denton received the Distinguished Budget Presentation Award from the Government Finance Officers Association (Attachment A), marking the City’s 40th consecutive year earning this honor. This recognition reflects the City’s longstanding commitment to excellence in governmental budgeting and to producing a budget document that functions as a clear policy guide, a sound financial plan, an operational roadmap, and an effective communication tool for our community. This award affirms the City’s- budget is both fiscally responsible and designed to clearly serve the community’s needs. This year’s recognition is especially meaningful, as it highlights the City’s successful transition to a fully digital budget book, enhancing accessibility, usability, and transparency for both the City Council and the public. DTV Video Highlights for March – In addition to producing public meetings, DTV released several videos this month that raise awareness, educate, and inform our community. The following are highlighted videos Council is encouraged to share: • Why Do You Love The Library? At the recent Makers Gonna Make event at the North Branch, we asked young creatives their thoughts on the library. • 41st Annual Texas Storytelling Festival The Texas Storytelling Festival in Denton brings storytellers together for four days of performances, workshops, and community built around the art of storytelling. • Denton Off The Record: Matt Grigsby Our new series, Denton Off The Record, kicks off with Matt Grigsby, sitting in a tree in our very own North Lakes Park, singing "I'd be Happy Then". All videos air on DTV, are shared via social media channels, and are available on the City’s YouTube channel. Staff contact: Billy Matthews, Marketing and Communications 2 C. Mayor’s Pet Spotlight – Lovely Lexa is a 3-year-old, Terrier Pit Bull mix who has been in the shelter since January. She’s a high-energy dog who thrives on activity - perfect for someone who enjoys running or outdoor adventures. Lexa is very dog-friendly and loves to play with toys, making her a great companion for families with other dogs or active individuals. She’s highly food motivated, which makes training sessions both fun and effective. Lexa’s extended stay in the shelter means she’s eager for a loving home where she can burn off her energy and bond with her people. Her playful, affectionate nature and love for exercise make her an ideal foster for anyone looking for a fun and loyal friend. Due to her length of stay and ongoing need for a stable environment, we’re seeking someone who can give Lexa the attention and care she deserves. Tree Clearing on Sherman – On March 30, Council Member Beck inquired about trees being cleared at a church on Sherman Drive. The work being performed consisted of clearing the understory and dead trees as a result of a year-long enforcement case due to encampments on the property and history of a fire on the site. There were no confirmed protected trees removed as part of the clearing process, and no tree mitigation is required at this time. Staff provided direction to the contractor to apply for a clear and grade permit to proceed with the clearing of the understory on the entire site and provided guidance on best practices when clearing to ensure the health and preservation of existing trees. Additionally, staff reminded the contractor that removal of any tree with a diameter at breast height (DBH) greater than six inches requires review and approval of a tree removal application, which was also provided to the contractor. Quiet Zones – On March 28, Council Member Byrd shared an inquiry from a resident regarding an update on establishing quiet zones at railroad crossings. Staff is advancing this work as part of the Mingo/Ruddell 2023 Bond Project. Preliminary engineering agreements with the railroad have been completed, and design is currently at 60% for the full project scope. Once constructed, the project will establish a full Quiet Zone covering the crossings in this corridor, including Mingo, Ruddell, Perkins, Willis, Frame, East University, and McKinney. At this time, the anticipated completion window for the project is late 2028 to early 2029. Staff contact: Seth Garcia, Capital Projects C. Dog Park Safety – On March 30, Council Member Beck inquired about safety in the City’s dog parks. Each dog park has signage outlining rules for park users, dog owners, and handlers, along with additional guidelines posted at the entrances to the off-leash areas. If a patron feels unsafe, or if someone’s behavior leads to an environment that feels unsafe because park rules aren’t being followed, they can call the Parks and Recreation Customer Service number listed on the signage or use 311, which is available 24/7. Emergency situations should be reported to 911. Staff contact: Christine Taylor, City Manager’s Office D. Street Island Trees – On March 30, Council Member Beck shared an inquiry regarding the removal of trees from the street median on Royal Lane by Nette Shultz Park. The trees removed from the median were in declining health. Because the median does not have irrigation at this time, it is not considered an ideal location for replacement trees under current conditions. The current approach is to focus new plantings in locations that support long-term health and survivability. Any future improvements would need to align with maintenance capacity, long-term sustainability, and available funding. Staff contact: Allison Wing, Parks and Recreation 4 E. Herbicide Use at City Parks – On March 30, Council Member Beck shared an inquiry regarding the usage of glyphosate at Nette Shultz Park. The City has not used glyphosate for any purpose since it was banned in 2019. Alternative products are used for weed control. The City’s organic maintenance program is currently a pilot initiative limited to Denia Park and Avondale Park, and there is no formal process at this time for adding additional parks to the program. A scheduled review and potential update of the Integrated Pest Management (IPM) program is planned for later this calendar year. As part of that work, staff will evaluate the overall effectiveness of the organic regimen at Denia and Avondale Parks compared to conventional methods outlined in the IPM manual. This assessment will help inform future decisions about whether and how the organic program could be expanded to additional sites such as Nette Shultz. Tree over Blagg Road – On March 31, Council Member Holland shared an inquiry from a resident regarding a potentially dead tree overhanging Blagg Road. Community Improvement Services staff conducted an initial inspection at the site on Blagg Rd and determined that there were no violations of the property maintenance code. 17-40(d) requires that limbs from trees must be higher than 13.5 vertical feet above a street, which this tree passed the standard of. The City's Tree and Landscape Planner inspected the tree and confirmed it to be a living pecan tree that is older, leaning, and occasionally dropping branches, but not an immediate risk of falling. Because no development is occurring on the site, this situation does not fall under the Denton Development Code as a street tree, and the City has no code requirement compelling removal of a tree in this condition. The property owner does, however, have the right to remove the tree if an ISA-certified arborist completes a Tree Risk Assessment and determines it to be hazardous, and obtains a Tree Removal Permit. Lake Forest Lake – On April 1, Council Member Holland shared an inquiry from a resident regarding the fountain and aerators in the lake at Lake Forest Park. Staff removed the fountain, which could not be salvaged. However, the aerators are in place, and there are no plans to remove them. The Parks and Recreation department intends to keep the pond healthy. The award represents a significant achievement by the entity. It reflects the commitment of the governing body and staff to meeting the highest principles of governmental budgeting. In order to receive the budget award, the entity had to satisfy nationally recognized guidelines for effective budget presentation. These guidelines are designed to assess how well an entity's budget serves as: ▪a policy document ▪a financial plan ▪an operations guide ▪a communications device Budget documents must be rated "proficient" in all four categories, and in the fourteen mandatory criteria within those categories, to receive the award. There are over 1,900 participants in the Budget Awards Program. The most recent Budget Award recipients, along with their corresponding budget documents, are posted quarterly on GFOA's website. Award recipients have pioneered efforts to improve the quality of budgeting and provide an excellent example for other governments throughout North America. Government Finance Officers Association (GFOA) advances excellence in government finance by providing best practices, professional development, resources, and practical research for more than 25,000 members and the communities they serve. 7 Date: April 3, 2026 Report No. 2026-024 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: The transition of Discover Denton to Denton Destination Management and Marketing Organization an independent 501(c)(6) organization. BACKGROUND: On December 17, 2024, City Council approved Ordinance No. 24-2486, authorizing the City Manager to execute a contract with the Denton Chamber of Commerce for the acquisition of the equipment, intellectual property, and other assets of Discover Denton, a line of business under the Denton Chamber of Commerce and the assumption of certain contracts. Since the City’s acquisition, and as part of the council approved long-term plan, Discover Denton has been working towards establishing itself as a stand-alone DMMO starting with the formation of the Discover Denton Advisory Board (“DDAB”). The DDAB met October 29, 2025, and approved the organizational bylaws and voted to appoint an interim executive board. Subsequently, the transition required additional actions including: February 3, 2026: During a City Council Work Session proposed bylaws were presented to City Council for review and feedback. February 17, 2026: City Council approved the initial bylaws (6-0) for the Denton DMMO and signed Resolution 26-0181 authorizing the filing of the Certificate of Formation. February 18, 2026: The Certificate of Formation was officially filed with the State of Texas, subsequent acknowledgement of the filing was received February 20, 2026. March 3, 2026: The Denton DMMO was issued an Employer Identification Number (EIN) by the Internal Revenue Service, establishing itself as a 501(c)(6). March 20, 2026: Kristi Franz, Executive Director of Discover Denton presented an application to the Community Partnership Committee requesting a transfer of the remaining Hotel Occupancy Tax (HOT) funding for Calendar Year 2025-26. The committee reviewed and provided direction to award Hotel Occupancy Tax (HOT) funds to the Denton DMMO for Program Year 2026, excluding the portion retained by the City to cover costs for Discover Denton and related activities. DISCUSSION: With the legal formation of the Denton DMMO complete, the next phase in transitioning the organization to an independent entity is the execution of an Acquisition Agreement and an Intellectual Property Licensing Agreement between the City and the Denton DMMO. These agreements will address: 8 Date: April 3, 2026 Report No. 2026-024 Lease Assignment: The City will agree to execute a subsequent transfer of the current lease for the Visitor Center space, located at 111 W. Hickory Street, from the City of Denton to Denton DMMO. Asset Transfers: Transferring all inventory, tangible personal property, contracts, permits, rights and warranties to the extent necessary for the continued operation of Discover Denton. Facility Usage: The DMMO will establish a formal lease agreement with the City for the office space currently occupied by Discover Denton within the Development Services Center. Intellectual Property: By executing the Acquisition Agreement, the City and the Denton DMMO will agree to the form of an Intellectual Property License Agreement that will grant a license to the Denton DMMO for the use of the Discover Denton brand and related intellectual property. The Acquisition Agreement will establish a closing period ending on May 8, 2026. During the closing period, the necessary contract assignments, lease agreements, and other documents required to formalize the component parts of the transition will be executed by the City and the DMMO. CONCLUSION: The Denton Destination Management and Marketing Organization has successfully met the requirements to operate as an independent entity. City staff requests Council authorization for the Interim City Manager, or their designee, to execute the Discover Denton Acquisition Agreement; the Discover Denton Intellectual Property License Agreement; and any related documents or instruments necessary to complete the organization’s transition to full operational independence.
