General Information & Status Updates
A.GreenSense Incentive Program Update – Incentives for energy efficiency upgrades, electric
vehicles, e-bikes, and electric lawn equipment have been widely utilized this year. The
GreenSense incentive program, funded by Denton Municipal Electric (DME), will be fully
expended by Aug. 20 and applications will be held over to next program year to be
processed if funding is allocated in the Fiscal Year 2027 budget.
Electric vehicle, e-bike, and electric lawn equipment incentives are funded by the
Sustainability Framework Fund and budget line items are nearing overall estimated
amounts. The Sustainably Framework Fund will allow rebates to continue without
disruption and remain under overall fund budget.

B.Traffic Signal Installations – The Traffic Operations team is completing the installation of
new traffic signals at two locations this month. The first is at the intersection of Lakeview
Boulevard and Shady Shores Road and brought it into full operation on Aug. 6. This signal
build was completed in-house and addresses the long-pending request for residents’ delay
and congestion issues, and safe operations for pedestrians, bikers, and motorists in the area.
The second new traffic signal is at the intersection of Teasley Lane (FM 2181) and Hunter
Creek Road. The signal will be operational by end of August. This signal build was
completed in-house and addresses the immediate safety need for the area for residents,
proposed new Denton Fire station and overall safe operations for pedestrians and motorists
in the area. With the in-house signal builds, the traffic operations team is saving
approximately $150k-$200k in construction costs at these locations. Staff contact: James

C.Inclement Weather Shelter – From July 30 through Aug. 5, the Inclement Weather Shelter
at the Denton Community Shelter (909 N. Loop 288) was opened seven times by Our Daily
Bread. The inclement weather shelter is opened in accordance with the City’s Use of
Facilities for Inclement Weather Policy to provide overnight cooling for individuals when
there is a Major HeatRisk, representing a major risk of heat-related impacts affecting all
individuals without proper hydration and adequate cooling. The table below details the
shelter’s utilization and capacity through this period and attached is the Denton County
Public Health Heat-Related Illness Surveillance Report for the week of July 26 through
Aug. 1. Additional information on shelter and weather resources, including instructions on
how to sign up for inclement weather alerts, can be found on the City’s website. Staff

D.Mayor’s Pet Spotlight – Meet Freddie, a sweet 5-year-old, 60-pound Husky mix ready to
find her forever family! While she can be a little shy at first, Freddie has blossomed with
the help of our shelter team and volunteers. Once she warms up, she’s all about cozy
snuggles and loves being brushed. Freddie is already crate- and potty-trained, which makes
moving into a new home a breeze. Her previous owner also shared that she does great with
cats and other dogs. She’s an easygoing, affectionate girl who would make a wonderful

Responses to Council Member Requests for Information
A.Process to Dissolve an HOA – On July 24, Council Member Rumohr shared an inquiry
from a resident about potentially dissolving a Homeowner’s Association (HOA). The
process to dissolve an HOA would be complex and would depend largely on what property
the HOA owns and maintains within the subdivision. Much of the process would be a civil
matter the City would not be party to, but if an HOA's property ownership and any
responsibilities or rights of the City to access and maintain those properties are established
through the platting process, the City could have some involvement. Under Denton
Development Code Sections 8.3.2D and 8.3.6J, an HOA may not be dissolved without
prior written consent of the Planning and Zoning Commission by way of authorizing a plat
amendment. This is not a process the City has utilized previously, and it would be very
subdivision-specific, so research into the platting and formation would be required. This
research and any specific process guidance would involve multiple departments, but as an
initial point of contact, residents can contact the Planning Division of Development

B.Food Truck Location Policy – On August 3, Council Member Ferrie shared an inquiry from
a resident regarding enforcement of rules for a specific food truck business about proximity
to other buildings. In this case, the fire inspections performed were not complaint-driven.
During a routine food truck inspection, the Fire Inspector notified the owner that they
needed to maintain 10’ from the adjacent building, as regulated by the 2021 IFC Section
503.1.1 as well as NFPA 96 Section 7.8.2. On a later date, as the Fire Inspector drove past
the location, they observed the food truck had moved closer to the building and stopped to
discuss the issue, but no one was at the food truck. To gain compliance, they spoke to the
tenants of the automotive business where the food truck was parked and let them know the
food truck could not be parked within 10’ of the building.
The Fire Department has been working on educating food truck owners about the fire safety
code requirements and has not taken any enforcement action against them. Instead, they
have been working with food truck owners to gain compliance through education. On July
1, House Bill 2844 went into effect, establishing a statewide licensing and regulatory
framework for mobile food vendors administered by the Texas Department of State Health
Services. The bill preempts local municipalities from health permitting rules but allows the
authority having jurisdiction to retain control over fire, zoning, parking codes, and location-

INFORMAL STAFF REPORT

SUBJECT:
UPDATE - City Surplus Real Property Sale (Planned for Q4 2026)
EXECUTIVE SUMMARY:
This report provides an update following the March 3, 2026 Work Session presentation on
preparations for the planned sale of City-owned surplus real property. The sealed bid sale is
tentatively scheduled for the fourth quarter of 2026. Staff continue to finalize public-facing
materials, modernize sealed bid procedures, and coordinate interdepartmentally to ensure a
transparent and efficient sale process.
BACKGROUND:
The opportunity to identify City surplus real property for potential sale was discussed as part of
the 2025 Budget Task Force. Additionally, implementing a regular review and assessment of the
City’s real property inventory was one of the recommendations made by Matrix Consulting
Group’s operational assessment of the City’s Real Estate Division operations. Going forward, this
recurring review will be performed annually in concert with the Budget process and is essential to
(i)optimize public programming and long-range planning efforts, (ii) ensure properties are
developed in alignment with City priorities, and (iii) prevent overlooked assets from remaining
underutilized or unprogrammed.
Real Estate conducted a preliminary review of properties in the City’s real property inventory,
considering properties unsold from a prior Surplus Sale, inquiries received from the general public,
physical property conditions, and current City use or future public need.
Next, staff initiated a collaborative, cross-department review with department stakeholders for
which the properties were purchased. This review provided operating departments with an
opportunity to evaluate and identify their current and future programming needs, master plan
requirements, and City initiatives.
Finally, the Finance Department evaluated the preliminary list of surplus properties (shown
below), provided data relating to initial funding sources used to procure the properties, and
identified any revenue restrictions that may apply to the proceeds of the sale.

During a March 3, 2026, Work Session presentation (ID: 25-2294), City Council provided staff
with direction to move forward with conducting a sealed bid sale of the identified properties
meeting staff-recommended criteria, shown below.
DISCUSSION:
Public Interest and Marketing
To date, Real Estate staff have developed and implemented tools to track public interest in the
surplus property sale in advance of official advertising, through the official marketing and award
periods, and closing.
• Digital signup sheet- To date, 18 discrete entries have been received through the staff-
monitored Surplus Property Signup link requesting to be notified of the upcoming sale.
• The surplus property list will be posted on the City’s Development Services-Real Estate
website.
• For Sale signs have been designed and will be placed on each property.
• Newspaper ads will run for the mandatory two weeks prior to bid closing.
• When the sale goes live, public inquiries will be directed to Procurement to ensure all
potential bidders have access to the same information.
• BIDDERS ARE REQUIRED TO PERFORM THEIR OWN DUE DILIGENCE ON
THE PROPERTIES PRIOR TO BIDDING. Staff recommend potential bidders
schedule and attend a Pre-Application Conference (PAC) with the Development
Assistance Team (DAT) to identify or confirm zoning, land use regulations, easements,
and verify property can be used as desired.

Real Estate and Procurement staff have updated the sealed bid process by:
• Refreshing bid packets and submission instructions
• Documenting evaluation criteria to ensure transparency
• Finalizing internal controls for timestamping, bid openings and awards of winning bids

Real Estate staff are working closely with Legal, Procurement/Purchasing, Communications, and
Finance to ensure alignment across all components of the sale process.
Timeline
Preparations remain on track for a Q4 2026 surplus property sale, consistent with prior
expectations.
Upcoming milestones include:
✓ Finalizing bid packets,
o Publishing the Notice of Sealed Bid Sale,
o Opening and closing the sealed bid window,
o Returning to Council for action on bid results.
CONCLUSION:
Real Estate and Procurement staff continue to make steady progress toward advertising the
upcoming Surplus Property Sealed Bid Sale in Q4, 2026. Early public interest is strong, internal
procedures have been implemented, and marketing materials are now being finalized. The
properties will be advertised for a minimum of two weeks in August and bid results will be
presented to Council for consideration in September.

State law and the City charter currently identify available methods of sale of City property via
Sealed Bid Sale Process - Auction
This option is available for developable tracts of land or at City’s discretion.
Process- Advertising a list of surplus properties in the local newspaper for 2 consecutive weeks
All bidders will be required to submit a completed City Surplus Property Sealed Bid Packet through
Purchasing/IONWAVE in order to participate in the sealed bid sale.
Bids will be compiled and presented to Council for decision to accept or reject bid offers.
Direct Sale Process - to a foundation, government agency, or an abutting owner*
This option is available for property interests obtained for streets, rights-of-way or easements; land the
City wants to have developed, land in a reinvestment zone
Process-
Determine if an RFP is appropriate to accomplish the City’s initiative or mission
Negotiate an agreement or contract terms for approval by the Council;
Market values will be determined by an independent appraisal or at auction
Restrictions for each method of sale largely depend on the property condition and
sale price (market value).
