General Information & Status Updates
A. Mayor’s Pet Spotlight Barkly is a 3-year-old, 47-pound American Pit Bull Terrier who has
been waiting for a loving home since June. He’s a highly social dog who thrives on human
companionship and loves greeting new people with an enthusiastic tail wag. Barkly is dog-
friendly, making playdates and park outings easy and enjoyable. He adores toys and is very
food-motivated, which makes training both fun and rewarding. He already knows basic
commands and is fully potty trained, so he’s ready to slip right into a new routine.
After spending more than two months in the shelter, Barkly is eager to find a foster or
forever family who can give him the attention he deserves. His playful energy and
affectionate personality make him a wonderful match for an active household looking for

B. Inclement Weather Shelter – From Aug. 27 through Sept. 2, the Inclement Weather Shelter
at the Denton Community Shelter (909 N. Loop 288) was opened seven times. The
inclement weather shelter is opened in accordance with the City’s Use of Facilities for
Inclement Weather Policy to provide overnight cooling for individuals when there is a
Major or Extreme HeatRisk. The below table details the shelter’s utilization and capacity
through this period and Attachment A is the Denton County Public Health Heat-Related
Illness Surveillance Report for the week of Aug. 23 through Aug. 29. Although standard
capacity during inclement weather is 195 beds, Our Daily Bread further expands capacity
at the shelter when the need arises. Additional information on shelter and weather
resources, including instructions on how to sign up for inclement weather alerts, can be

Responses to Council Member Requests for Information
A. Bonnie Brae Phase 6 Updates – On Aug. 31, Council Member Rumohr shared inquiries
from residents about the Bonnie Brae Phase 6 project regarding a new traffic signal and a
side path buffer. The traffic signal is planned on Bonnie Brae Street at the Rayzor Ranch
parking lot in front of Academy Sports, which is funded by the new HEB development.
Vehicles and pedestrians will be able to cross or turn into Bonnie Brae Street at this signal.
Second, the 10-foot side path is planned immediately next to the eastern travel lane of
Bonnie Brae Street in some areas without a buffer between them. The area between the
edge of ROW and the old sidewalk contains in-ground drainage infrastructure in sections,
streetlighting, pull boxes, and room for franchise utilities to be placed. Staff contact: Seth

B. Lakeview Drive Drainage Work – On Aug. 31, Mayor Pro Tem Stevens and Council
Member Ferrie shared an inquiry from a resident regarding plans for drainage work on
Lakeview Drive while the nearby bridge was still under construction. Based on this
feedback, staff have decided to delay the drainage work until after the TxDOT bridge is
reopened.
Once the work is rescheduled, Lakeview Drive will remain open during operations using
alternating single-lane closures with flaggers actively directing vehicles safely around our

C. Development Notification Systems – On Sept. 3, Council Member Rumohr shared an
inquiry from a resident who received a development notification regarding the Bonnie
Brae Street Renaming project. Development Services currently utilizes two different
systems for project notifications. To improve consistency for residents, the GIS map
notification system is being updated to link people to the same information as the News
Flash system linked above. This is expected to be implemented before the end of

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Updates to the City of Denton’s 90th Texas Legislative Session Program.
BACKGROUND:
On August 4, 2026, the City Council held a Work Session of the City of Denton’s draft 90th Texas
Legislative Session Program. During the Work Session, Council provided direction to add several
priorities/positions to the program. Staff also identified an additional position for inclusion in the
Utilities section to reinforce the City's existing authority over municipally owned utility rate-
setting. This report summarizes those additions for Council’s information.
DISCUSSION:
Council-Directed Additions
The following items were added to the Legislative Program at Council’s direction:
Active Legislative Priorities
Economic Development Corporation Sales Tax Allotment
The City supports legislation increasing the sales tax allocation cap and providing the flexibility
to allocate proceeds to both a transportation authority and an Economic Development Corporation
(EDC).
Legislative Positions:
Community & Partnerships: The City of Denton strives to be a good place to live for everyone,
and supports legislation that upholds that goal at the state level.
Taxation & Finance (Support): Separate treatment of business personal property (BPP) tax
revenue from data centers in no-new revenue rate calculations.
Utilities (Support): Regulatory clarity on data centers that preserves local decision-making
authority over data center siting and development;
Staff-Initiated Addition:
In response to ongoing statewide discussions regarding the structure and rate-setting authority of
municipally owned utilities, staff added the following position to the Utilities section:
Utilities (Support): legislation that promotes responsible, transparent, and affordable municipally
owned utility rates.

CONCLUSION:
These additions are reflected in the attached 90th Texas Legislative Session Program. With the
addition of these items, staff will finalize the program and present the final program to Council at
the September 22 Council Meeting.

90th Texas Legislative Session
DRAFT Legislative Program
The City of Denton's Legislative Program outlines the City's priorities and positions for the 90th
Texas Legislative Session. This program is intended to guide the City's engagement with the Texas
Legislature and state agencies to advance legislation that supports the needs and well-being of
Denton residents. Developed by City staff and approved by the Denton City Council, this program
reflects the shared goals of the Denton community. The City supports legislation that strengthens
local government's ability to serve its residents and opposes legislation that undermines that ability.
The City of Denton's legislative efforts are guided by the following principles:
• Foster strong partnerships with state leaders, regional partners, and community
institutions.
• Support investments in infrastructure, public safety, and economic opportunity.
• Advance the health, safety, and well-being of Denton residents.
• Support accountable and transparent local government principles and decision-making.
• Ensure strong financial stewardship to support dependable, high-value services for
residents.
Active Legislative Priorities
These items represent legislation the City of Denton is actively pursuing during the 90th
Legislative Session.
First Responder Retirement & Property Tax Benefits
The City supports legislation providing full retirement benefits and expanded property tax
exemptions to first responders catastrophically injured in the line of duty.
Housing Authority Reform (Ch. 392)
The City supports amending Chapter 392 to ensure the legislature's prior changes to Chapter 303
Public Facility Corporations also apply to Public Facility Corporations and partnerships created
under Chapter 392.
Public Information Request Clarification
The City supports legislation clarifying public information request requirements regarding the
release of records involving deceased suspects versus deceased victims.
Qualified Hotel Project Program Extension
The City supports extending the Qualified Hotel Project program, which is set to expire, to
preserve a critical economic development tool for municipalities.

Support: mental health care access and funding; services for individuals experiencing
homelessness; public school and higher education funding; local decision-making authority.
Taxation & Finance
Support: municipal debt issuance authority; separate treatment of business personal property
(BPP) tax revenue from data centers in no-new-revenue rate calculations.
Oppose: restrictions on Certificates of Obligation; limits on necessary fee authority.
Land Use & Development
Support: cities' authority over ETJ removal requests; local control over lot sizes, density,
parking, and ADUs.
Oppose: restrictions on annexation, zoning, eminent domain, building codes, tree preservation,
short-term rentals, or rights-of-way management.
Utilities
Support: Texas Water Development Board grant funding; direct potable reuse and water
conservation initiatives; clear definition of Dispatchable Reliability Reserve Service technology;
critical infrastructure classification for electric power generation units; regulatory clarity on data
centers that preserves local decision-making authority over data center siting and development;
legislation that promotes responsible, transparent, and affordable municipally owned utility rates.
Oppose: restrictions on large load interconnections to MOU distribution systems; legislation
impacting General Fund Transfers.
City Services
Support: first responder designation for essential city employees like solid waste, animal control,
and utility workers; TASPP reimbursement restoration to historic funding levels; Texas Parks
and Wildlife Local Parks Grant Program funding, humane regulation of puppy mills and pet
stores.
Oppose: restrictions on library materials decisions or community events.
Transportation & Aviation
Support: multimodal transportation funding for growing urban areas; local flexibility to fund
transportation projects; state aviation capital improvement investment.

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Main Street Advisory Board Proposed Board Slate
BACKGROUND:
On June 16, 2026, City Council approved the creation of the City of Denton Main Street Advisory
Board, a requirement for National Main Street Program Accreditation pursuant to the City’s
agreement with the Texas Historical Commission, to advise City Council on matters relating to
Downtown revitalization, economic development, design improvements, promotion strategies, and
preservation efforts. Council is scheduled to consider the appointment of members to the Main
Street Advisory Board at the September 22, 2026 meeting.
DISCUSSION:
The Main Street Advisory Board shall consist of seven (7) voting members and two (2) non-voting
ex-officio members who are appointed by the City Council.
Denton Main Street Advisory Board members will serve two-year terms and may serve up to three
consecutive terms. The establishing ordinance specifies that appointed members
must represent certain categories when filling seats on the Board. Representatives from Denton
County and the University serve as ex-officio members and do not have defined terms of service.
A total of eleven (11) applications were submitted, with eight (8) applicants eligible for either
voting or ex-officio positions. The remaining applications were ineligible for the following
reasons:
1.The applicant did not fall within one of the required board membership categories.
2.The applicant withdrew their application.
3.The applicant is a business owner who already serves on the Tax Increment Reinvestment
Zone Number One (TIRZ 1) Board.
Staff have reviewed the available seats for nomination and appointments as shown in the table
below and confirmed each nominee’s willingness to serve.

The first Main Street Advisory meeting is tentatively scheduled for October.
CONCLUSION:
Staff recommend moving forward with the proposed slate of nominees during the next city council
meeting on September 22, 2026.
