II. General Information & Status Updates
A. Organizational Updates – Please find below an update of recent organizational
changes:
1. Capital Projects – Director of Capital Projects Galen Gillum has
announced that he will be leaving the City of Denton, effective December
31, to pursue other career interests. We greatly appreciate Galen’s
leadership over the last year to create the Capital Projects department, help
organize processes, and move forward key capital projects and
improvements. We wish him the best of luck in his future endeavors.
Todd Estes, City Engineer, has been named the new Director. Todd joined
the City of Denton in July 2017 from the City of Fort Worth where he
worked for over four years to deliver $91 million in capital projects of all
types and complexity. Prior to Fort Worth, Todd worked as the City
Engineer for the City of Marble Falls and he previously worked in private
consulting as a project manager and design engineer for private
development projects. Please join us in thanking Galen for his service and
congratulating Todd on his promotion. We look forward to continued
progress under his leadership.
2. Finance Department – Director of Finance Chuck Springer has announced
he will be resigning his position with the City of Denton to accept a
position with the Town of Prosper as Executive Director of
Administrative Services. His last day in the office will be Friday,
December 29. Please join us in thanking Chuck for his service and
leadership. He has been a pleasure to work with and we wish him well in
his future endeavors.
Antonio (Tony) Puente, currently the Assistant Finance Director, has been
promoted to Finance Director. Tony first started with the City of Denton
in 1999 as a Code Enforcement Officer, briefly left to work as a Budget
Analyst for the City of Grand Prairie, and was rehired by Denton in 2001
as a Revenue Analyst. Since 2001, Tony has held various positions in the
City of Denton’s Finance Department overseeing the City’s budget office,
accounting, payroll, accounts payable, purchasing, municipal court, cash
handling, investments and debt management. Please join us in
congratulating Tony.
3. Municipal Court Administration – Municipal Court will remain under the
management of the Finance Department; however, the division will report
directly to Customer Service Manager Tiffany Thomson effective
immediately. This change is designed to improve customer service,
provide stronger oversight, and enhance the administration of payment
transactions in City Hall East.
4. Communications and Public Affairs – Brian Daskam, Public Information
Officer, and Robby Stengel, Public Communications Manager, have
announced their resignations for the month of December to pursue other
opportunities. We thank them for their years of service and wish them the
best of luck.
With the vacancies, management has analyzed restructuring
Communications (Public Information Office, Public Communications
Office, DTV, and Reprographics) and evaluated other organizational
functions that could create better alignment and outreach to the residents,
community, and other governmental agencies. As such, a new office will
be created in the City Manager’s Office called the Department of Public
Affairs and Intergovernmental Relations. Sarah Kuechler has been named
as Director and Jessica Rogers, currently Energy Services Manager in
DME, has been named as Deputy Director. The office will lead and
manage Communications, Intergovernmental Relations, and Strategic
Initiatives (including the strategic plan, performance measures, managed
competition, and special projects).
Additionally, Community Development will be moved from
Development Services to this department to provide a stronger connection
to the City Manager’s Office, enhance communication and oversight of
programs and services, and provide a more holistic approach to addressing
housing and homelessness.

B. Council Work Session Room – On Saturday, December 9, a contractor will install
a “smart glass” window for the Council Work Session Room to allow for the room
to be easily transitioned for closed meetings. The “smart glass” consists of a film
of liquefied crystal between two glass panes. In a neutral state, de-energized, the
glass is opaque. When it is energized, through a simple on/off switch, it causes a
reaction within the glass allowing it to be transparent. Staff contact: Mark Nelson
C. Ethics Ordinance – The next meeting for City Council to work with Alan
Bojorquez on development of an ethics ordinance is scheduled for a Work Session
of the City Council on Tuesday, December 19 at 1:00 p.m. in the Council Work
Session Room. Staff will work with Mr. Bojorquez to put together a schedule for
the remaining sessions with an outline of planned topics to be discussed at each
meeting. As directed, staff will draft the agenda to allow for Council to suspend
the Rules of Procedures to provide an opportunity for public comment at Work
Sessions where the ethics ordinance will be discussed. Staff contact: Bryan

D. TxDOT On-System Status Report – The December 2017 Texas Department of
Transportation (TxDOT) On-System Report has been attached for your review.
This report is updated by ITS staff on a monthly basis and provides current status
regarding TxDOT On-System projects that may impact mobility in the Denton
Area. This report is included as part of the Council Mobility Committee Backup
and John Polster, ITS facilitates a discussion of the report as part of the monthly
Mobility Committee Meeting. This report will be posted to the City of Denton
website on December 11, 2017. Staff contact: Mark Nelson
E. Prolonged Closure of Entrance Ramp from southbound US 77 onto I-35E – On
Thursday, Dec. 7, TxDOT officials announced that the entrance ramp from
southbound US 77 onto soundbound Interstate 35E will be closed for up to one
year, beginning this Monday, Dec. 11. The closure is part of a construction project
aimed at adding capacity and easing congestion along I-35E. Please see attached
press release.
Staff is working with the TxDOT project manager to provide us with more
advanced notice of such closures and to understand the remaining I-35E project
sequencing and traffic flow impacts. Staff contact: Mark Nelson
F. City Hall West (CHW) Committee Meeting – The City Hall West Steering
Committee will hold its initial meeting on December 18 at 5:30 p.m. at the Civic
Center. This will include a report on the background of the project, discussion of
the initial proposal from Architexas, and review of the charges for the committee
from the City Council. In addition the committee will be discussing the committee
ground rules including the policy regarding open meetings, placing items on the
agenda, how minutes will be taken, public participation, and subsequent meeting
dates. This initial meeting will immediately be followed by a tour of City Hall
West so the committee can see the current state of the building and begin thinking
about the possible future uses that will be discussed in the following meetings.

G. Cedar Street Parking Lot – Please see attached a rendering of the Cedar Street
Parking Lot at the conclusion of the full reconstruction project; expected to be
complete by April 29, 2018. Once complete, the parking lot will be improved with
86 parking spaces including four additional handicap spaces. Updates will also
include benches, new security lighting, enhanced landscaping, wayfinding
signage, and brick banding of the sidewalk, similar to what is currently on Cedar
Street.
Staff will install the light poles that are in the historic districts as directed by City
Council during discussion of potential downtown improvement projects at the
December 5, 2017 City Council Work Session meeting. Staff contact: Mark

H. Parks and Rec Presentation Follow-up – In response to questions related to the
Parks and Recreation Department’s presentations to Council on December 5,
2017, the following information has been gathered.

I. Denton Police Appreciation Day – The Denton Citizens’ Police Academy Alumni
(DCPAA) will be hosting the Annual Denton Police Officers’ Appreciation Day
from 6 am on the morning of December 14 until 11 pm that night at the Denton
Public Safety Training Center. Members of the DCPAA serve food, drinks and
snacks throughout the day to all Denton Police employees. They also give away
door prizes. The Denton CPAA has been hosting the event for 21 years. Denton
City Management and Council Members are welcome to attend. Staff contact:

J. Denton Police Department Career Fair – The Denton Police Department will host
a career fair on Saturday, January 6, 2018, beginning at 10:00am, at the Denton
Public Safety Training Facility. The Denton Police Department is dedicated to
engaging the community in a collaborative effort to enhance public safety and is
seeking individuals who are dedicated to meeting the challenges of policing in an
ever-changing environment. Any interested persons are invited to attend to learn
about careers with the Police Department from police officers, duty officers,

K. Informal Staff Reports – Please see attached two informal staff reports regarding

III. Community Events
A. Police Christmas Food Drive – Donate five food donation items from now until
December 19 at the Denton Police Department to be able to enjoy lunch with
Denton Police officers on the 19th! The lunch will take place on Tuesday,
December 19 from 11:30 a.m. to 1:30 p.m. at the Denton Public Safety Training
Center. All donations will benefit the Denton Community Food Center (DCFC).

B. Pet Supply Donation Tree at the Library – Emily Fowler Central Library is
accepting pet supply donations to support animals at the Denton Animal Shelter
during the holiday season. Stop by Emily Fowler Central Library, 502 Oakland St,
to donate supplies through the month of December. Below are a list of needs:

Current Activity:
PS&E: Approved May 22, 2017.
Utilities: With the exception of City of Denton utilities, whose relocations have been incorporated
into the construction contract, utility relocations are now complete.
Construction: The project let on July 11, 2017. Project was awarded to MCM with a low bid of
$37,641,150, at 4.85% below the estimate. There are 27 months of barricades. TxDOT is placing
safeguards in the MCM contract to ensure a timely schedule. Pre-construction meeting occurred on
October 5, 2017. MCM second work schedule was resubmitted in November and given conditional
approval. Time started on November 6, 2017.
Signals: Signal on the north property line at Guyer High School will be included in the FM 2181
contract. City has provided TxDOT with a copy of the signal warrant for the new signal request at
Sundown near the South Branch Library.
City participation: Funding city utility relocations.

on April 25, 2012. Re-evaluation is underway and on
track for May 2018.
PS&E: Signed and sealed roadway plans were
submitted and accepted by TxDOT on July 14, 2017.
UPRR: Road design is complete.
Lochner is working to revise the geometry to meet
UPRR criteria. TxDOT held a meeting on August 22,
2017, with UPRR and Lochner to discuss and resolve
final comments. Follow-up meeting between Lochner
and UPRR held on August 31, 2017. Lochner
completed comments and provided to TxDOT and
UPRR on September 18, 2017. Lochner has submitted
an abbreviated Exhibit A to use for the Railroad
Agreement, and they are working on bridge package
for submittal.

Current Activity:
Funding: This project is fully funded with Regional Toll Revenue.
Construction: The project let on July 8, 2014. The contract was
awarded to Webber, LLC, in the amount of $34,857,000.00, which
was 3% over the estimate. The contract calls for 505 working days
and 24 months of barricades. Construction began on April 20, 2015.
See attached TxDOT construction report.
Other: Continuous six-foot sidewalks on both sides of the roadway,
as well as outside rider shared-use lanes, are planned.
Signal at FM 2499/Robinson: Construction is funded through county
RTR funds. Materials for signal have been ordered but may not be
received until mid-January or first of February due to hurricane-hit
areas receiving priority of materials shipment.
*The roadway will not open until the signal is functional.

Advanced Planning: TxDOT is working to retain engineering services to begin the advanced
planning for widening the Mayhill bridge under IH-35E to its ultimate width. TxDOT has engaged
LTRA and plans to have an executed work authorization in January. TxDOT is working on a
construction estimate so that funding can be identified. Permanent CSJ should be created in
December.

Utility Relocations: Both the city’s utilities and the roadway project will be in one set of plans
developed by Brown & Gay. Only Atmos remains in conflict. Atmos is currently potholing.
Relocations not affecting construction.
PS&E: The 100% plans were sent to Austin on August 5, 2016.
Construction: This project was awarded to OHL on September 22, 2016, for a total construction
cost of $27,503,078. The contract allows for 442 working days and 17 months of barricades. The
pre-construction meeting occurred on February 16, 2017. Construction began on March 6, 2017.

City participation: Funding $2.1 million for local match on Brinker underpass.

Current Activity:
Schematic: HDR submitted 60% plans to TxDOT Dallas District on January 30, 2017. Received
comments from design division and addressing comments from Dallas District. Awaiting FHWA
comments. Public meeting to present initial plan view held on June 22, 2017. Received comments
from FHWA on the IAJR. HDR continues addressing comments and working on 90% schematic.
TxDOT and HDR are working on supplemental work authorizations for the completion of the
schematic and the completion of the environmental portion of the project. Work authorization for
remaining schematic tasks has been executed. Work authorization for completion of
environmental documentation is still underway.
Portion of IH 35 at FM 455 will be broken out and built with the FM 455 project.
Environmental: Conducting preliminary data collection.
PS&E: To be developed in two segments after schematic and environmental approval.
Other: Project is currently only funded for planning. Additional funding will need to be identified
for right-of-way acquisition, utility relocation, final PS&E, and construction.

Current Activity:
Funding: Denton County provided preliminary engineering and ROW acquisition. City of
Denton assisted with utility relocations and aesthetics. State funded construction.
Construction: The project was awarded to Jagoe Public. See attached TxDOT construction report.
Other: Sidewalks are being constructed on both sides of the project, except from Hinkle to Carroll
Boulevard due to ROW constraints. The District stated that the schematic was completed when
sidewalks were not typically included in state projects. However, prior to letting the project, it was
decided to add sidewalks everywhere they could be added. Mike Hainline, TxDOT’s project
manager at the time, stated that there is not room horizontally or vertically in this section of US
380. He also identified several conflicts at cross streets and Grandy’s driveway. The primary
issues were grade, right-of-way width, utility conflicts, and drainage concerns.
City participation: Funded city utility relocations. Will be working with TxDOT on landscaping.

Current Activity:
ITS met with TxDOT Denton and TxDOT Dallas to begin process of adding turning
improvements. ITS continues discussions with TxDOT regarding interim improvements, as well
as the possibility of adding these improvements to the US 380 East project. TxDOT has included
these improvements in the new maintenance contract that is expected to let in March 2018.
TxDOT expects to begin the work widening the ramp in May 2018.

technical reports for the EA. AECOM submitted draft EA for District review on November 17, 2017.
PS&E: TxDOT design team is working on 30% PS&E for CSJ 0135-10-057 (from Loop 288 to US 377).
Estimate 30% submittal in spring 2018. TxDOT has completed negotiations with consultant preparing
PS&E for CSJ 0135-10-050 (from US 377 to county line); awaiting approval of work authorization.
ROW: AECOM is finalizing proposed ROW and preparing additional ROE letters for ENV survey.
Utilities: AECOM prepared and completed SUE drawings.
Funding: For CSJ -050, TxDOT has identified $47.1 million in Proposition 1 funds and $14 million in
STP-MM for a total of $61.1 million; for CSJ -057, TxDOT has identified $13 million in Proposition 1
funds. US 380 has been listed as a project on the 10-year plan with an additional $28.6 million.
Other: NCTCOG has agreed to cost share the addition of a 10-ft wide side path from Mayhill to the
Greenbelt Corridor. City council approved a LPAFA on September 12, 2017, for the 10-foot sidewalk
component from Mayhill to the Greenbelt in the amount of $848,874.75.
City participation: City is funding 20% local match of NCTCOG funding.

Current Status:
Environmental: CP&Y developed ICI analysis and report. CP&Y has coordinated with
individual property owners on the latest alignment studies and schematics.
Schematic: Ongoing coordination with City of Denton to determine John Paine intersection
location along Loop 288. City thoroughfare plan shows a future new location for John Paine.
Confirmed design at IH 35 with HDR. CP&Y to match Loop 288 alignment used in IH 35 design.
Loop 288/IH-35W conceptual interchange design will be determined based on preliminary traffic
data. Traffic data to be performed by HNTB.
Developing ultimate main lane, direct connector, and frontage road design at the Loop 288/IH-35
interchange (northern terminus) to match the IH 35 schematic design by HDR. Ongoing
coordination between HDR and CP&Y to make sure designs are consistent between plans.
Meeting with City of Denton, TxDOT, and ITS held on May 31, 2017, to discuss conflicts with
gas well sites or other utilities along FM 2449 corridor and potentially shifting the Loop 288

Planning: Advanced planning and design will be contracted and managed by Denton County.
ITS has worked with TxDOT staff to develop the scope of services for this facility.
ITS met with LTRA to discuss project scope on July 25, 2017. LTRA is in the process of
providing a draft scope based on the meeting. TxDOT will then confirm the scope. ITS will
then coordinate review of the cost with TxDOT. LTRA, TxDOT, ITS, and City of Denton
representatives met on August 29, 2017, to discuss project scoping and outline design needs.
LTRA has submitted draft scope, which is currently under TxDOT review. Scope and fee have
been finalized and submitted to ITS. Anticipate commissioners court consideration in
December.

I-35 Mobility Improvements Include Temporary Ramp Closure
DENTON, TX, Dec. 8, 2017 – On Dec. 7, 2017, TxDOT officials announced that the entrance
ramp from southbound US 77 onto southbound Interstate 35E will be closed for up to one year,
beginning Monday. The closure is part of a construction project aimed at adding capacity and
easing congestion along I-35E. Lane closures are expected southbound on I-35 on Sunday and
Monday between 10 p.m. and 6 a.m.
“When complete, lane capacity at the Loop 288 intersection of I-35E will be doubled,” said
Mark Nelson, Director of Transportation for the City of Denton. “The project will also expand I-
35E to three lanes in each direction, add a south to north u-turn at Mayhill Road, and grade
separation at Brinker Road providing additional options for local traffic in the area.”

Overview of historic designations within the Downtown Square.
BACKGROUND:
On November 7, 2017 Council requested that staff research the possibilities of designating the
Fine Arts Theater building (113-115 N. Elm St.) as a historic landmark and the Downtown
Square as a historic district. The Fine Arts Theatre is not currently specifically designated as a
historic landmark. There are three different levels in which a building or area can be designated
as historic. This can be achieved in several ways:
Federal: the National Register of Historic Places (NRHP) through the National Parks
Service;
State: Recorded Texas Historical Landmark (RTHL) through the Texas Historical
Commission;
Local designation: historic landmark, historic district or historic conservation district.
Currently, the Denton Courthouse Square is listed as a historic district through the National
Register of Historic Places. The Denton County Courthouse is also designated as a Texas
Historical Landmark, as well as City Hall West and the Campus Theatre (214 W. Hickory St.).
DISCUSSION:
Consideration of options to designate the Fine Arts Theatre as a State or local landmark or the
Square as a local historic district. The following provides specifics on the each of the three levels
of historic designations.
National Register of Historic Places (Federal)
Currently the Downtown Square is listed on the NRHP as the Denton County Courthouse Square
Historical District. It was given this designation on December 28, 2000 and included a number of
buildings as contributing towards that designation. The Fine Arts Theater is listed as a
contributing building for the district along with 29 other buildings, sites, structures, and objects
that can be found in the National Register Nomination File.
The following applies to all buildings within a NRHP district:
Federal preservation grants for planning and rehabilitation are available.
Federal investment tax credits are available up to 20% of eligible costs.
Preservation easements for non-profits.
International building code fire and life safety alternatives available.
Property may be eligible for additional state tax benefits and grants. Texas currently
offers a credit worth 25% of eligible rehabilitation costs.
NRHP designation puts no restriction on what a property owner may do with a property
unless federal assistance is received.
Does not automatically invoke local historic district or landmark designation.

Recorded Texas Historical Landmarks (State)
Currently there are three buildings in the Downtown area that are designated as Recorded Texas
Historical Landmarks: City Hall West, Campus Theatre, and the Denton County Courthouse.
Buildings on the Downtown Square eligible for RTHL designation are those buildings at least 50
years of age and retains the integrity from a period of at least 50 years ago.
(RTHL and NHRP designation are separate and are not a prerequisite for either designation nor
do they guarantee listing in the other register.)
The following applies to all RTHL buildings:
Buildings qualify for a 25% tax credit for eligible rehabilitation costs, but it is not
necessary to receive the state tax credit.
(An NRHP designation also allows a candidate to receive the tax credit.)
If a building is a RTHL then notification must be made to the Texas Historical
Commission at least 60 days prior to any alterations being made to the building.
If the changes made to the structure are unwarranted or appreciable then the State Marker
Review Board may withdraw the designation.
Locally Designated Historic Landmarks or Districts (Local)
A building or district can also be designated at the local level through the City Council. There are
seven buildings, as shown in Attachment 1, that are local historic landmarks in the Downtown
Square. The Fine Arts Theatre is not currently a historic landmark. The Denton Development
Code lists 13 criteria that allow designation of a landmark and one is “Recognition as a recorded
state historic landmark, a national historic landmark or entered into the National Register of
Historic Places”. Typically the owner of a property applies for a historic landmark designation.
There has been no precedent where the City initiated a designation. An informal staff report was
provided to the Historic Landmark Commission (HLC) in 2013 about the designation of the
Courthouse Square as a local historic district, but there was no interest from the property owners
at that time. In January 2018, the HLC will receive a report and hold a discussion regarding
locally designating the Downtown Square and surrounding area as a historic district.
The following applies to buildings designated as a local historic landmark:
Eligible for exemptions of 50% of city property taxes for 10 years may be granted based
on certain criteria. (Denton City Charter; Chapter 10; Article VI – VII)
Buildings within a historic district are not eligible for the tax exemption unless those
buildings are also separately designated as a historic landmark.
A Certificate of Appropriateness is required for any work except routine maintenance.
Applications for a Certificate of Appropriateness must be approved by the HLC prior to
beginning work on a historic landmark building or on buildings in a historic district or
conservation district.

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Report addressing citizen letters requesting multifamily recycling, composting, and construction
material diversion.
BACKGROUND:
Over the last several weeks, the City Council has received numerous citizen letters regarding
requests to implement and/or improve multifamily recycling, composting, and construction
material diversion.
Last week, a resident contacted Solid Waste staff and stated that representatives from Texas
Campaign for the Environment were canvassing their neighborhood and distributing the attached
flyers. Many of the letters being sent to Council are likely the result of this group’s efforts.
The resident also stated that the canvasser requested donations and claimed to be working
directly with members of the City Council. On November 22, 2017, Council received the
attached email from the DFW Program Director for Texas Campaign for the Environment. More
information about this organization can be found by visiting https://www.texasenvironment.org/.
The subject matter highlighted by the flyers and citizen letters are key focus areas for the Solid
Waste department. While City of Denton recycling services are available to all commercial and
multifamily entities, staff acknowledges the need to improve upon the 41.5% recycling adoption
rate for multifamily properties. Staff is actively working on strategies to increase recycling
accessibility for multifamily tenants, and an update on these efforts was provided to the Council
Committee on the Environment on November 6, 2017. A copy of the presentation is attached.
Staff continues to work with the Committee on the Environment on strategies to improve
multifamily recycling, and will bring a final draft of these efforts to the Public Utilities Board
and City Council when completed.
In regards to composting, a staff report detailing the City of Denton’s Dyno Dirt operation was
provided to Council as part of the November 10, 2017 reading file. As for the diversion of
construction materials, Solid Waste’s Building Materials Recovery operation diverts, processes,
and sells construction and demolition materials such as wood, concrete, and metal.
The Solid Waste department is dedicated to waste minimization and sustainable business
practices, and staff appreciates our citizens’ input and commitment to improving our city’s
performance in these areas.

Dear Denton City Council & Staff,
This is Corey Troiani, local program director for Texas Campaign for the Environment. Our organization is excited and
eager to hear recent developments on the city’s pursuit of an ordinance to expand access to multi‐family and
commercial recycling throughout Denton. Universal recycling ordinances have been effective in a number of cities
throughout Texas and the U.S. in helping reduce waste and increase resource recovery. Like most cities, the majority of
Denton’s waste is generated by commercial and multi‐family establishments, and without good standards or
requirements for providing basic recycling services, many tenants and residents are left in the lurch with no option but
to trash everything they discard.
I’ve attached some professional research from other cities on multi‐family recycling. You’ll see one of the reports was
generated with funding from our Zero Waste project and it includes focus groups with apartment tenants and managers
in Dallas. The other resources were generated by a consulting group outside of Texas and contain some good universal
info for local governments on this topic. I hope you find these resources helpful and informative as you seek the best
policy measures to address recycling in the city.
Texas Campaign for the Environment is continuing to organize in Denton communities to build support for universal
recycling. Our supporters have already written hundreds of letters to your offices—not only on this issue, but on other
waste diversion programs as well. The City of Denton has undergone many recent changes in staff and leadership,
including the Director of Solid Waste, which has resulted in changes to Denton’s 2016 Strategic Plan for solid waste and
recycling. (By the way, we congratulate your recent decision to disband the landfill mining project, an all‐too‐expensive
and dangerous endeavor.) We believe the city’s strategic recycling plan should reflect the values of the city’s new
leadership and the will of its citizens. In addition to our recommendation for a Universal Recycling Ordinance, we also
urge you to reconsider the strategies and goals of this plan by involving residents, businesses, and community leaders
in public discussion on how the city can continue to innovate and strive for a more circular economy for its resources.
If Dallas, Fort Worth, San Antonio, and Austin can set long‐term ambitious recycling goals, why can’t Denton?
