The attached report reflects progress through the fourth quarter of the fiscal year. Initiatives aligned with Council priorities are also tracked and reportedthrough the City’s performance management software and included, amongst over 100initiatives supporting the Council’s Key Focus Areas, on the City’s public-facingdashboard. Staff contact: Aimée Kaslik, City Manager’s Office B.Development Services Staff Development – The Development Service Center located at401 N Elm Street will be closed to the public on Wednesday, Oct. 30, for staff development.During the closure, customers will be able to apply for permits and submit developmentprojects electronically through the City of Denton’s Development Portal. Notice of the facility closure is posted on the online portal facility doors, and customers have beennotified by email. Normal operations will resume on Thursday, Oct. 31. Staff contact: ScottMcDonald, Development Services C.Traffic Signal Installation at Teasley (FM 2181) and Sundown – On Oct. 23, the City’s Traffic Signal Operations Team completed the building and installation of traffic signals at the intersection of Teasley Lane and Sundown Blvd. The Traffic Operations Teamcoordinated with the Police, Denton Municipal Electric, and Utilities departments for thestaff and equipment needed to accomplish this signal installation. By managing the projectinternally, the City saved approximately $113,000 in labor costs and plans to utilize this process for future traffic signal installations. Staff contact: James Andrews, Development Services D.Small Business Bootcamp – The City of Denton is offering a free, three-part Small Business Bootcamp on Thursday, Nov. 7 at 6:00 p.m., Thursday, Nov. 14 at 6:00 p.m., and Saturday, Nov. 16th at 9:00 a.m. at the Denton Civic Center located at 321 E. McKinney Street. Registration is open through Oct. 30, and free childcare will be provided onsite for registered participants. Staff contact: Courtney Douangdara, Community Services E.Homeowner Repair Assistance – Six local homeowners received free glass door andwindow replacements through a partnership between the City of Denton and the North Texas Glass Association (NGA). NGA provided materials and labor for the repairs. TheCity’s Homeowner Repair Program assists low- and moderate-income homeowners inDenton who need help with minor repairs. F.Downtown Ambassador Program- Beginning in January 2024, the City of Denton launcheda two-year pilot program designed to help build and maintain a clean, safe, and thrivingdowntown for residents, businesses, and visitors. Staff contact: Courtney Douangdara, Community Services G.Inclement Weather Warming Stations – In preparation for winter weather, the City ofDenton has compiled a list of warming stations available for the 2024-25 winter season. The warming stations are heated facilities with public access to restrooms, water fountains, and sitting areas. Figure 4New window installed Figure 3Window before replacement 3 Responses to Council Member Requests for Information A.Cooper Creek Bed Maintenance – On Oct. 11, Council Member Beck inquired about the Cooper Creek bed maintenance. Upon assessing the vegetation at the creek bed and discovering that nearly 50 percent of the vegetation is native plant species, staff initiated aplan to clear the creek bed at the end of the vegetation growth cycle in December orJanuary. Staff contact: Ziad Kharrat, Parks and Recreation B.Disaster Recovery Webinar – On Oct. 15, Council Member McGee shared information for an upcoming webinar from the Texas General Land Office and inquired if the City couldreceive recovery allocation for Winter Storm Uri. Staff attended the webinar anddetermined that the city is not eligible for these funds. The Grant Management Officecontinues to research available funding opportunities. Staff contact: Terrance Jones, Finance C.Battery Storage with Rooftop Solar—At the Oct. 22, 2024, Council Meeting, CouncilMember Jester raised a question about using battery storage in conjunction with rooftopsolar. Battery storage would enable rooftop storage users to utilize more of their own solar power when solar energy is not accessible. Battery storage with a capacity equal to or greater than 3 kilowatt hours, is eligible forResidential Clean Energy Tax Credits. The tax credit is currently 30% for systemsplaced in service after Dec. 31, 2021, and before Jan. 1, 2033. More information can befound here. Staff contact: Bill Shepherd, Denton Municipal Electric D.Value of Solar – On Oct. 23, Council Member Holland shared feedback from a residentregarding the Value of Solar impact on the Climate Action Plan (CAP). On June 18, 2024, the City Council held a work session on a Revised Climate Action Plan and gave staff direction to bring it forward for action. On Aug. 6, 2024, the City Councilunanimously (7-0) adopted the City’s Climate Action Plan. The adopted CAP includesthree (3) primary goals supported by 16 actions. All 16 actions were tied to existing CityMaster Plans with set timelines and tied to the City’s Science Based Targets (SBT). Asdiscussed during the City Council work session and with the Sustainability Framework Advisory Committee (SFAC) annual reporting will be made that will show progress on all16 actions. Within status reporting data will be shared to show our progress towards theSBT. Comparisons will be made against various master plans, inputs for GHG reductionmodeling, and when possible, against Sustainability Solutions Group (SSG)schedules. An example of an SSG schedule would be rooftop solar. SSG projected the City to add 5megawatts (MW) of rooftop solar by the end of 2025 (raising 9 MW to 14 MW). As ofOctober 2024, the City has over 13 MW of installed capacity. SSG modeled reductionsfrom local renewable energy installation that included an additional 183 MW by 2048 (9MW to 192 MW), which would result in a 0.4% reduction in GHG emissions, which SSG called a small reduction. 4 The Internal Revenue Service (IRS) has Tax Credits for both solar and battery installations for qualified taxpayers that will today run through Tax Year 2034. Up to 30% of total cost through 2032 and then steps down a bit before ending in 2034. IRS tax credits are an agenda item for this Friday’s SFAC meeting. The original Notice to Proceed (NTP) was issued on September 28, 2022, but construction was halted shortly thereafter due to the discovery of numerous franchise utility conflicts during initial site exploration and survey. In response to these issues, a revised NTP was issued on February 13, 2023. However, further delays occurred in September 2023 due to ongoing right-of-way negotiations and conflicts with overhead electric lines and gas lines. Additionally, the merger of Kansas City Southern (KCSR) with Canadian Pacific (CPR) in March 2023 necessitated restarting negotiations with the newly formed Canadian Pacific Kansas City (CPKC) railroad. Despite these setbacks, the City of Denton secured approval for the right-of-way acquisition on July 23, 2024. The current proposed NTP for the project is January 2025, and it is anticipated that construction will resume at that time. DISCUSSION: Project Restart and Change Order: With right-of-way acquired (July 23, 2024), utility conflicts to be resolved by December 1, 2024, and railroad permits/agreements expected to be in place by the close of 2024, the contractor can remobilize to restart work. Change Order Details: •Initial Amount: Over $11 million •Negotiated Amount: $9,229,824.91 •Reasons for Increase: Labor and material escalation, additional equipment rental. Contingency and Total Change Order: •5% Contingency: $2,477,258.76 •Total Change Order: $6,752,566.15. o $10,000,000 was approved for the Hickory Creek 3 project in the FY 24-25 budget.This money will be used to fund this change order. 23 October 25, 2024 Report No. 2025-003 Impact on Project: •Original Contract Amount: $49 million •Change Order Percentage: 13% (well below the contract's allowed percentage) •Anticipated Remobilization: January 1, 2025 •New Completion Date: Q2 2026 Approval of the change order will allow the project to proceed with the revised timeline and budget. CONCLUSION: Based on the information provided, staff recommends approval of the proposed change order. Key Reasons for Approval: •Necessary for Project Completion: The change order addresses essential factors that haveimpacted the project's timeline and budget, such as utility conflicts, railroad agreements, and increased material and labor costs. •Reasonable Cost Increase: The negotiated change order amount represents a 13% increase,which is well within the contract's allowable percentage. •Positive Impact on Project: Approving the change order will allow the project to proceedwith a revised timeline and budget, ensuring its successful completion. Recommendation: The change order request is tentatively scheduled for City Council consideration on December 3, 2024. The requested change order of $6,752,566.15 will enable the contractor to remobilize on-site by January 1, 2025 and complete the project by Q2 2026.
