Public Meetings & Agendas | Denton, TX (civicplus.com) General Information & Status Updates A.Stream Clean 2024 – Stream Clean will be held on Saturday, Dec. 7, from 9:00 a.m. to 11:30 a.m. and an optional breakfast will be served at 8:00 a.m. at the Denton Civic Center Pool, 515 N. Bell Avenue. This event brings the community together to collect trash andrecycle material in and around Denton’s waterways and properly dispose of it. Pleaseregister by visiting the Stream Clean webpage. Late registration will also be available atthe Denton Civic Center Pool on Dec. 7. Staff contact: Trevor Crain, Capital Projects C.DTV Video Highlights for November - DTV released several videos this month that raiseawareness, educate, and inform our community: •Denton’s 31 Days of Halloween Rewind YouTube This October, our community came together to transform Denton into the Halloween Capital of Texas. •Paperless Billing YouTube Not only is paperless billing more convenient, it’s also more sustainable. •Pollinator Garden at the Landfill YouTube City staff, local students, and Girl Scouts plant a new pollinator garden at the Landfill. •The Give Responsibly Initiative YouTube The City of Denton's Give Responsibly initiative offers a better way to give. All videos air on DTV, are shared via social media channels, and are available on the City’s YouTube channel. The City Secretary's Office has implemented anew process and will resolve the backlog by the end of December 2024. Members of thepublic can still access the Council’s vote history from 2018 to 2023 by visiting the CityCouncil website. This resource includes effective ways to communicateprojects and recommendations for planning and hosting neighborhood meetings. The new webpage may be viewed here. Staff contact: Tina Firgens, Development Services 2 F.Special Events Team Wins Big – The Denton Parks and Recreation Special Events Teamreceived several awards and honors at the recent Texas Festivals and Events AssociationConference. The “July Jubilee” won a gold award for Best Social Ad Series and silver awards for Best Event Program and Best Emergency Preparedness Plan. The Emergency Preparedness plan was authored by Alyssa Owen from Fire and Officer Justin Thomasfrom Police in collaboration with the Special Events Team. “The North of Totality” event poster also won a silver award in the category of Commemorative Poster. The poster was based on the design of the traffic box on Carroll Boulevard that University of North Texas student and City of Denton intern Kaci Martinoriginally created. At the conference, Autumn Natalie and Arianna Such officially graduated from the Texas Event Management Institute (TEMI) and received their status as Certified Festivals and Events Associates – a professional designation that is the result of numerous years of in-career expertise and the completion of the two-year TEMI program. Staff contact: AutumnNatalie, Parks and Recreation Responses to Council Member Requests for Information A.ApplePay for Utilities – On Nov. 7, Council Member Byrd shared an inquiry regardingApplePay as an option for payment of utilities. The online payment portal, Invoice Cloud, is supported by Wells Fargo Merchant Services. The Invoice Cloud portal requires a gateway which is currently Bridgepay, that does not have the capabilities to meet ApplePayrequirements. Should Bridgepay develop these requirements, staff will reviewimplementing the ability to accept ApplePay as payment via Customer Service’s onlineportal. Staff contact: Bill Shepherd, Denton Municipal Electric B.Upcoming Streets Projects – On Nov. 18, Council Member Holland inquired about Streetprojects currently underway. Several major roadway projects are in progress or upcomingfocused on completing the Neighborhood Rehabilitation Program (neighborhood streets)from the 2019 Bond Program. A table of the progress is below. The program is scheduled to be completed by the end of 2026. Hickory Creek Roadway Phase 3 is currently on hold, but an agreement to begin workagain is underway. Ryan Road is planned for construction after Hickory Creek Roadwayis completed. The Ruddell/Mingo roadway project began in August 2024. During Bonnie Brae Phase 6, Riney Road East and Westgate Roadways are planned forreplacement. BACKGROUND: The new Hickory GIS Substation is currently being built adjacent to an entry corridor to the City of Denton for its downtown, University of North Texas, and historic district areas. Aesthetics along this entry corridor were of particular interest to the Council, who wanted the new substation to fit the area. On June 21, 2016, the City Council (ID 16-7111) provided DME staff direction regarding the Hickory Substation site related to options for the substation’s configuration and aesthetic treatment. The presentation included background information on the Hickory GIS Substation site, the recommendation of the Substation Aesthetic Committee, and estimated construction costs. Council directed DME to build the new Hickory Substation with GIS technology to minimize its footprint and align with the Council’s preference for an architectural façade/wall. Additional direction from the Council included DME moving forward with underground transmission circuits appropriate to the construction of this substation as well as converting existing overhead distribution circuits in the same general area to underground. Construction for the overhead to underground conversion started over 18 months ago, which required closing Bonnie Brae, Oak, and Hickory streets several times to install underground facilities. DME completed the construction of these underground facilities except for one duct bank. The remaining duct bank routes south along the east side of Bonnie Brae Street and will need to be located in the new street Rights of Way (ROW) that the City is planning to acquire in the future for the widening of Bonnie Brae (Project Bonnie Brae Phase 4B). DME investigated other routes for the remaining underground duct bank but no feasible routes were found due to existing underground conflicts in these roads. DME plans to temporarily leave two distribution lines overhead until the new ROW for Bonnie Brae Road is acquired. This will minimize the number of lane closures required in the area and reduce the impact on residents. DISCUSSION:  Department Structure & Staffing Levels: The CIS team consists of a Neighborhood Services Manager and seven (7) officers. Based on population density and case volume, the team operates across seven (7) districts (Exhibit 1). In Fiscal Year 2023-24, the team increased from six (6) to seven (7) officers. This position was added to support Solid Waste and address Chapter 24 ordinance updates. The current staff transition resulted from two long-term employee retirements, one resignation, and one transfer to another City department. Skill Level of CIS Officers: Donnie Denny: Senior CIS Officer with over 10 years of experience in CIS with the City of Denton and a TDLR licensed officer. Toni Hooten: CIS Officer with nearly 4 years in the department and a TDLR licensed officer. Christina Dixon: First-year CIS Officer hired January 2024 and currently attending Texas State TEEX Basic Code training from November 4th to 8th. Megan Hall, Scott Stratton, Aaren Pierpoint, and Richard Naugle: All in their first year, hired in July and August 2024 and are still in training. Engagement with HOAs: Meeting Attendance: CIS regularly attends meetings for Denia, Wheeler Ridge, and Sedna. Success Measurement of Operations: 1.Focus on Education: CIS prioritizes educating residents on ordinance compliance and property maintenance. CIS measures success by the voluntary compliance rate achieved and the average time to close cases. 2.High Success Rate: CIS achieves a 98% success rate in achieving voluntary compliance. Only 2% of cases require further action such as work orders or summonses. The average time to close cases in FY 23/24 was 15 days, with only 2% proceeding to summonses or work orders. CIS Enforcement Procedures 1.Initial Notice and Education: 7-Day Verbal Notice/Courtesy Door Hanger: CIS provides a verbal notice or courtesy door hanger to educate residents and property owners about the violation(s) and potential impacts of non-compliance. Reinspection: Follow-up inspection to assess compliance and determine next steps. Engagement: CIS collaborates with residents showing measurable progress to encourage community involvement and refers all possibly eligible candidates to outside services such as Sweat Team, Hearts for Homes, Valley Creek Church, Minor Repair Program, etc. 2.Written Notice: 26 Nov. 22, 2024 Report No. 2025-008 10-Day Written Notice: If violations persist after seven days, a written notice is mailed outlining the issues causing the violation. Contact Attempts/Due Diligence: Officers utilize all resources available to reach out to residents, property owners and property managers. 3. These items will appear on the Dec. 3, 2024, City Council Meeting Agenda under Consent. The item numbers, item names, and a general description of changes are listed below. Where applicable, the authority to make the changes is listed as well. DISCUSSION: 24-2198 General Obligations Commercial Paper Annual Refunding Authority Following the issuance of the 2019 Bond Program, the City established a Commercial Paper Program to begin Bond Projects, which started prior to the summer debt issuance. This program, in conjunction with the Refunding Ordinance, allows the City to begin construction and enter contracts with vendors; this prevents projects from being delayed due to the summer debt issuance. The program authorizes the City to issue up to $100 million dollars of commercial paper. After the issuance of commercial paper, the City has 270 days to roll the paper issuance into long-term debt. Utilizing this program with the annual Bond issuance ensures that projects are started, completed, and funded when needed. The city council reviews this item Annually. There have been no changes to the program since 2023, when it was revised to include the 2023 Bond Program. This is a standard program recorded in the City’s debt portfolio, and its usage, when needed, is approved by the Council. 24-2199 Utility System Revenue Commercial Paper Annual Refunding Authority Prior to Winter Storm Uri, the City established a Commercial Paper Program to fund utility capital projects outside of Bond Programs. This program, in conjunction with the Refunding Ordinance, allows the City to begin construction and enter into contracts with vendors, which prevents projects from being delayed due to the summer debt issuance. When Winter Storm Uri occurred, ERCOT required multi-million-dollar payments 30 Date: Nov. 22, 2024 Report No. 2025-009 throughout the week to allow DME to continue to provide power. The Council renews this program annually. The only program change from inception in 2021 is the increase from $100 million to $300 million in the same year as established. This program, like the General Obligations Commercial Paper Annual Refunding Authority, is to fund utility capital projects outside of the Bond Programs. As listed above, it may also be used in an emergency like Uri. Within 270 days of the issuance of commercial paper, the City refunds the issuance into a long-term investment vessel, like our Summer Debt issuance. The program allows for issuance of up to $300 million dollars, with approval of this Council. 24-2200 Debt Service Management Policy Annual Review The City’s Debt Service Management Policy was originally developed in 1995 and adopted by the City Council on March 5, 1996. On April 20, 2010, the Council adopted revisions to the policy, including the requirement that the policy be reviewed at least annually to ensure compliance with statutory and Securities and Exchange Commission (SEC) requirements. The Debt Service Management Policy provides general guidelines by which the City will issue debt and addresses the issues of process, use, and limitations. After reviewing the existing Debt Service Management Policy with the City’s Financial Advisor, Bond Counsel, and internal Investment and Debt Management Committee, the following revisions are being proposed: Administrative Maintenance: Removal of Controller from Debt Committee The removal of the Controller from the committee came following a discussion of internal control. This position, in completion of its duties, should remain outside of this Committee. For that reason, the Controller is removed from the Committee. This leaves the Committee with four members: the City Manager, the Chief Financial Officer, the Assistant Director of Finance, and the Treasury Manager. Consultants to the committee are the City’s investment advisor and bond counsel. When needed, a representative of the City’s legal department will act as a legal advisor; the City’s internal auditor serves as a non-voting member. Add language to solidify the annual completion of the Conflict-of-Interest form The language is added to this contract to solidify the annual completion of Conflict- of-Interest forms. 24-2201 Investment Policy Annual Review The Public Funds Investment Act in the state of Texas requires all public entities to maintain and review an investment policy in accordance with the provisions of the Public Funds Investment Act of Tex. Gov’t. Code Chapter 2256. The Public Funds Investment Act seeks to ensure the security of public funds during investment activities. This policy 31 Date: Nov. 22, 2024 Report No. 2025-009 outlines how the City will invest funds and helps align our investment strategy with the following prioritized objectives under Texas Gov’t. Code Sec. 22556(d). This policy is reviewed for compliance by the City’s financial advisor and is further reviewed by the Government Treasurers of Texas. DISCUSSION: During the Nov. 19 City Council Meeting, Council Member Jester asked questions about the notification process for solicitation of Merchant Services Card Processing. To ensure every supplier can submit a proposal/bid for a city solicitation, the Purchasing/Procurement Department does the following: Every solicitation that is issued to suppliers is listed in our electronic bidding software (Ionwave). Vendors may register for the commodity code related to the good or service they offer. Ionwave uses the National Institute of Government Purchasing (NIGP) commodity codes. These codes are nationally recognized category codes for commodities and services in public procurement. Every supplier that is registered under the NIGP code(s) for the solicitation will receive an email with the invitation to bid, a link to our online bidding software, and information about the solicitation. The City also searches the State of Texas Centralized Master Bidders List (CMBL) for suppliers registered under the NIGP code(s) and directly emails them the invitation to bid. The solicitation is advertised in the Denton Record-Chronicle at least once a week for two consecutive weeks. Procurement asks that the department research possible suppliers and submit emails for those suppliers. If emails are supplied, Procurement directly emails the bid to the suppliers. All solicitations are accessible through the City of Denton Procurement page under open solicitations - Procurement | Denton, TX For the item referenced, the Scope of Work requested bidders to submit a non-fee-based pricing schedule due to previous Public Utility Board and City Council direction. This direction asked that card processing fees not be passed to the customer. This direction was generally given because payment processing fees were being considered as part of the cost of doing business and the card regulations tied to customer fee programs are complicated and in constant flux. Due to this, departments have budgeted to pay for card processing expenses along with the expenses incurred in accepting cash and check payments.
