Monthly Financial Reports – The Monthly Financial Report provides a comprehensive overview of the City of Denton's financial performance, including key revenue and expenditure highlights, as well as budget variances. Parks and Recreation Magazine Article – Denton Parks and Recreation's data dashboards were recently featured in Parks and Recreation Magazine in an article co-authored by Director Gary Packan. The "Parks and Recreation Performance Scorecard" offers over 40 updated charts, tracking service delivery and progress toward the Parks, Recreation, and Trails System Master Plan. The article highlights the department's effective data sharing with staff and the public. The National Recreation and Parks Association, the leading professional organization for parks and recreation professionals, publishes Parks and Recreation Magazine. Denton County Days at the Texas Capitol – On April 2 and 3, a delegation of Denton leaders, including Mayor Hudspeth, Mayor Pro Tem Meltzer, Council Members Beck, Jester, and McGee, participated in Denton County Days at the Texas Capitol. This advocacy event, coordinated by Denton County and local Chambers of Commerce, provided an invaluable platform to engage with state agencies and our representatives in the Texas Legislature. The City's representatives effectively communicated Denton's key legislative priorities, outlined in the attached Legislative Program. Their discussions with state legislators centered on vital issues such as maintaining local control over land use and development, safeguarding cities' capacity to fund essential infrastructure, and advocating for increased state investment in water and wastewater infrastructure to meet Denton’s growing needs. This direct engagement ensures Denton's voice is heard on matters critical to the community's future. Staff contact: Kristi Fogle, City Manager’s Office D. Mayor’s Pet Spotlight – Rosie is a young American Pit Bull Terrier, just shy of her first birthday at 10 months old. She has been in the shelter since Dec. 27, 2024, and staff are eager to help find her a loving home. Rosie is housebroken and leash trained, making her an easy addition to any household. She will thrive in a household where she is the only pet. She has a playful spirit and loves toys. Her food motivation makes her responsive to training and eager to learn new tricks. Rosie is highly social with people and thrives on human interaction, doing best in a home where she can receive plenty of attention. The shelter environment is not ideal for Rosie; she needs a home where she can relax and be herself. Rosie has a lot of love to give and would make an excellent companion for the right person or family. Staff contact: Bailey Coleson, Animal Services. 2 Responses to Council Member Requests for Information A.Street and Sidewalk Repair – On March 12, Mayor Hudspeth shared an inquiry from a resident regarding street and sidewalk conditions in their neighborhood. Staff evaluated theconditions, and Fowler Drive does not meet the criteria for reconstruction, but thesidewalks does. Staff will continue to monitor the street and perform maintenance asnecessary and sidewalk design will begin this year, with replacement planned for nextfiscal year. Staff contact: Daniel Kremer, Streets B.Highway Safety Improvement Program (HSIP) Application – On March 21, Mayor ProTem Meltzer shared an inquiry from a resident regarding the HSIP application. Staffinformed the resident that the most effective avenue of support for the application is a letterfrom City leadership. To advance legislation that addresses shared priorities and enhances the well-being of the entire Denton area, the City supports the following initiatives: • Expand access to affordable mental health care through legislation and funding. • Support legislation and funding for community-based services for individuals experiencing homelessness. • Protect the autonomy of local officials to make decisions in the best interest of their communities. • Oppose restrictions on cities' ability to contract with registered lobbyists for legislative services. If restrictions are imposed, allow cities to maintain contracts for non-lobbying legislative services, such as bill analysis and tracking. • Support legislation that enhances the City’s vibrant community and economy including affordable housing, economic development agreements, environmental sustainability, public and higher education funding, public safety, and tourism. City Services • Support legislation that designates essential city employees, like solid waste, utilities, and animal control officers, as first responders. • Support legislation mandating that retail pet stores only sell animals acquired from animal control agencies, shelters, or rescue organizations, and require stores to maintain records of the animals’ origins. • Support legislation that restores a city’s ability to regulate retail pet stores. • Support legislation and funding for the Texas Parks and Wildlife Department’s Local Parks Grant Program. • Oppose legislation that limits franchise fee authority for solid waste services. • Oppose legislation that restricts libraries' authority to make decisions regarding materials, implements a state-issued rating system for purchases, or prohibits libraries from hosting community events. Land Use & Development • Support legislation that protects and clarifies the City’s role in requests for removal from their extraterritorial jurisdictions (ETJ). • Support legislation that preserves the City’s authority to establish lot sizes, parking requirements, density, and accessory dwelling unit (ADU) requirements within city limits. • Oppose legislation that restricts a city’s authority over development issues, including annexation, eminent domain, zoning, regulatory takings, building codes, tree preservation, short-term rentals, and manufactured housing. • Oppose legislation that diminishes the City’s authority to manage and control its rights-of-way, including limitations on requiring dedications or studies as part of plat submissions. 4 City DENTON State Legislative Program 89th Texas Legislature Municipal Court • Support legislation that amends extended-term protective orders to include offenses against pregnant individuals and those involving strangulation. • Support legislation that creates a nominal court fee to provide need-based funding for court-appointed attorneys in Class C misdemeanor cases. • Support legislation that improves virtual or remote access for defendants in municipal court. • Oppose legislation that eliminates the option of issuing warrants for Class C misdemeanors. Taxation & Financial Strategies • Support legislation allowing municipalities to issue debt and protecting debt issuances. • Support increasing the competitive bidding threshold to reflect rising costs and inflation. • Oppose legislation limiting a city’s ability to issue Certificates of Obligation (COs) and levy necessary fees. Transportation & Aviation • Support legislation that invests in the State’s multimodal transportation systems and increases funding for growing urban areas. • Support legislation that provides cities with greater flexibility to fund local transportation projects. • Support legislation that invests in the State’s aviation program capital improvement. Utilities • Support legislation that increases state grant funding to the Texas Water Development Board, in alignment with the priorities outlined in the State Water Plan. • Support legislation that promotes direct potable reuse water, and other water conservation initiatives. • Support legislation that clearly defines technology resources capable of meeting the goals of the Dispatchable Reliability Reserve Service. • Support legislation that classifies electric power generation units as critical infrastructure, giving them the same priority protections as entities with priority access to natural gas during emergencies. • Oppose any legislation that restricts large load interconnections to the distribution systems of Municipal-Owned Utilities (MOUs). • Oppose legislation that creates unfunded mandates on Municipal-Owned Utilities. 5 April 4, 2025 Report No. 2025-038 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Sale of Transmission System Assets by the Texas Municipal Power Agency (“TMPA”) to the City of Bryan, Texas. EXECUTIVE SUMMARY: On March 13, 2025, the TMPA Board of Directors approved Resolution No. 2025-3-4 (attached) approving the sale of certain transmission assets to the City of Bryan, Texas pending approval by the governing bodies of each member city. In accordance with the 2016 Joint Operating Agreement between TMPA and the Member Cities, approval of the sale of transmission assets having an aggregate net book value in excess of $500,000 in any fiscal year but must approved by member cities. The proposed assets to be sold have a net book value of $3,238,620. In conjunction with this sale but under separate action not requiring approval from member cities, TMPA will purchase certain transmission assets from the City of Bryan, Texas have a net book value of $2,260,339 and also own additional transmission assets valued at $4,786,000 which are under construction. Consideration and approval of this item is schedule for April 14th for the Public Utilities Board and May 6th for the City Council. DISCUSSION: The City of Bryan owns the Dansby and Bryan East substations. TMPA owns equipment in these substations. The TMPA and Bryan equipment in the Dansby and Bryan East substations have, over the years, been comingled together to such an extent, that the situation has created operational, maintenance, and regulatory issues for Bryan and TMPA. The Resolution that is proposed for consideration and action would resolve these issues by transferring ownership of the substation equipment to Bryan. The following is a summary of the terms and conditions of the proposed Asset Purchase Agreement: -Bryan would purchase from TMPA the substation assets for net book value, $3,238,620. -TMPA would reserve the right to construct new transmission lines connecting to the substations. -TMPA would purchase from Bryan the Gibbons Creek to Greens Prairie 138 kV transmission line for net book value, $251,648. Bryan would reserve and continue to operate its electric distribution system that is built under the transmission line. -TMPA would purchase from Bryan equipment (consisting mainly of poles) owned by Bryan in the Agency’s Gibbons Creek to Bryan East 138 kV transmission line for net book value, $2,008,691. 6 April 4, 2025 Report No. 2025-038 -Bryan has initiated a project to reconductor the Gibbons Creek to Greens Prairie 138 kV transmission line (the “Gibbons Creek to Greens Prairie 138 kV Reconductor Project”). TMPA will acquire this Project. At closing, TMPA would reimburse Bryan for actual costs incurred as of the date of closing. Thereafter, Bryan would continue to construct the Project to completion with the costs of the Project being borne by TMPA. The Resolution appropriates $4,786,000 for this Project. Since the net book value of the transmission assets being sold to Bryan exceed $500,000 in the aggregate, TMPA is required under the Joint Operating Agreement to obtain approval of this transaction from the four Member Cities. CONCLUSION: In conjunction with the purchase and ownership of transmission system assets by TMPA from the City of Bryan, Texas, the value proposition for TMPA is beneficial to the City of Denton. These transactions add $3,807,719 in additional value to TMPA and since the City’s ownership share is 21.3%, it’ll add an additional $811,044 in value compared to the current transmission system value. This incremental increase in value will create additional transmission revenue that will be allocated annually to the City of Denton. Approximately 723 acres remain which are currently being marketed for sale. Remaining acreage was never mined, has highway frontage, and is likely valued higher on a per acre basis. ➢Transmission Assets –Possible unbundling and transfer of ownership to each member city.
