General Information & Status Updates
A. Recreation Center Temporary Closures – The Denton Senior Center will be closed July
17-19 for HVAC replacement, and North Lakes Recreation Center will be closed July 21-
August 2 for structural repairs. Memberships will remain valid at all other recreation center locations, and staff will attempt to relocate or reschedule any affected programs and will only cancel programs in those cases where rescheduling or relocation is not possible. A communication plan to inform patrons impacted by these temporary closures will be

B. Mayor’s Pet Spotlight – Chumkin is a 15-year-old Shi tzu. This old gal has no time for drama, just a deep appreciation for the simple things: booty scratches, slow strolls around the house, and
long peaceful naps. Chumkin is independent, undemanding, and
easy to have a good relationship with. She co-exists with dogs, cats, and kids without issue. She’s reliably potty trained, too. We don’t know much about her past, but it seems like getting loved on is a new experience for her; she warms up quickly! What this
senior Shi tzu lady needs is a soft bed, gentle hands, and someone

C. Denton Main Street Earns National Accreditation – The Denton Main Street has been awarded Accredited status by Main Street America, the organization’s highest recognition. This honor places Denton among the top downtown programs in the country, with only
872 of the nation’s 1,172 designated Main Street programs reaching this level of
achievement. Accreditation is awarded to programs that show a strong commitment to downtown revitalization. Recipients must demonstrate excellence in leadership, diversified funding, strategic programming, preservation-based economic development, and measurable community impact. The Main Street program demonstrates these principles
through a four-point strategy including: economic vitality, design, promotion, and organization. Highlights include: 2024 Downtown Sign Program, Twilight Tunes, Arts& Autos, Wassail Fest, and seasonal Shop Small Crawls; and the Main Street Dollars e-gift card program to keep spending local. In 2025, the City launched the Downtown Lowdown newsletter to promote events and resources for property and business owners, including
retail roundtables, mixers, training sessions, and over 1,200 volunteer hours, along with leadership participation at national and state-level conferences. In 2024, the City established a Main Street program Masterclass. The City of Denton Office of Economic Development manages the Main Street Program Certification in collaboration with the Denton Main Street Association 501c6 The National Main Street press release can be found

Responses to Council Member Requests for Information
A. Sunset Street Completion Date – On June 30, Mayor Hudspeth inquired about the
construction completion date for Sunset Street. The roadway reconstruction of Sunset Street between University Drive and Carroll Boulevard will be constructed in two sections as part of the Neighborhood 2 & 6 project. The eastbound lane is currently under construction with an anticipated completion date of Aug. 15. The westbound lane will begin construction on Aug. 18, with a final completion date of Nov. 2025. Marketing and
Communications assisted with a social media campaign informing patrons of the continued accessibility, and to encourage business visits. Staff contact: Scott Fettig, Capital Projects B. Construction on Huisache Street – On June 30, Mayor Hudspeth requested an update on the Huisache Street construction. Work began on April 28 with the replacement of utilities,
which has been completed. Roadway reconstruction is currently underway. Paving is
scheduled to start on July 22. The estimated final completion is Sept. 5. Staff contact: Dante Hale, Capital Projects C. Active Adult Center Update – On July 2, Mayor Pro Tem Rumohr shared a request for an
update on the progress of the active adult center. In 2023, City of Denton residents passed
Proposition F to issue bonds for a new active adult center. These bonds are scheduled for issuance in 2026, and no construction activities have commenced yet. The active adult center is listed on the Public Dashboard where updates can be viewed, along with other City initiatives. Staff contact: Gary Packan, Parks and Recreation
D. Livestock Riding or Driving on Public Streets – On July 8, Mayor Hudspeth inquired
whether the City of Denton has requirements for a horse-drawn carriage as part of a funeral
procession. Staff investigated and determined the only allowance for horses to be ridden or
driven on public property is for parades per the City of Denton Code of Ordinances (Sec.

E. Placement of Objects in City Cemeteries – On July 8, Council Member Byrd inquired about
the rules and regulations for placing personal offerings to loved ones at City-owned
cemeteries. Acceptable decorations include small flags, floral arrangements in permanent
headstone vases, and certain special arrangements. These items must not interfere with
maintenance or pose safety hazards. The City does not allow loose items, glass containers,
or decorations that extend beyond the headstone, as they can be easily displaced or
damaged during severe weather and routine maintenance. The City installed new signage
with these rules in both English and Spanish at both Oakwood and IOOF Cemeteries in

F. West Oak Street Sidewalk – On July 2, Mayor Pro Tem Rumohr requested an update on
the project along West Oak Street, which impacts sidewalks along the south side of the
street. Staff visited the area and determined this is not a City-owned project. MasTec is
currently backfilling the excavation from an Atmos Energy project. The Public Works
Inspection team is collaborating with MasTec to ensure proper restoration is completed
following the City’s right-of-way construction management ordinance and that City
specifications are followed. Staff will verify the contractor restores the sidewalks with
proper accessibility by the project’s completion, which is scheduled for mid-Sept. Staff

G. Detention Basin on Sherman Drive – On July 9, Council Member Beck requested that staff inspect the detention basin at Sherman Drive and Hercules Lane. A detention basin is a
type of stormwater management facility rather than a natural pond or wildlife feature. The
purpose of a detention basin is to temporarily hold stormwater runoff during rain events and release it at a controlled rate to prevent downstream flooding. This detention basin should not hold water for more than 24 hours after a rain event when properly maintained.
The Homeowner’s Association (HOA) is responsible for the maintenance and care of this
detention basin which includes removing debris that could prevent proper stormwater flow or create unsanitary conditions and mowing the area (documented on the property plat). Staff has been in regular communication with the HOA regarding issues at this detention basin and are available to discuss or advise on any maintenance plans that the HOA has for
the detention basin or any modifications to the design of the detention basin to reduce the
need for future maintenance. The best way to prevent this from happening again would be for the HOA to properly maintain the detention basin by keeping it clear of debris, silt, and any obstruction to the
flow of water. The detention basin will not hold water when it is properly maintained and

INFORMAL STAFF REPORT

SUBJECT:
Non-Competitive 4% Low Income Housing Tax Credit Financing
BACKGROUND:
Housing Tax Credits
The Housing Tax Credit program is the largest public funding source in the nation for affordable
rental homes. Housing Tax Credits are funded federally and administered by states. In Texas, the
program is administered by the Texas Department of Housing and Community Affairs (TDHCA).
There are two types of Housing Tax Credits (HTC):
4% HTC • Non-Competitive
• Applications accepted year-round
• Allows the developer to reduce federal tax burden by a proportion of
eligible construction costs, 30% of the development costs.
• Requires resolution of no objection from municipality
• Must be at least 50% funded by Multifamily Housing Revenue Bonds
9% HTC • Competitive
• Application occurs once per year
• Allows the developer to reduce federal tax burden by a proportion of the eligible construction costs, 70% of the development costs.
• Requires resolution of support from municipality
Multifamily Housing Revenue Bonds
Because a 4% Housing Tax Credit only covers approximately 30% of a development’s equity,
developments must seek other sources of funding. Per Internal Revenue Code1, 4% Housing Tax
Credit developments are required to finance at least 50% of the cost of land and construction using
Multifamily Housing Revenue Bonds. The State has a set amount of tax-exempt Private Activity
Bonds which can be issued in Texas each year, including Multifamily Housing Revenue Bonds.
The Texas Bond Review Board administers the Private Activity Bond program and issues
Certificates of Reservation to 4% Housing Tax Credit developments, stating that one of the state’s
tax-exempt Private Activity Bonds may go to that development.
Afterwards, the development must find an approved government entity to issue the bond on a
conduit basis. Then the bond is purchased by a private investor to fund the cost of development.
These bonds do not create a debt or liability to the State of Texas or taxpayers of the jurisdiction.

Developers have options for conduit bond issuers, including Texas Department of Community
Affairs (TDHCA), but they may also partner with a conduit issuer local to the development.
Denton Housing Authority (DHA) is authorized to issue Multifamily Housing Revenue Bonds.
Under the Internal Revenue Code2, bond issuers are required to receive approval from the elected
body that governs them. The City of Denton’s City Council is the elected body that governs DHA.
DISCUSSION:
There are two potential development projects in Denton seeking a 4% Housing Tax Credits award
in 2025 and an accompanying Multifamily Housing Revenue Bond. Both project developers have
partnered with DHA as the conduit issuer, who will need the bond issuance approved by the City
of Denton. If approved, no debt obligation will be created for the City of Denton. If not
approved, the developers would have to seek Multifamily Housing Revenue Bonds elsewhere and
the projects may be at risk.
Roselawn Village
Roselawn Village Apartments is a 4% Housing Tax Credit Development proposed for 2800
Roselawn Dr. On February 18, 2025, City Council approved a Resolution of No Objection for the
developer’s application to TDHCA for the tax credit (ID 25-103).
Waterford at Spencer Oaks
The Waterford at Spencer Oaks Apartments is an existing apartment complex at 2100 Spencer Rd,
Denton, TX 76205. Its’ construction was funded by Housing Tax Credits in 1996. Their
affordability commitments last 30 years, and would otherwise expire next year in 2026, with the
apartments converting to market rate. By undergoing a rehabilitation with Housing Tax Credit
funding, the development would recommit to affordability for another 30 years. A Resolution of
No Objection to their application for the 4% Housing Tax Credit award will be brought to City
Council on the July 22 agenda for Public Hearing.
Bond Issuance
Both projects have selected DHA as the conduit issuer for their required Multifamily Housing
Revenue Bonds. DHA will hold the public hearings at 1225 Wilson St., Denton, Texas 76205 on
July 10 at 10 a.m. (Roselawn Village) and 11 a.m. (Waterford at Spencer Oaks). Approval for a
DHA bond issuance has not been considered by the City Council since Sep. 20, 2022. The City’s
process has been to place this item on the consent agenda. Staff will place the approval of these
bonds for both developments on the Aug. 5 Consent Agenda. Staff will bring proposed
amendments to the HTC process later this year that include approving bond issuance for projects
concurrently with approving the Resolution of No Objection when possible.
